1515 SYNOPSIS:
1616 This bill would direct the Alabama State Law
1717 Enforcement Agency to establish, develop, manage, and
1818 maintain the Alabama Criminal Enterprise Database.
1919 This bill would also provide for submission to
2020 and use of the database.

2323 AN ACT
2424 Relating to crimes and offenses; to amend Section
2525 13A-6-260, Code of Alabama 1975, to further provide for
2626 definitions; and to add Section 13A-6-264 to the Code of
2727 Alabama 1975, to provide for the establishment, development,
2828 management, and maintenance of the Alabama Criminal Enterprise
2929 Database.
3030 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
3131 Section 1. Section 13A-6-260, Code of Alabama 1975, is
3232 amended to read as follows:
3333 "§13A-6-260
3434 For the purposes of this article, the following terms
3535 have the following meanings:
3636 (1) ALEA. The Alabama State Law Enforcement Agency.

6666 (1) ALEA. The Alabama State Law Enforcement Agency.
6767 (1)(2) CRIMINAL ENTERPRISE. Any combination,
6868 confederation, alliance, network, conspiracy, understanding,
6969 or other similar arrangement in law or in fact, including a
7070 streetgang as defined in Section 13A-6-26, of three or more
7171 persons, through its membership or through the agency of any
7272 member, that engages in a course or pattern of criminal
7373 activity.
7474 (2)(3) CRIMINAL ENTERPRISE MEMBER. a. An individual who
7575 meets three or more of the following at the time of the
7676 planning or commission of the underlying offense:
7777 a.1. Admits to criminal enterprise membership.
7878 b.2. Is voluntarily identified as a criminal enterprise
7979 member by a parent or guardian.
8080 c.3. Is identified as a criminal enterprise member by a
8181 reliable informant.
8282 d.4. Adopts the style of dress of a criminal
8383 enterprise.
8484 e.5. Adopts the use of a hand sign identified as used
8585 by a criminal enterprise.
8686 f.6. Has a tattoo identified as used by a criminal
8787 enterprise.
8888 g.7. Associates with one or more known criminal
8989 enterprise members.
9090 h.8. Is identified as a criminal enterprise member by
9191 physical evidence.
9292 i.9. Has been observed in the company of one or more
9393 known criminal enterprise members four or more times.
9494 Observation in a custodial setting requires a willful

124124 Observation in a custodial setting requires a willful
125125 association. This paragraph may be used to identify criminal
126126 enterprise members who recruit and organize in jails, prisons,
127127 and or other detention settings.
128128 j.10. Has authored any communication indicating
129129 responsibility for the commission of any crime by a criminal
130130 enterprise.
131131 b. Where a single act or factual transaction satisfied
132132 the requirements of more than one of the criteria in this
133133 subdivisionparagraph a., each of those criteria has been
134134 satisfied for the purposes of this subdivisiondefinition.
135135 (4) CRIMINAL JUSTICE AGENCY. Any federal law
136136 enforcement agency, prosecuting agency, or corrections agency,
137137 or any state, county, or municipal law enforcement agency,
138138 prosecuting agency, or corrections agency in this state.
139139 (5) DATABASE. The Alabama Criminal Enterprise Database.
140140 (6) DATABASE INFORMATION. Either of the following:
141141 a. Any contents of the database.
142142 b. Any records, including electronically stored
143143 information, that are generated or transmitted to ALEA's
144144 possession, custody, or control due to a criminal justice
145145 agency's submission of information for inclusion in the
146146 database.
147147 (3)(7) DESTRUCTIVE DEVICE. The same meaning as in
148148 Section 13A-10-190.
149149 (4)(8) FIREARM. Any of the following:
150150 a. Any weapon which will, is designed to, or may be
151151 readily be converted to expel a projectile by the action of an
152152 explosive or the frame or receiver of any such weapon.

182182 explosive or the frame or receiver of any such weapon.
183183 b. A firearm silencer.
184184 c. A destructive device.
185185 (5)(9) FIREARMS SILENCER. Any device for silencing,
186186 muffling, or diminishing the report of a portable firearm,
187187 including any combination of parts, designed or redesigned,
188188 and intended for use in assembling or fabricating a firearm
189189 silencer, and any part intended only for use in such assembly
190190 or fabrication.
191191 (6)(10) MACHINE GUN. Any weapon that shoots, is
192192 designed to shoot, or can be readily restored to shoot
193193 automatically more than one shot, without manual reloading, by
194194 a single function of the trigger. The term shall also include
195195 the frame receiver of any such weapon, any part designed and
196196 intended solely and exclusively, or combination of parts
197197 designed and intended, for use in converting a weapon into a
198198 machine gun, and any combination of parts from which a machine
199199 gun can be assembled if such parts are in the possession or
200200 under the control of a person.
201201 (11) SECRETARY. The Secretary of ALEA.
202202 (7)(12) SHORT-BARRELED RIFLE. The same meaning as in
203203 Section 13A-11-62.
204204 (8)(13) SHORT-BARRELED SHOTGUN. The same meaning as in
205205 Section 13A-11-62."
206206 Section 2. Section 13A-6-264 is added to the Code of
207207 Alabama 1975, to read as follows:

209209 (a) Subject to the availability of funding, ALEA shall
210210 establish a statewide inter-jurisdictional criminal

240240 establish a statewide inter-jurisdictional criminal
241241 intelligence system known as the Alabama Criminal Enterprise
242242 Database.
243243 (b) ALEA shall establish, develop, manage, and maintain
244244 the database in accordance with the Criminal Intelligence
245245 Systems Operating Policies adopted by the United States
246246 Department of Justice and codified in 28 C.F.R. Part 23.
247247 (c) Any criminal justice agency may submit information
248248 for inclusion in the database.
249249 (d) To the extent permitted under subsection (b), the
250250 database may contain any information about a person reasonably
251251 suspected of criminal conduct or activity that meets both of
252252 the following criteria:
253253 (1) The information is relevant to the person's
254254 suspected criminal conduct or activity.
255255 (2) The information is relevant to identifying an
256256 individual as a criminal enterprise member or identifying a
257257 criminal enterprise.
258258 (e) Subject to rules established by the secretary, any
259259 criminal justice agency may access the database for legitimate
260260 law enforcement or criminal justice purposes.
261261 (f) ALEA may not permit any person or entity to access
262262 database information in its possession, custody, or control
263263 unless one of the following conditions applies:
264264 (1) The access is made by personnel of a criminal
265265 justice agency pursuant to subsection (e).
266266 (2) The access is necessary for ALEA to establish,
267267 develop, manage, or maintain the database.
268268 (3) The access is necessary for ALEA to comply with a

298298 (3) The access is necessary for ALEA to comply with a
299299 court order, discovery request, or subpoena for the production
300300 of database information as authorized in subsection (h).
301301 (4) The access is permitted under subsection (b).
302302 (g) Database information shall be deemed confidential
303303 and shall not be subject to public disclosure under Article 3
304304 of Chapter 12 of Title 36, Code of Alabama 1975.
305305 (h) In any criminal, civil, or administrative
306306 proceeding, database information shall not be used as evidence
307307 or be subject to discovery by subpoena or otherwise, except as
308308 required by subsection (b), the Constitution of Alabama of
309309 2022, the Constitution of the United States, or as necessary
310310 for a criminal justice agency to pursue a legitimate law
311311 enforcement or criminal justice purpose.
312312 (i) Nothing in this section shall affect the
313313 disclosure, discovery, or admissibility of information that a
314314 criminal justice agency has in its possession, custody, or
315315 control by any means other than the agency's access to the
316316 database or submission of information to the database.
317317 (j)(1) The secretary shall adopt rules establishing a
318318 uniform digital process for criminal justice agencies to
319319 submit information for inclusion in the database.
320320 (2) The secretary shall adopt rules regarding the use
321321 of database information and may establish and impose civil
322322 penalties and other sanctions for the violation of such rules.
323323 (3) The secretary may adopt rules that otherwise
324324 promote the effective establishment, development, management,
325325 maintenance, or use of the database in compliance with federal
326326 standards.
