1717 AN ACT
1818 Relating to the Town of White Hall in Lowndes County;
1919 to allow the authorization of pari-mutuel wagering on
2020 simulcast past events and live horse and dog races under
2121 certain conditions and to provide for the taxation of wagering
2222 and the distribution of tax revenue.
2323 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
2424 Section 1. As used in this act, the following words
2525 have the following meanings:
2626 (1) COUNCIL. The Town Council of the Town of White Hall
2727 in Lowndes County.
2828 (2) LICENSEE. A person licensed by the council to
2929 conduct charitable bingo pursuant to Sections 43A-2.00 or
3030 43A-2.01 of the Constitution of Alabama of 2022, in a facility
3131 not less than 40,000 square feet and in existence on October
3232 1, 2023, with the mailing address of 6999 Highway 80 West,
3333 Hayneville, Alabama 36040.
3434 (3) SIMULCAST. Televised or broadcast by other
3535 electronic means.
3636 Section 2. The council may authorize a licensee to
3737 conduct pari-mutuel wagering on simulcast past events and live

6767 conduct pari-mutuel wagering on simulcast past events and live
6868 horse and dog races.
6969 Section 3. (a)(1) The council is vested with the powers
7070 and duties specified in this act and all other powers
7171 necessary and proper to enable the council to execute fully
7272 and effectually the purposes of this act.
7373 (2) The council shall adopt rules specifying the
7474 conditions under which the licensee, as part of its licensed
7575 activity, may cause simulcast programming of pari-mutuel
7676 events, including both past events and live horse and dog
7777 races, held at racetracks located outside the state to be
7878 transmitted for public viewing to the licensee and made the
7979 subject of pari-mutuel wagering.
8080 (3) Subject to the exceptions as the council may
8181 approve by rule in order to satisfy applicable requirements of
8282 federal law, all pari-mutuel wagering with respect to racing
8383 events that are the subject of simulcast programming shall be
8484 subject to the rules of the council governing pari-mutuel
8585 wagering.
8686 (b) The council shall receive no revenue from the
8787 simulcast programming of racing events other than the
8888 following:
8989 (1) The commission horse wagering fee due with respect
9090 to that part of the horse racing handle wagered on simulcast
9191 horse racing events by bettors placing bets at the facility in
9292 the jurisdiction of the council.
9393 (2) The commission dog wagering fee due with respect to
9494 that part of the dog wagering handle wagered on simulcast dog
9595 racing events by bettors placing bets at the facility in the

125125 racing events by bettors placing bets at the facility in the
126126 jurisdiction of the council.
127127 (3) A portion of tax revenues with respect to the
128128 taxation provided and allocated for in this act.
129129 (c)(1) If permitted by federal law and made possible by
130130 contractual arrangements with the operator of the racetrack
131131 that originates the simulcast programming, the licensee may
132132 conduct pari-mutuel wagering on past events and live horse or
133133 dog racing events simulcast to the facility in the municipal
134134 jurisdiction of the council from locations outside the state.
135135 (2) When conducting pari-mutuel wagering under
136136 subdivision (1), the pari-mutuel pools for the wagering may be
137137 limited to bets made by bettors placing bets at the facility
138138 located in the jurisdiction of the council or, alternatively,
139139 the pari-mutuel pools may include bets made by bettors placing
140140 bets at the facility that conducts the simulcast event, as
141141 well as bets made by bettors placing bets at one or more
142142 locations outside the state; provided, that to the extent
143143 bettors placing bets at the facility located in the
144144 jurisdiction of the council participate in the pari-mutuel
145145 pools, the total amount wagered by the bettors shall be
146146 administered in accordance with the rules of the council.
147147 Section 4. (a) The council shall adopt rules specifying
148148 the conditions under which the licensee, as part of its
149149 licensed activity, may cause simulcast programming of
150150 pari-mutuel events, including both past events and live horse
151151 and dog races, held at racetracks located outside the state to
152152 be transmitted for public viewing to the licensee and there
153153 made the subject of pari-mutuel wagering.

183183 made the subject of pari-mutuel wagering.
184184 (b) Subject to the exceptions as the council may
185185 approve by rule in order to satisfy applicable requirements of
186186 federal law, all pari-mutuel wagering with respect to racing
187187 events that are the subject of simulcast programming shall be
188188 subject to the rules of the council governing pari-mutuel
189189 wagering.
190190 Section 5. (a) A licensee conducting pari-mutuel
191191 wagering shall pay to the council, for the use of the council,
192192 a tax in an amount equal to four percent of the total
193193 contributions less prizes paid to winners. The tax may be
194194 adjusted as determined necessary by the council but shall not
195195 exceed four percent.
196196 (b) From the taxes paid to the council, the tax revenue
197197 shall be distributed as follows:
198198 (1) Twenty percent to the Lowndes County Commission.
199199 (2) Twenty percent to the Lowndes County Board of
200200 Education.
201-(3) Twenty percent to the Black Belt Unincorporated
202-Wastewater Program (BBUWP).
203-(4) Forty percent to the council, of which amount 10
201+(3) Sixty percent to the council, of which amount 10
204202 percent shall be distributed to other municipalities in
205203 Lowndes County. In addition, the council may distribute any
206204 amount of monies received pursuant to this subdivision to any
207205 charity in Lowndes County that is approved by the council.
208206 (c) A licensee conducting historical pari-mutuel
209207 wagering shall pay to the State of Alabama a tax in an amount
210208 equal to one percent of the total contributions less prizes
211209 paid to winners.
210+Section 6. Nothing in this act shall be construed to
211+authorize or make lawful "off-track betting" or wagering or

242-Section 6. Nothing in this act shall be construed to
243241 authorize or make lawful "off-track betting" or wagering or
244242 gambling of any kind at any location in the state other than
245243 at the facility of a person who is a licensee of the council.
246244 All laws of the state, whether local or general, and all
247245 ordinances of any political subdivision thereof, that
248246 prohibit, restrict, or regulate wagering or gambling of any
249247 kind outside the jurisdiction of the council, shall not be
250248 affected by this act and shall remain in full force and
251249 effect.
252250 Section 7. This act shall become effective the first
253251 day of the third month fol lowing its passage and approval by
254252 the Governor, or its otherwise becoming law.
