1515 SYNOPSIS:
1616 Under existing law, a municipality may enact an
1717 ordinance or resolution to levy a new tax or license
1818 fee or to increase the rate of any existing tax or
1919 license fee when the tax or license fee is otherwise
2020 authorized by law.
2121 This bill would provide that a municipality may
2222 only levy a new tax or license fee, or increase the
2323 rate of a tax or license fee, by ordinance.
2424 This bill would provide that the ordinance may
2525 not be considered for adoption until after a public
2626 hearing, and would require at least 30 days' notice
2727 before the public hearing.
2828 This bill would also provide for the
2929 requirements of the notice.

6565 regarding certain taxes and fees; and to require notice in
6666 certain circumstances.
6767 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
6868 Section 1. Section 11-45-2, Code of Alabama 1975, is
6969 amended to read as follows:
7070 "ยง11-45-2
7171 (a) The style of an ordinance of a city or town shall
7272 be, "Be it ordained by the city (or town) council of _______
7373 as follows:" inserting the name of the city or town as the
7474 case may be.
7575 (b)(1) No ordinance or resolution intended to be of
7676 permanent operation shall be adopted by the council at the
7777 same meeting at which it is introduced, unless unanimous
7878 consent of those present is given for the immediate
7979 consideration of such the ordinance or resolution, such with
8080 consent to be shown by a vote taken by yeas and nays, and the
8181 names of the members voting shall be entered upon the
8282 minutes,.
8383 (2)and no No ordinance or resolution intended to be of
8484 permanent operation shall become a law unless on its final
8585 passage a majority of the members elected to said the council
8686 in cities of over 12,000 inhabitants shall vote in its favor.
8787 (3) In all towns and in cities of less than 12,000
8888 population, an affirmative vote of a majority of the whole
8989 number of members of the council to which the corporation is
9090 entitled, including the mayor, shall be required to enact any
9191 ordinance or resolution intended to be of permanent operation.
9292 (c)(1)a. Notwithstanding subsection (b), any action of
9393 a council to adopt a new tax or license fee, or to increase

123123 a council to adopt a new tax or license fee, or to increase
124124 the rate of a tax or license fee, shall be subject to this
125125 subdivision.
126126 b. After the ordinance is introduced at a council
127127 meeting, a public hearing shall be held by the council after
128128 not less than 30 days' notice of the public hearing is given.
129129 c. The notice shall state all of the following:
130130 1. The substance of the proposed ordinance.
131131 2. The amount of any proposed new tax or license fee,
132132 or the amount of the increase in any tax or license fee.
133133 3. The date, time, and place of the public hearing.
134134 4. That a copy of the proposed ordinance may be
135135 obtained from the office of the municipal clerk.
136136 d. The notice shall be published in a newspaper of
137137 general circulation published in the municipality or otherwise
138138 in the same manner as the publication of an ordinance is
139139 provided for in Section 11-45-8(b).
140140 e. A representative of the municipality shall post a
141141 copy of the proposed ordinance on the website of the
142142 municipality, if the municipality has a website, and on the
143143 Secretary of State's open meetings website.
144144 f. After the public hearing, the proposed ordinance may
145145 be considered by the council at a regular council meeting.
146146 (c) The council shall award no contract on bids except
147147 by resolution."
148148 Section 2. This act shall become effective on October
149149 1, 2025.
