20	20	Relating to Jefferson County; to amend Section
21	21	45-37-233, Code of Alabama 1975, to further provide for pistol
22	22	permits and pistol permit fees.
23	23	BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
24	24	Section 1. Section 45-37-233, Code of Alabama 1975, is
25	25	amended to read as follows:
26	26	"§45-37-233
27	27	(a) This section shall be known as the Pistol Permit
28	28	Reduction Act of 1999 for Jefferson County.
29	29	(b) In Jefferson County, the total fee for issuance of
30	30	a one-year permit to carry a pistol as provided by Section
31	31	13A-11-75 shall be seven dollars and fifty cents ($7.50) per
32	32	year. The fee shall be paid by the sheriff to the county
33	33	treasurer, and the county treasurer shall distribute the seven
34	34	dollars and fifty cents ($7.50) as follows:
35	35	(1) Four dollars and fifty cents ($4.50) shall be
36	36	distributed to the retirement system established by Article
37	37	12.
38	38	(2) Fifty cents ($.50) shall be distributed to the
39	39	Jefferson County Sheriff's Fund.

70	70	(3)a. Two dollars and fifty cents ($2.50) shall be
71	71	distributed to a fund in the county treasury designated the
72	72	Jefferson County Legislative Delegation Office Fund to be
73	73	further distributed as provided herein.
74	74	b. Any amounts previously distributed and not expended
75	75	pursuant to this subdivision shall be transferred to the fund.
76	76	c. Any amounts in the fund over one hundred twenty
77	77	thousand dollars ($120,000) on April 10, 2014, shall
78	78	thereafter be distributed to the public school systems in the
79	79	county to be used for the operation of the public schools,
80	80	including, but not limited to, being used for school security,
81	81	on a pro rata basis based on the number of school students in
82	82	each school system, including the City of Gardendale School
83	83	System, to the total number of students in the county based on
84	84	enrollment numbers for the 2013-2014 school year as reported
85	85	to the State Department of Education.
86	86	d. Notwithstanding the distribution provided in the
87	87	preceding sentence paragraph c., in the event the City of
88	88	Gardendale School System has not been officially separated
89	89	from the Jefferson County School System at the time of any
90	90	distribution provided for therein, the portion of the funds
91	91	that would have been distributed to the City of Gardendale
92	92	School System based on the distribution formula provided
93	93	therein shall be distributed to the City of Gardendale to be
94	94	used only for the operation of the Gardendale School System
95	95	upon separation.
96	96	e. The remaining balance in the fund and any amounts
97	97	accruing pursuant to this subdivision after the distribution

127	127	accruing pursuant to this subdivision after the distribution
128	128	provided in the preceding sentence paragraph d. or the portion
129	129	needed thereof shall be spent for the operation of a
130	130	legislative office located in Birmingham.
131	131	(c) The total fee for issuance of a five-year permit to
132	132	carry a pistol as provided by Section 13A-11-75 shall be
133	133	thirty-seven dollars and fifty cents ($37.50). The fee shall
134	134	be paid by the sheriff to the county treasurer and the county
135	135	treasurer shall distribute the fee in the same proportions as
136	136	provided in subsection (b). "
137	137	Section 2. This act shall become effective on October
138	138	1, 2025.
