	15	+	SYNOPSIS:
	16	+	This bill would create the offense of aggravated
	17	+	theft of employee retirement benefits and would
	18	+	establish penalties for violations.
15	19		A BILL
16	20		TO BE ENTITLED
17	21		AN ACT
18	22		Relating to crimes and offenses; to add Section
19	23		13A-8-2.2 to the Code of Alabama 1975, to establish the crime
20	24		of aggravated theft of employee retirement benefits; and to
21	25		provide a criminal penalty for a violation.
22	26		BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
23	27		Section 1. Section 13A-8-2.2 is added to the Code of
24	28		Alabama 1975, to read as follows:
25	29		§13A-8-2.2
26	30		(a)(1) A person commits the crime of aggravated theft
27	31		of employee retirement benefits if the person embezzles,
28	32		steals, or unlawfully and willfully abstracts or converts to
29	33		his or her own use or to the use of another, any of the
30	34		monies, funds, premiums, credits, or other assets due to be
31	35		paid as contributions to any employee retirement benefit plan,
32	36		or to any fund connected with an employee retirement benefit
33		-	plan.
34		-	(2) For the purposes of this section, the term
35		-	"employee retirement benefit plan" includes, but is not
36		-	limited to, any plan under the Retirement Systems of Alabama
37		-	including the Teachers' Retirement System, the Employees'

	66	+	or to any fund connected with an employee retirement benefit
	67	+	plan.
	68	+	(2) For the purposes of this section, the term
	69	+	"employee retirement benefit plan" includes, but is not
	70	+	limited to, any plan under the Retirement Systems of Alabama
67	71		including the Teachers' Retirement System, the Employees'
68	72		Retirement System, and the Judicial Retirement Fund, and any
69	73		plan established under Chapter 27A or Chapter 27C of Title 36.
70		-	(b) It is an affirmative defense to a prosecution under
71		-	this section if an individual, in the course of his or her
72		-	employment, acts in good faith reliance upon the direction or
73		-	supervision of another under color of law or in a position of
