16+This bill would create the offense of aggravated
17+theft of employee retirement benefits and would
18+establish penalties for violations.

1822 Relating to crimes and offenses; to add Section
1923 13A-8-2.2 to the Code of Alabama 1975, to establish the crime
2024 of aggravated theft of employee retirement benefits; and to
2125 provide a criminal penalty for a violation.
2226 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
2327 Section 1. Section 13A-8-2.2 is added to the Code of
2428 Alabama 1975, to read as follows:
2529 ยง13A-8-2.2
2630 (a)(1) A person commits the crime of aggravated theft
2731 of employee retirement benefits if the person embezzles,
2832 steals, or unlawfully and willfully abstracts or converts to
2933 his or her own use or to the use of another, any of the
3034 monies, funds, premiums, credits, or other assets due to be
3135 paid as contributions to any employee retirement benefit plan,
3236 or to any fund connected with an employee retirement benefit
33-plan.
34-(2) For the purposes of this section, the term
35-"employee retirement benefit plan" includes, but is not
36-limited to, any plan under the Retirement Systems of Alabama
37-including the Teachers' Retirement System, the Employees'

66+or to any fund connected with an employee retirement benefit
67+plan.
68+(2) For the purposes of this section, the term
69+"employee retirement benefit plan" includes, but is not
70+limited to, any plan under the Retirement Systems of Alabama
6771 including the Teachers' Retirement System, the Employees'
6872 Retirement System, and the Judicial Retirement Fund, and any
6973 plan established under Chapter 27A or Chapter 27C of Title 36.
70-(b) It is an affirmative defense to a prosecution under
71-this section if an individual, in the course of his or her
72-employment, acts in good faith reliance upon the direction or
73-supervision of another under color of law or in a position of
74-authority.
