68 | 68 | | confederation, alliance, network, conspiracy, understanding, |

69 | 69 | | or other similar arrangement in law or in fact, including a |
---|
70 | 70 | | streetgang as defined in Section 13A-6-26, of three or more |
---|
71 | 71 | | persons, through its membership or through the agency of any |
---|
72 | 72 | | member, that engages in a course or pattern of criminal |

73 | 73 | | activity. |

74 | 74 | | (2)(3) CRIMINAL ENTERPRISE MEMBER. a. An individual who |
---|
75 | 75 | | meets three or more of the following at the time of the |
---|
76 | 76 | | planning or commission of the underlying offense: |
---|
77 | 77 | | a.1. Admits to criminal enterprise membership. |
---|
78 | 78 | | b.2. Is voluntarily identified as a criminal enterprise |
---|
79 | 79 | | member by a parent or guardian. |
---|
80 | 80 | | c.3. Is identified as a criminal enterprise member by a |
---|
81 | 81 | | reliable informant. |
---|
82 | 82 | | d.4. Adopts the style of dress of a criminal |
---|
83 | 83 | | enterprise. |
---|
84 | 84 | | e.5. Adopts the use of a hand sign identified as used |
---|
85 | 85 | | by a criminal enterprise. |
---|
86 | 86 | | f.6. Has a tattoo identified as used by a criminal |

134 | 134 | | satisfied for the purposes of this subdivisiondefinition. |

135 | 135 | | (4) CRIMINAL JUSTICE AGENCY. Any federal law |
---|
136 | 136 | | enforcement agency, prosecuting agency, or corrections agency, |
---|
137 | 137 | | or any state, county, or municipal law enforcement agency, |
---|
138 | 138 | | prosecuting agency, or corrections agency in this state. |
---|
139 | 139 | | (5) DATABASE. The Alabama Criminal Enterprise Database. |
---|
140 | 140 | | (6) DATABASE INFORMATION. Either of the following: |
---|
141 | 141 | | a. Any contents of the database. |
---|
142 | 142 | | b. Any records, including electronically stored |
---|
143 | 143 | | information, that are generated or transmitted to ALEA's |
---|
144 | 144 | | possession, custody, or control due to a criminal justice |
---|
145 | 145 | | agency's submission of information for inclusion in the |
---|
146 | 146 | | database. |
---|
147 | 147 | | (3)(7) DESTRUCTIVE DEVICE. The same meaning as in |
---|
148 | 148 | | Section 13A-10-190. |
---|
149 | 149 | | (4)(8) FIREARM. Any of the following: |

---|

191 | 191 | | (6)(10) MACHINE GUN. Any weapon that shoots, is |

192 | 192 | | designed to shoot, or can be readily restored to shoot |

193 | 193 | | automatically more than one shot, without manual reloading, by |

194 | 194 | | a single function of the trigger. The term shall also include |
---|
195 | 195 | | the frame receiver of any such weapon, any part designed and |

196 | 196 | | intended solely and exclusively, or combination of parts |

197 | 197 | | designed and intended, for use in converting a weapon into a |
---|
198 | 198 | | machine gun, and any combination of parts from which a machine |

199 | 199 | | gun can be assembled if such parts are in the possession or |

200 | 200 | | under the control of a person. |

243 | 243 | | (b) ALEA shall establish, develop, manage, and maintain |

244 | 244 | | the database in accordance with the Criminal Intelligence |
---|
245 | 245 | | Systems Operating Policies adopted by the United States |
---|
246 | 246 | | Department of Justice and codified in 28 C.F.R. Part 23. |
---|
247 | 247 | | (c) Any criminal justice agency may submit information |
---|
248 | 248 | | for inclusion in the database. |
---|
249 | 249 | | (d) To the extent permitted under subsection (b), the |
---|
250 | 250 | | database may contain any information about a person reasonably |
---|
251 | 251 | | suspected of criminal conduct or activity that meets both of |
---|
252 | 252 | | the following criteria: |
---|
253 | 253 | | (1) The information is relevant to the person's |
---|
254 | 254 | | suspected criminal conduct or activity. |
---|
255 | 255 | | (2) The information is relevant to identifying an |
---|
256 | 256 | | individual as a criminal enterprise member or identifying a |
---|
257 | 257 | | criminal enterprise. |
---|
258 | 258 | | (e) Subject to rules established by the secretary, any |
---|
259 | 259 | | criminal justice agency may access the database for legitimate |
---|
260 | 260 | | law enforcement or criminal justice purposes. |
---|
261 | 261 | | (f) ALEA may not permit any person or entity to access |
---|
262 | 262 | | database information in its possession, custody, or control |
---|
263 | 263 | | unless one of the following conditions applies: |
---|
264 | 264 | | (1) The access is made by personnel of a criminal |
---|
265 | 265 | | justice agency pursuant to subsection (e). |
---|
266 | 266 | | (2) The access is necessary for ALEA to establish, |
---|
267 | 267 | | develop, manage, or maintain the database. |

268 | 268 | | (3) The access is necessary for ALEA to comply with a |

307 | 307 | | or be subject to discovery by subpoena or otherwise, except as |
---|
308 | 308 | | required by subsection (b), the Constitution of Alabama of |
---|
309 | 309 | | 2022, the Constitution of the United States, or as necessary |
---|
310 | 310 | | for a criminal justice agency to pursue a legitimate law |
---|
311 | 311 | | enforcement or criminal justice purpose. |
---|
312 | 312 | | (i) Nothing in this section shall affect the |
---|
313 | 313 | | disclosure, discovery, or admissibility of information that a |
---|
314 | 314 | | criminal justice agency has in its possession, custody, or |
---|
315 | 315 | | control by any means other than the agency's access to the |
---|
316 | 316 | | database or submission of information to the database. |
---|
317 | 317 | | (j)(1) The secretary shall adopt rules establishing a |
---|
318 | 318 | | uniform digital process for criminal justice agencies to |
---|
319 | 319 | | submit information for inclusion in the database. |
---|
320 | 320 | | (2) The secretary shall adopt rules regarding the use |
---|
321 | 321 | | of database information and may establish and impose civil |
---|
322 | 322 | | penalties and other sanctions for the violation of such rules. |
---|
323 | 323 | | (3) The secretary may adopt rules that otherwise |
---|
324 | 324 | | promote the effective establishment, development, management, |

325 | 325 | | maintenance, or use of the database in compliance with federal |
