18	18		Relating to the Town of White Hall in Lowndes County;
19	19		to allow the authorization of pari-mutuel wagering on
20	20		simulcast past events and live horse and dog races under
21	21		certain conditions and to provide for the taxation of wagering
22	22		and the distribution of tax revenue.
23	23		BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
24	24		Section 1. As used in this act, the following words
25	25		have the following meanings:
26	26		(1) COUNCIL. The Town Council of the Town of White Hall
27	27		in Lowndes County.
28	28		(2) LICENSEE. A person licensed by the council to
29	29		conduct charitable bingo pursuant to Sections 43A-2.00 or
30	30		43A-2.01 of the Constitution of Alabama of 2022, in a facility
31	31		not less than 40,000 square feet and in existence on October
32	32		1, 2023, with the mailing address of 6999 Highway 80 West,
33	33		Hayneville, Alabama 36040.
34	34		(3) SIMULCAST. Televised or broadcast by other
35	35		electronic means.
36	36		Section 2. The council may authorize a licensee to
37	37		conduct pari-mutuel wagering on simulcast past events and live

67	67		conduct pari-mutuel wagering on simulcast past events and live
68	68		horse and dog races.
69	69		Section 3. (a)(1) The council is vested with the powers
70	70		and duties specified in this act and all other powers
71	71		necessary and proper to enable the council to execute fully
72	72		and effectually the purposes of this act.
73	73		(2) The council shall adopt rules specifying the
74	74		conditions under which the licensee, as part of its licensed
75	75		activity, may cause simulcast programming of pari-mutuel
76	76		events, including both past events and live horse and dog
77	77		races, held at racetracks located outside the state to be
78	78		transmitted for public viewing to the licensee and made the
79	79		subject of pari-mutuel wagering.
80	80		(3) Subject to the exceptions as the council may
81	81		approve by rule in order to satisfy applicable requirements of
82	82		federal law, all pari-mutuel wagering with respect to racing
83	83		events that are the subject of simulcast programming shall be
84	84		subject to the rules of the council governing pari-mutuel
85	85		wagering.
86	86		(b) The council shall receive no revenue from the
87	87		simulcast programming of racing events other than the
88	88		following:
89	89		(1) The commission horse wagering fee due with respect
90	90		to that part of the horse racing handle wagered on simulcast
91	91		horse racing events by bettors placing bets at the facility in
92	92		the jurisdiction of the council.
93	93		(2) The commission dog wagering fee due with respect to
94	94		that part of the dog wagering handle wagered on simulcast dog
95	95		racing events by bettors placing bets at the facility in the

125	125		racing events by bettors placing bets at the facility in the
126	126		jurisdiction of the council.
127	127		(3) A portion of tax revenues with respect to the
128	128		taxation provided and allocated for in this act.
129	129		(c)(1) If permitted by federal law and made possible by
130	130		contractual arrangements with the operator of the racetrack
131	131		that originates the simulcast programming, the licensee may
132	132		conduct pari-mutuel wagering on past events and live horse or
133	133		dog racing events simulcast to the facility in the municipal
134	134		jurisdiction of the council from locations outside the state.
135	135		(2) When conducting pari-mutuel wagering under
136	136		subdivision (1), the pari-mutuel pools for the wagering may be
137	137		limited to bets made by bettors placing bets at the facility
138	138		located in the jurisdiction of the council or, alternatively,
139	139		the pari-mutuel pools may include bets made by bettors placing
140	140		bets at the facility that conducts the simulcast event, as
141	141		well as bets made by bettors placing bets at one or more
142	142		locations outside the state; provided, that to the extent
143	143		bettors placing bets at the facility located in the
144	144		jurisdiction of the council participate in the pari-mutuel
145	145		pools, the total amount wagered by the bettors shall be
146	146		administered in accordance with the rules of the council.
147	147		Section 4. (a) The council shall adopt rules specifying
148	148		the conditions under which the licensee, as part of its
149	149		licensed activity, may cause simulcast programming of
150	150		pari-mutuel events, including both past events and live horse
151	151		and dog races, held at racetracks located outside the state to
152	152		be transmitted for public viewing to the licensee and there
153	153		made the subject of pari-mutuel wagering.

183	183		made the subject of pari-mutuel wagering.
184	184		(b) Subject to the exceptions as the council may
185	185		approve by rule in order to satisfy applicable requirements of
186	186		federal law, all pari-mutuel wagering with respect to racing
187	187		events that are the subject of simulcast programming shall be
188	188		subject to the rules of the council governing pari-mutuel
189	189		wagering.
190	190		Section 5. (a) A licensee conducting pari-mutuel
191	191		wagering shall pay to the council, for the use of the council,
192	192		a tax in an amount equal to four percent of the total
193	193		contributions less prizes paid to winners. The tax may be
194	194		adjusted as determined necessary by the council but shall not
195	195		exceed four percent.
196	196		(b) From the taxes paid to the council, the tax revenue
197	197		shall be distributed as follows:
198	198		(1) Twenty percent to the Lowndes County Commission.
199	199		(2) Twenty percent to the Lowndes County Board of
200	200		Education.
201		-	(3) Twenty percent to the Black Belt Unincorporated
202		-	Wastewater Program (BBUWP).
203		-	(4) Forty percent to the council, of which amount 10
	201	+	(3) Sixty percent to the council, of which amount 10
204	202		percent shall be distributed to other municipalities in
205	203		Lowndes County. In addition, the council may distribute any
206	204		amount of monies received pursuant to this subdivision to any
207	205		charity in Lowndes County that is approved by the council.
208	206		(c) A licensee conducting historical pari-mutuel
209	207		wagering shall pay to the State of Alabama a tax in an amount
210	208		equal to one percent of the total contributions less prizes
211	209		paid to winners.
	210	+	Section 6. Nothing in this act shall be construed to

242		-	Section 6. Nothing in this act shall be construed to
243	241		authorize or make lawful "off-track betting" or wagering or
244	242		gambling of any kind at any location in the state other than
245	243		at the facility of a person who is a licensee of the council.
246	244		All laws of the state, whether local or general, and all
247	245		ordinances of any political subdivision thereof, that
248	246		prohibit, restrict, or regulate wagering or gambling of any
249	247		kind outside the jurisdiction of the council, shall not be
250	248		affected by this act and shall remain in full force and
251	249		effect.
252	250		Section 7. This act shall become effective the first
253	251		day of the third month fol lowing its passage and approval by
254	252		the Governor, or its otherwise becoming law.
