1515 SYNOPSIS:
1616 Under existing law, the existance and
1717 functioning of the Alabama Massage Therapy Licensing
1818 Board is under the temporary jurisdiction of the Board
1919 of Nursing and the Executive Director of the Board of
2020 Nursing.
2121 This bill would authorize the Executive Director
2222 of the Board of Nursing to designate an individual to
2323 perform certain powers, duties, and functions of the
2424 Alabama Massage Therapy Licensing Board on behalf of
2525 the executive director.
2626 This bill would define what constitutes an
2727 emergency order and provide further for other
2828 definitions.
2929 This bill would clarify that an individual
3030 practicing massage therapy pursuant to a temporary
3131 permit issued by the board is exempt from regulation by
3232 the board; and would change the annual meeting month of
3333 the board from October to November.
3434 This bill would require a majority vote of the
3535 membership of the board to discipline a licensee, would
3636 delete temporary or transitional provisions, and would
3737 provide further for the duties of the board.
3838 This bill would provide further for the
3939 qualifications for licensing and the contents of an

148148 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
149149 Section 1. Section 2 of Act 2024-361, 2024 Regular
150150 Session, is amended to read as follows:
151151 "Section 2. (a) The existence and functioning of the
152152 Alabama Board of Massage Therapy, created and functioning

183183 pursuant to Chapter 43 of Title 34, Code of Alabama 1975, is
184184 terminated, and those code sections are expressly repealed.
185185 (b)(1) Commencing on June 1, 2024, the Alabama Board of
186186 Massage Therapy shall be reconstituted as the Alabama Massage
187187 Therapy Licensing Board and all powers, duties, and functions
188188 of the new board shall be temporarily assumed and performed by
189189 the Board of Nursing pending the reconstitution of the Alabama
190190 Massage Therapy Licensing Board as provided in Chapter 43A of
191191 Title 34, Code of Alabama 1975. Additionally, commencing on
192192 June 1, 2024, the Executive Officer of the Board of Nursing ,
193193 or his or her designee, shall temporarily assume and perform
194194 all duties, responsibilities, and functions of the position of
195195 an executive director for the Alabama Massage Therapy
196196 Licensing Board, as defined in Section 34-43A-2, Code of
197197 Alabama 1975, pending the appointment of an executive director
198198 by the new Alabama Massage Therapy Licensing Board.
199199 (2) During the temporary transfer commencing on June 1,
200200 2024, all personnel of the Board of Nursing may act as agents
201201 of and may perform those duties, responsibilities, and
202202 functions determined necessary by the Executive Officer of the
203203 Board of Nursing , or his or her designee, to support the
204204 Alabama Massage Therapy Licensing Board, created in Chapter
205205 43A of Title 34, Code of Alabama 1975, until those duties,
206206 responsibilities, and functions temporarily assumed by the
207207 Executive Officer of the Board of Nursing , or his or her
208208 designee, pursuant to subdivision (1) are transferred to the
209209 executive director of the newly reconstituted Alabama Massage
210210 Therapy Licensing Board pursuant to subdivision (3). During

240240 Therapy Licensing Board pursuant to subdivision (3). During
241241 the temporary transfer the Board of Nursing, on behalf of the
242242 Alabama Massage Therapy Licensing Board, may employ and train
243243 individuals subject to the state Merit System for the Alabama
244244 Massage Therapy Licensing Board.
245245 (3) All powers, duties, and functions temporarily
246246 assumed and performed by the Board of Nursing and the
247247 Executive Officer of the Board of Nursing , or his or her
248248 designee, pursuant to subdivision (1), shall be transferred to
249249 the Alabama Massage Therapy Licensing Board, as created by
250250 Chapter 43A of Title 34, Code of Alabama 1975, on or before
251251 October 1, 2026.

257257 "§34-43A-2
258258 For purposes of this chapter, the following terms have
259259 the following meanings:
260260 (1) ADVERTISE. To distribute a card, flier, sign, or
261261 device to any individual or entity, or allow any sign or
262262 marking on any building, radio, television, or to publicize by
263263 any other means designed to attract public attention.
264264 (2) BOARD. The Alabama Massage Therapy Licensing Board
265265 created by this chapter.
266266 (3) EMERGENCY ORDER. The immediate suspension of a
267267 license without a hearing when the board determines that
268268 public safety is at immediate risk. An emergency order

298298 public safety is at immediate risk. An emergency order
299299 requires a licensee to cease practice pending a formal
300300 hearing. The term may also be referred to as the summary
301301 suspension of a license.
302302 (3)(4) EXAMINATION. The National Certification Board
303303 for Therapeutic Massage and Bodywork Examination or the
304304 Federation of State Massage Therapy Board's Massage and
305305 Bodywork Licensing Examination administered by an independent
306306 agency or another nationally or internationally accredited
307307 examination administered by an independent agency approved by
308308 the board, or state examination administered by the board or,
309309 at the discretion of the board, a state examination
310310 administered by the appropriate regulating body for massage
311311 therapy located in another state . The national examination
312312 shall be accredited by the National Commission for Certifying
313313 Agencies. The board may also administer a written, oral, or
314314 practical examination.
315315 (4)(5) EXECUTIVE DIRECTOR. The Executive Director of
316316 the Alabama Massage Therapy Licensing Board.
317317 (5)(6) LICENSE. The credential issued by the board
318318 which allows the holder to engage in the safe and ethical
319319 practice of massage therapy.
320320 (6)(7) MASSAGE THERAPIST. An individual licensed
321321 pursuant to this chapter who practices or administers massage
322322 therapy or related touch therapy modalities to a client for
323323 compensation.
324324 (7)(8) MASSAGE THERAPY ESTABLISHMENT. A site, premises,
325325 or business licensed by the board where massage therapy is
326326 practiced by a massage therapist.

357357 (8)(9) MASSAGE THERAPY INSTRUCTOR. A massage therapist
358358 who is approved by the board to teach the practice of massage
359359 therapy.
360360 (9)(10) MASSAGE THERAPY or RELATED TOUCH THERAPY
361361 MODALITIES. a. The mobilization of the soft tissue which may
362362 include skin, fascia, tendons, ligaments, and muscles for the
363363 purpose of establishing and maintaining good physical
364364 condition.
365365 b. The term includes effleurage, petrissage,
366366 tapotement, compression, vibration, stretching, heliotherapy,
367367 superficial hot and cold applications, topical applications,
368368 or other therapy that involves movement either by hand,
369369 forearm, elbow, or foot , or use of manual methods or
370370 mechanical or electrical devices or tools that mimic or
371371 enhance the action of human hands for the purpose of
372372 therapeutic massage, and any massage, movement therapy,
373373 massage technology, myotherapy, massotherapy, oriental massage
374374 technique, structural integration, acupressure, or polarity
375375 therapy.
376376 c. The term may include the external application and
377377 use of herbal or chemical preparations and lubricants
378378 including, but not limited to, salts, powders, liquids,
379379 nonprescription creams, cups, mechanical devices such as cups,
380380 T-bars, thumpers, body support systems, heat lamps, hot and
381381 cold packs, salt glow, steam cabinet baths, or hydrotherapy.
382382 d. The term does not include laser therapy, microwave,
383383 injection therapy, manipulation of the joints, or any
384384 diagnosis or treatment of an illness that normally involves

414414 diagnosis or treatment of an illness that normally involves
415415 the practice of medicine, chiropractic, physical therapy,
416416 podiatry, nursing, midwifery, occupational therapy,
417417 veterinary, acupuncture, osteopathy, orthopedics, hypnosis, or
418418 naturopathics.
419419 (10)(11) MASSAGE THERAPY SCHOOL. A school approved by
420420 the board where massage therapy is taught and which is one of
421421 the following:
422422 a. If located in Alabama, approved by the board as
423423 meeting the minimum established standards of training and
424424 curriculum as determined by the board.
425425 b. If located outside of Alabama, recognized by the
426426 board and by a regionally recognized professional accrediting
427427 body.
428428 c. A postgraduate training institute accredited by the
429429 Commission on Massage Therapy Accreditation.
430430 (11)(12) SEXUALLY-ORIENTED BUSINESS. A sex parlor,
431431 massage parlor, nude studio, modeling studio, love parlor,
432432 adult bookstore, adult movie theater, adult video arcade,
433433 adult motel, or other commercial enterprise which has the
434434 offering for sale, rent, or exhibit, or the exhibit of, items
435435 or services intended to provide sexual stimulation or sexual
436436 gratification to the client.
437437 (12)(13) STUDENT. Any individual who is enrolled in a
438438 massage therapy school."

440440 Except as specifically provided by this chapter, no
441441 individual may do any of the following unless licensed

473473 (1) Advertise that he or she performs massage therapy
474474 or related touch therapy modalities.
475475 (2) Hold himself or herself out to the public as a
476476 massage therapist, using any name or description denoting
477477 himself or herself as a massage therapist, or purporting to
478478 have the skills necessary to perform massage therapy.
479479 (3) Practice massage therapy on the general public for
480480 compensation."
481481 "§34-43A-4
482482 (a) The following individuals, offices, and
483483 establishments are exempt from this chapter:
484484 (1) A student who is rendering massage therapy services
485485 under the supervision of a massage therapy instructor , or any
486486 other supervisory arrangement recognized and approved by the
487487 board, including, but not limited to, a temporary permit . A
488488 student shall be designated by title clearly indicating his or
489489 her training status.
490490 (2) An individual practicing massage therapy pursuant
491491 to a temporary permit issued by the board.
492492 (2)(3) A qualified member of another profession who is
493493 licensed and regulated under state law while in the course of
494494 rendering services which are within the scope of his or her
495495 license, provided that the individual does not represent
496496 himself or herself as a massage therapist.
497497 (3)(4) An individual providing massages to his or her
498498 immediate family.
499499 (4)(5) An individual offering massage therapy
500500 instruction who is visiting from another state, territory, or

530530 instruction who is visiting from another state, territory, or
531531 country, provided that the individual is licensed or
532532 registered as required in his or her place of residence. A
533533 visiting instructor may teach continuing education courses in
534534 this state for up to 100 hours per year without being licensed
535535 by the board. A visiting instructor who teaches continuing
536536 education courses in this state for 100 hours or more per year
537537 is required to be licensed by the board.
538538 (5)(6) Members of the Massage Emergency Rescue Team
539539 (MERT), or any other nationally or internationally recognized
540540 disaster relief association, who practice massage therapy in
541541 this state only during a time declared by the Governor or the
542542 Legislature to be a city, county, or state emergency. These
543543 therapists may work in this state for a period of time
544544 approved by the board.
545545 (6)(7) A Native American healer using traditional
546546 healing practices. A Native American healer who applies to the
547547 board for a massage therapist license shall comply with all
548548 licensing requirements.
549549 (7)(8) An individual acting under the supervision of
550550 and pursuant to delegation from a physician, a physical
551551 therapist, or a chiropractor for whom the delegated acts are
552552 within the scope of his or her the license of the physician,
553553 physical therapist, or chiropractor , provided that the
554554 individual does not represent himself or herself as a massage
555555 therapist.
556556 (8)(9) The office of a chiropractor, physician, or
557557 physical therapist which employs or contracts with a massage
558558 therapist who to provide massage therapy at the physical

588588 therapist who to provide massage therapy at the physical
589589 location of the office is exempt from an establishment
590590 license.
591591 (b) Nothing in this chapter shall be construed to
592592 authorize massage therapists to administer, dispense, or
593593 prescribe drugs or engage in the practice of medicine in any
594594 manner, including, but not limited to, nutrition, diagnosing
595595 or prescribing drugs for mental, emotional, or physical
596596 disease, illness, or injury."
597597 "§34-43A-5
598598 (a)(1) There is created the Alabama Massage Therapy
599599 Licensing Board. The purpose of the board is to protect the
600600 health, safety, and welfare of the public by ensuring that
601601 massage therapists, massage therapy schools, massage therapy
602602 establishments, and massage therapy instructors meet
603603 prescribed standards of education, competency, and practice.
604604 To accomplish this mission, the board shall establish
605605 standards to ensure completion of all board functions in a
606606 timely and effective manner and to provide open and immediate
607607 access to all relevant public information. The board shall
608608 communicate its responsibilities and services to the public as
609609 part of its consumer protection duties. The board shall
610610 develop and implement a long range plan to ensure effective
611611 regulation and consumer protection.
612612 (2) All rights, duties, records, property, real or
613613 personal, and all other effects existing in the name of the
614614 Alabama Board of Massage Therapy, formerly created and
615615 functioning pursuant to Chapter 43, or in any other name by
616616 which that board has been known, shall continue in the name of

646646 which that board has been known, shall continue in the name of
647647 the Alabama Massage Therapy Licensing Board. Any reference to
648648 the former Alabama Board of Massage Therapy, or any other name
649649 by which that board has been known, in any existing law,
650650 contract, or other instrument shall constitute a reference to
651651 the Alabama Massage Therapy Licensing Board as created in this
652652 chapter. All actions of the former Alabama Board of Massage
653653 Therapy or the executive director of the former board taken
654654 prior to June 1, 2024, are approved, ratified, and confirmed.
655655 (3) The status of any individual or entity properly
656656 licensed, accredited, or registered by the former Alabama
657657 Board of Massage Therapy on June 1, 2024, shall continue under
658658 the jurisdiction of the Alabama Massage Therapy Licensing
659659 Board. Any license, accreditation, or registration subject to
660660 renewal on or before October 1, 2024, pursuant to this chapter
661661 may be temporarily extended by six months unless and until
662662 otherwise provided by rule of the board.
663663 (b)(1) The board shall consist of the following nine
664664 members:
665665 a. Three active licensees appointed by the Governor.
666666 b. Two active licensees appointed by the Lieutenant
667667 Governor and one at-large member appointed by the Lieutenant
668668 Governor.
669669 c. Two active licensees appointed by the Speaker of the
670670 House of Representatives and one at-large member appointed by
671671 the Speaker of the House of Representatives.
672672 (2) The seven active massage therapist licensee members
673673 of the board shall be appointed so that not more than one
674674 active licensee member from each United States Congressional

704704 active licensee member from each United States Congressional
705705 District in the state is appointed to serve at the same time.
706706 The two members appointed from the state at large shall have
707707 never been licensed as massage therapists nor have had any
708708 direct financial interest in the massage therapy profession.
709709 One of the at-large members shall have extensive knowledge of
710710 sex trafficking and related law enforcement efforts to defeat
711711 sex trafficking. The at-large member appointed by the
712712 Lieutenant Governor and the at-large member appointed by the
713713 Speaker of the House of Representatives shall be appointed
714714 from a list of three names each provided by the Minority
715715 Leader of the Senate and the Minority Leader of the House of
716716 Representatives, respectively. The appointing authorities
717717 shall coordinate their appointments to assure the board
718718 membership is inclusive and reflects the racial, gender,
719719 geographic, urban, rural, and economic diversity of the state.
720720 (3) The members initially appointed to the board shall
721721 be appointed not later than July 1, 2024. Each board member
722722 shall be selected upon personal merit and qualifications, not
723723 per membership or affiliation with an association. Each board
724724 member shall be a citizen of the United States and a resident
725725 of this state for two years immediately preceding appointment.
726726 No member of the board shall serve more than two full
727727 consecutive terms.
728728 (c) Of the initial nine appointees to the board, three
729729 members shall be appointed for terms of two years, three
730730 members shall be appointed for terms of three years, and three
731731 members shall be appointed for terms of four years as
732732 determined by lot. Thereafter, successors shall be appointed

762762 determined by lot. Thereafter, successors shall be appointed
763763 for terms of four years, each term expiring on June 30.
764764 (d) Vacancies on the board occurring prior to the
765765 expiration of a term shall be filled by the original
766766 appointing authority within 30 days after the vacancy to serve
767767 for the remainder of the unexpired term. Each member of the
768768 board shall serve until his or her successor has been duly
769769 appointed and qualified.
770770 (e) The board shall hold its first meeting within 30
771771 days after the initial members are appointed. At the first
772772 meeting and annually thereafter in the month of October
773773 November, the board shall elect a chair and a vice chair from
774774 its membership. The board shall hold no less than two biannual
775775 meetings for the purpose of reviewing license applications per

784784 (f) Board members shall not receive compensation for
785785 their services, but shall receive the same per diem and

823823 (2) When necessary, the board may retain outside
824824 counsel who satisfies the qualifications required of a deputy
825825 attorney general.
826826 (h) An affirmative vote of a majority of the members of
827827 the board shall be required to grant deny, suspend, or revoke,
828828 probate, reprimand, or otherwise discipline a licensee holding
829829 a license to practice massage therapy or a license to operate
830830 a massage therapy establishment.
831831 (i) The board shall be financed only from income
832832 accruing to the board from fees, licenses, other charges and
833833 funds collected by the board, and any monies that are
834834 appropriated to the board by the Legislature.
835835 (j) A board member may be removed at the request of the
836836 board for misfeasance, malfeasance, neglect of duty,
837837 commission of a felony, incompetence, permanent inability to
838838 perform official duties, or failing to attend two consecutive
839839 properly noticed meetings within a one-year period.
840840 (k) Members of the board are immune from liability for
841841 all good faith acts performed in the execution of their duties
842842 as members of the board.
843843 (l) Appointees to the board shall take the
844844 constitutional oath of office and shall file the oath in the
845845 office of the Governor before undertaking any duties as a
846846 board member. Upon receiving the oath, the Governor shall
847847 issue a certificate of appointment to each appointee. "

879879 (a) The board shall do all of the following:
880880 (1) Qualify applicants to take the licensing
881881 examination Establish qualifications for licensing and issue
882882 licenses to successful applicants.
883883 (2) Adopt a seal and affix the seal to all licenses
884884 issued by the board. All licenses shall be on pre-printed,
885885 sequentially numbered certification forms.
886886 (3) Create application forms for examination and
887887 licensing and assess and collect fees pursuant to this
888888 chapter.
889889 (4) Maintain a complete record of all massage
890890 therapists and annually prepare a roster of the names and
891891 addresses license numbers of those licensees. A copy of the
892892 roster shall be provided to any individual upon request and
893893 the payment of a fee established by the board in an amount
894894 sufficient to cover the costs of publication and distribution.
895895 (5) Provide for the investigation of any individual or
896896 entity who is suspected of violating this chapter.
897897 (6) Adopt and revise rules as necessary to implement
898898 this chapter pursuant to the Administrative Procedure Act. All
899899 administrative rules of the former Alabama Board of Massage
900900 Therapy existing on June 1, 2024, which reference Chapter 43,
901901 unless in conflict with existing law, shall remain in effect
902902 as rules of the Alabama Massage Therapy Licensing Board until
903903 amended or repealed by that board.
904904 (7) Provide a copy of this chapter, upon request, to
905905 any licensee or applicant for a license.

944944 (b) The board may do any of the following:
945945 (1) Accept or deny the application of any individual

959959 violates this chapter and incur necessary related expenses.

962962 educational programs that prepare individuals for licensing

10581058 on any sexually explicit website or online platform that
10591059 promotes prostitution, sexually explicit services, or human
10601060 trafficking.
10611061 (e) Unless exempt pursuant to Section 34-43A-4, a
10621062 massage therapist may only perform massage therapy services at
10631063 or through a licensed massage therapy establishment. If a
10641064 massage therapist is performing outcall massage therapy
10651065 services, those services shall be provided through a licensed
10661066 massage therapy establishment. "

10681068 (a) An individual desiring to be licensed as a massage

11241124 (1) Successfully completed a course of instruction in
11251125 massage therapy which meets the minimum criteria established
11261126 by board rule for course content and hours of instruction.
11271127 c. In addition to paragraphs a. and b., to To perform
11281128 therapeutic massage on an animal, a massage therapist shall
11291129 have also graduated from a nationally approved program and
11301130 completed at least 100 hours of postgraduate training and
11311131 education in animal anatomy, pathology, and physiology for the
11321132 specific type of animal upon which he or she will perform
11331133 therapeutic massage.
11341134 (2) Successfully passed a state board exam or a
11351135 national standardized examination approved by the board. The
11361136 board may approve other state exams on a case-by-case basis.

11751175 subdivisions (1) and (2) of subsection (a), the board may
11761176 license an applicant who is licensed or registered to practice
11771177 massage therapy in another state if the standards of practice
11781178 or licensing of that state, at the time the applicant was
11791179 originally licensed or registered, were equal to or stricter
11801180 than the requirements imposed by this chapter. All applicants
11811181 may be subject to an initial in-person board hearing
11821182 determined by at the discretion of the board.
11831183 (c) Upon receipt of an application, the board shall
11841184 notify the applicant that his or her application is pending
11851185 complete and shall also notify the applicant upon the approval
11861186 or rejection of his or her application. An application is not
11871187 complete until all components of the application have been
11881188 received and all criminal history information has been
11891189 delivered to the board. If an application is proposed to be
11901190 rejected, the board shall notify the applicant of the reasons
11911191 for the rejection the applicant shall be entitled to a hearing

12271227 massage therapy establishment or be licensed by the board
12281228 pursuant to this chapter.
12291229 (c) A massage therapy establishment shall contract with
12301230 or employ only licensed massage therapists to perform massage
12311231 therapy. Every Each establishment shall notify the board of
12321232 every massage therapist shall be registered with the board who
12331233 performs massage therapy at or through the massage therapy
12341234 establishment, and one of them those massage therapists shall
12351235 be designated as the individual who will ensure that the
12361236 massage therapy establishment complies with state law and all
12371237 applicable administrative rules.
12381238 (d) A massage therapy establishment license is not
12391239 assignable or transferable.
12401240 (e) If the holder of a massage therapy establishment
12411241 license moves the location of the massage therapy
12421242 establishment without changing either the name or ownership of
12431243 that massage therapy establishment, the board shall may waive
12441244 the new establishment license fee, if documentation set by
12451245 rule of the board is approved. This subsection shall not
12461246 change the expiration date of a massage therapy establishment
12471247 license. The new location is subject to an inspection before
12481248 any massage therapy services are performed at the new
12491249 location.
12501250 (f)(1) Except as provided in subdivision (2), each
12511251 applicant for a an initial massage therapy establishment
12521252 license shall complete a criminal history background check
12531253 pursuant to rules adopted by the board.

12911291 license shall be the owner, lessee, or legal possessor of the

12931293 (g) The physical location of a proposed massage therapy
12941294 establishment shall be subject to an initial inspection by the
12951295 board before a massage therapy establishment license is
12961296 granted to the applicant. A massage therapy establishment
12971297 which provides only outcall massage therapy services must
12981298 designate a physical location at which records and equipment
12991299 are available for inspection.
13001300 (h) If the physical location of a massage therapy
13011301 establishment has been shut down by the board or by local,
13021302 state, or federal law enforcement, the physical location is
13031303 permanently prohibited from being licensed or operating as a

15341534 in unprofessional conduct that has endangered or is likely to
15351535 endanger the health, safety, and welfare of the public, as
15361536 defined by the rules of the board.
15371537 (4) The licensee or applicant for licensing has been
15381538 convicted of a felony or of any crime arising out of or
15391539 connected with the practice of massage therapy.
15401540 (5) The licensee or applicant for licensing has
15411541 violated or aided and abetted in the violation of this
15421542 chapter.
15431543 (6) The licensee or applicant for licensing is
15441544 adjudicated as mentally incompetent by a court of law.

15751575 (7) The licensee or applicant for licensing uses
15761576 controlled substances or habitually and excessively uses
15771577 alcohol.
15781578 (8) The licensee or applicant for licensing engaged in
15791579 false, deceptive, or misleading advertising.
15801580 (9) The licensee or applicant for licensing engaged in
15811581 or attempted to or offered to engage a client in sexual
15821582 activity, including, but not limited to, genital contact,

15911591 (12) The licensee or applicant or licensee for
15921592 licensing was convicted of impersonating a massage therapist
15931593 in another jurisdiction.
15941594 (c)(1) Subsequent to an official complaint, and for
15951595 other requirements established by this chapter, including for
15961596 the purpose of determining an applicant's suitability for a
15971597 license or the renewal of a license to practice massage
15981598 therapy, the board may request a criminal history background
15991599 check of the licensee or applicant for licensing pursuant to a
16001600 schedule created by rule of the board . Each applicant shall
16011601 submit a complete set of fingerprints and a form, sworn to by
16021602 the applicant, providing written consent from the applicant

16331633 for the release of criminal history background check
16341634 information to the board. The applicant or licensee shall
16351635 submit a full set of fingerprints to the board for the purpose
16361636 of obtaining a state and national criminal history background
16371637 check.
16381638 (2) The board shall submit the fingerprints and form
16391639 provided by each applicant to the Alabama State Law
16401640 Enforcement Agency (ALEA). The applicant may be fingerprinted
16411641 by ALEA at the time of the form submission. ALEA shall conduct
16421642 a check of state records and forward the fingerprints to the
16431643 FBI for a national criminal history background check.
16441644 (3) The results of the state and national criminal
16451645 history background check records shall be returned to the
16461646 board by ALEA.
16471647 (4) The board shall reimburse ALEA for conducting
16481648 criminal history background checks according to the fee
16491649 schedule adopted by the Alabama Justice Information
16501650 Commission.
16511651 (5) Any criminal history background check reports
16521652 received by the board from ALEA shall be marked confidential
16531653 and shall not be disclosed or made available for public
16541654 inspection. All criminal history background check reports
16551655 received pursuant to this section are specifically excluded
16561656 from any requirement of public disclosure as a public record.
16571657 Reports received may only be used for the purposes described
16581658 in this chapter. All information provided is subject to the
16591659 rules established by the Alabama Justice Information
16601660 Commission and Public Law 92-544. An individual that uses a

16901690 Commission and Public Law 92-544. An individual that uses a
16911691 criminal history background check report for purposes other
16921692 than those provided in this chapter may be subject to criminal
16931693 charges under Sections 41-9-601 and 41-9-602.
16941694 (2) Fingerprints obtained pursuant to subdivision (1)
16951695 may be exchanged by the board, the Alabama State Law
16961696 Enforcement Agency, or any successor entity thereof, or any
16971697 channeler approved by the board, with the Federal Bureau of
16981698 Investigation for the purpose of obtaining a state and
16991699 national criminal history background check.
17001700 (3) The applicant or licensee shall be responsible for
17011701 all costs associated with the submission of his or her
17021702 fingerprints and obtaining a state and national criminal
17031703 history background check. The board may incorporate those
17041704 costs into the cost of licensing or may charge the applicant
17051705 or licensee a separate fee, which may be payable to the board,
17061706 the Alabama State Law Enforcement Agency, or any successor
17071707 entity thereof, or the approved channeler, as appropriate.
17081708 (4) Information received by the board pursuant to a
17091709 state and national criminal history background check shall be
17101710 confidential and shall not be a public record, except that any
17111711 information received by and relied upon by the board in
17121712 denying the issuance of a license or revoking, suspending, or
17131713 otherwise disciplining a license or licensee may be disclosed
17141714 as necessary to support the denial or revocation, suspension,
17151715 or other disciplinary action.
17161716 (d) An individual governed by this chapter who has a
17171717 reasonable belief that another massage therapist has violated
17181718 this chapter shall inform the board in writing within 30

17481748 this chapter shall inform the board in writing within 30
17491749 calendar days after the date the individual discovers this
17501750 activity. Upon finding that an individual has violated this
17511751 subsection by not informing the board as required, the board
17521752 may do any of the following:
17531753 a. Impose an administrative fine of not more than ten
17541754 thousand dollars ($10,000) according to a disciplinary
17551755 infraction fine schedule adopted by rule of the board.
17561756 b. Suspend, probate, reprimand, otherwise discipline,
17571757 or revoke the individual's license to practice massage
17581758 therapy.
17591759 (e) The license of any individual who has been
17601760 convicted of, or has entered a plea of nolo contendere to, a
17611761 crime or offense involving human trafficking, prostitution, or
17621762 any other type of sexual offense shall be permanently revoked
17631763 by the board according to the Administrative Procedure Act.
17641764 (f) The massage therapy establishment license of any
17651765 massage therapy establishment wherein an individual has been
17661766 convicted of, or entered engages in conduct which leads to a
17671767 conviction of or entry of a plea of nolo contendere to, an
17681768 offense involving prostitution or any other type of sexual
17691769 offense against a client, or which the board determines is a
17701770 sexually-oriented business, shall be permanently revoked by
17711771 the board according to the Administrative Procedure Act.
17721772 (g)(1) Upon a finding that an individual or entity who
17731773 is governed by this chapter has performed massage therapy or
17741774 operated a massage therapy establishment without having
17751775 obtained a license, the board may do any of the following:

18061806 a.(1) Impose an administrative fine of not more than

18081808 b.(2) Issue a cease and desist order.
18091809 c.(3) Petition the circuit court of the county where
18101810 the act occurred to enforce the cease and desist order and
18111811 collect the assessed fine.
18121812 (h)(1) The executive director may issue an emergency
18131813 order suspending the operation of a massage therapy
18141814 establishment without a prior hearing when public safety is at
18151815 immediate risk. Public safety shall be considered at immediate
18161816 risk in any of the following circumstances:
18171817 a. A law enforcement agency notifies the board that the
18181818 law enforcement agency is investigating a massage therapy
18191819 establishment for an offense under Section 13A-6-152, this
18201820 chapter, or rules adopted by the board pursuant to this
18211821 chapter.
18221822 b. The massage therapy establishment is operating
18231823 without a valid license issued by the board.
18241824 c. The board has reasonable cause to believe that a
18251825 massage therapy establishment is violating this chapter or a
18261826 rule adopted by the board pursuant to this chapter, and, upon
18271827 physical inspection by the board, one or more violations are
18281828 confirmed.
18291829 d. Upon physical inspection of a massage therapy
18301830 establishment by the board, one or more violations of this
18311831 chapter or a rule adopted by the board pursuant to this
18321832 chapter are confirmed.
18331833 e. Other circumstances as determined by the board.
18341834 (2) Upon determining that an individual or entity

18641864 (2) Upon determining that an individual or entity
18651865 governed by this chapter has performed massage therapy or
18661866 operated a massage therapy establishment without a valid
18671867 license as provided in subdivision (g)(1), the executive
18681868 director of the board may issue an emergency order. If the
18691869 executive director believes a massage therapy establishment is
18701870 in violation of a local, municipal, or other applicable law,
18711871 the executive director shall notify local law enforcement of
18721872 the possible violations. An emergency order shall identify the
18731873 massage therapy establishment by its business name and state
18741874 that the massage therapy establishment is closed by order of
18751875 the board pursuant to this chapter and rules adopted by the
18761876 board pursuant to this chapter.
18771877 (3) A massage therapy establishment shall remain closed
18781878 to the public until it is in compliance with this chapter and
18791879 rules adopted by the board pursuant to this chapter. The board
18801880 shall provide the massage therapy establishment with a written
18811881 summary of the findings of any inspection resulting in the
18821882 emergency order and shall describe the compliance measures
18831883 necessary to remedy those findings. Within three business days
18841884 after receipt of the findings by the massage therapy
18851885 establishment, the board shall issue to the massage therapy
18861886 establishment, in writing, a complaint resulting in the
18871887 emergency order suspending the operation of the massage
18881888 therapy establishment, which describes the compliance measures
18891889 which must be taken for the emergency order to be rescinded.
18901890 (4) An emergency order suspending the operations of a
18911891 massage therapy establishment shall be printed on 8 ½" x 11"

19241924 (5) A massage therapy establishment may not remove the
19251925 posted emergency order or reopen for business until the board
19261926 determines, after a physical inspection, that the massage
19271927 therapy establishment is in compliance with this chapter and
19281928 rules adopted by the board pursuant to this chapter.
19291929 (6) A massage therapy establishment that reopens to the
19301930 public while operations are suspended shall be fined one
19311931 thousand dollars ($1,000) per day for each day in violation.
19321932 (7) If the board is required to enforce the emergency
19331933 order in circuit court for continued violations of this
19341934 chapter or rules adopted by the board pursuant to this
19351935 chapter, the court may triple any applicable fines and order
19361936 the massage therapy establishment to reimburse the board for
19371937 all legal fees and administrative costs incurred by the board
19381938 in enforcing the violation.
19391939 (8) Within 30 days after the issuance of an emergency
19401940 order suspending operations of a massage therapy
19411941 establishment, the massage therapy establishment may request,
19421942 in writing, a formal hearing before the board.
19431943 (2)(i) Any individual or entity aggrieved by any
19441944 adverse action of the board may appeal the action to the
19451945 Circuit Court of Montgomery County.
19461946 (h)(j) The board shall present any incident deemed
19471947 serious misconduct by the board to the local district attorney
19481948 for review and appropriate legal action.
19491949 (i)(k) The board may adopt rules to implement and
19501950 administer this section."

20522052 massage therapy instructor teaching a course in massage
20532053 therapy at a massage therapy school located in this state
20542054 shall be licensed by the board as a massage therapist and
20552055 registered as a massage therapy instructor. Instructors who
20562056 are not teaching massage therapy do not need to be registered.
20572057 An adjunct massage therapy instructor shall be dually licensed
20582058 in the state where he or she resides or be nationally
20592059 certified, or both.
20602060 (c) An applicant for registration as a massage therapy
20612061 instructor shall satisfy all of the following requirements:
20622062 (1) Be currently licensed as a massage therapist in
20632063 this state.
20642064 (2) Submit to the board a completed application as
20652065 prescribed by the board and the one-time application fee
20662066 specified in Section 34-43A-12 .
