1515 SYNOPSIS:
1616 Under existing law, the Contract Review
1717 Permanent Legislative Oversight Committee is
1818 responsible for reviewing state contracts for personal
1919 or professional services with private entities or
2020 individuals to be paid out of appropriated state or
2121 federal funds.
2222 This bill would clarify that all occupational
2323 and professional licensing board or commission funds
2424 are subject to review.
2525 This bill would also remove the requirement that
2626 the review of personal or professional services
2727 contracts be limited to those contracts paid out of
2828 appropriated funds issued on a state warrant.

7070 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
7171 Section 1. Section 29-2-41 of the Code of Alabama 1975,
7272 is amended to read as follows:
7373 "ยง29-2-41
7474 (a) Each member of the committee shall be entitled to
7575 regular legislative compensation, per diem, and travel
7676 expenses for each day he or she attends a meeting of the
7777 committee, which shall be paid out of the funds appropriated
7878 to the use of the Legislature, on warrants drawn on the state
7979 Comptroller upon requisition signed by the committee's chair.
8080 Members shall not receive additional compensation or per diem
8181 when the Legislature is in session. The Department of
8282 Examiners of Public Accounts shall furnish assistance and any
8383 relevant information to the committee.
8484 (b)(1) The committee shall have the responsibility of
8585 reviewing contracts for personal or professional services with
8686 private entities or individuals to be paid out of appropriated
8787 funds, federal or state, on a state warrant issued as
8888 recompense for those services.
8989 (2) Each state department entering into a contract to
9090 be paid out of appropriated funds, federal or state, on a
9191 state warrant which is notified by the committee, shall submit
9292 to the committee any proposed contract for personal or
9393 professional services. Each contract shall be accompanied by
9494 an itemization of the total cost estimate of the contract.

124124 an itemization of the total cost estimate of the contract.
125125 (c) A department, in lieu of the proposed contract, may
126126 submit to the committee a letter of intent to contract. A
127127 letter of intent to contract shall indicate the contracting
128128 parties, the services to be performed, an itemization of the
129129 total cost estimate of the contract, and such other
130130 information as the department may deem pertinent to the
131131 committee review of the contract. If a department elects to
132132 submit a letter of intent to contract in lieu of a proposed
133133 contract, the department shall be required to submit to the
134134 committee for its information the contract described in the
135135 letter of intent upon the execution of the contract.
136136 (d) The committee shall hold a hearing to review and
137137 comment where necessary on any contract or letter of intent to
138138 contract within a reasonable time not to exceed 45 days after
139139 a department has submitted the contract or letter of intent to
140140 contract to the committee. If the committee fails to hold a
141141 hearing to review a contract or letter of intent to contract
142142 within the 45-day time period, the contract shall be deemed to
143143 have been reviewed in compliance with this section. The
144144 committee may hold a contract considered at a meeting for up
145145 to 45 days following the meeting to review and comment on the
146146 contract.
147147 (e) Any contract made by the state or any of its
148148 agencies or departments in violation of this section and
149149 without prior review by the committee of either the contract
150150 or the letter of intent to contract shall be void ab initio.
151151 (f) The committee may issue subpoenas for any witnesses
152152 and require the production of any documents or contracts the

182182 and require the production of any documents or contracts the
183183 committee deems necessary to examine in order to conduct its
184184 duties.
185185 (g) The committee shall organize itself at the first
186186 meeting following a new quadrennium and elect from among its
187187 membership a chair and a vice-chair. Any committee member
188188 reelected to a new quadrennium shall continue to serve on the
189189 committee until such time the committee reorganizes itself.
190190 (h) The committee shall hold regular meetings at least
191191 once each month, the regular meetings to be held during the
192192 first week of each month.
193193 (i) For purposes of this section, the term "state
194194 department" or "department" includes, but is not limited to,
195195 occupational or professional licensing boards, commissions,
196196 and agencies."
197197 Section 2. This act shall become effective on October
198198 1, 2025.
