15	15	SYNOPSIS:
16	16	Under existing law, the Director of the Alabama
17	17	Emergency Management Agency is authorized to spend
18	18	public monies to carry out the emergency preparedness
19	19	and emergency response functions of the agency.
20	20	This bill would specify that this authorization
21	21	extends to the purchase from public funds of
22	22	promotional and educational materials that further
23	23	public awareness of the agency and emergency
24	24	preparedness.
25	25	This bill would also delete duplicative language
26	26	and make nonsubstantive, technical revisions to update
27	27	the existing code language to current style.

30	30	AN ACT
31	31	Relating to the Emergency Management Agency; to amend
32	32	Section 31-9-4, Code of Alabama 1975, to authorize the
33	33	emergency management agency to purchase promotional and
34	34	educational materials from the funds appropriated to its use;
35	35	and to delete duplicative language and make nonsubstantive,
36	36	technical revisions to update the existing code language to

68	68	BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
69	69	Section 1. Section 31-9-4, Code of Alabama 1975, is
70	70	amended to read as follows:
71	71	"§31-9-4
72	72	(a) There is hereby created within the executive branch
73	73	of the state government a department of emergency management,
74	74	hereinafter called the "Emergency Management Agency," with a
75	75	Director of Emergency Management, hereinafter called the
76	76	"director," who shall be the head thereof. The director shall
77	77	be appointed by the Governor. The director shall devote his or
78	78	her entire time to the duties of the office of director shall
79	79	be a full-time position . The director shall not hold another
80	80	office under the government of the United States or any other
81	81	state, or of this state , or any political subdivision thereof,
82	82	during his or her incumbency in such tenure in the office, and
83	83	shall not hold any position of trust or profit, or engage in
84	84	any occupation or business the conduct of which shall that
85	85	would interfere or be inconsistent with the duties of Director
86	86	of Emergency Management under the provisions of this article.
87	87	The director shall hold office during serve at the pleasure of
88	88	the Governor.
89	89	(b)(1) The director may employ, subject to the
90	90	provisions of the Merit System Act Article 1, Chapter 26, Title
91	91	36, such technical, clerical, stenographic, and other all
92	92	necessary personnel and may make such expenditures expend
93	93	within the appropriation therefor, or from other funds made
94	94	available to him or her for purposes of emergency management ,

124	124	available to him or her for purposes of emergency management ,
125	125	as may bethe funds necessary to carry out the purposes of this
126	126	article; provided, that the state shall not pay the
127	127	compensation, if any, of block wardens, fire guards, first aid
128	128	specialists, auxiliary firemen, auxiliary policemen, and
129	129	similar emergency management personnel, nor shall it pay the
130	130	compensation of personnel employed by or for a local
131	131	organization for emergency management.
132	132	(2) The director's authority pursuant to this
133	133	subsection includes the use of appropriated funds to purchase
134	134	items that are reasonably necessary to promote the functions
135	135	assigned to the Emergency Management Agency by this article,
136	136	including materials to educate the public on emergency
137	137	preparedness.
138	138	(c) The director and other personnel of the Emergency
139	139	Management Agency shall be provided with appropriate office
140	140	space, furniture, equipment, supplies, stationery, and
141	141	printing in the same manner as provided for personnel of other
142	142	state agencies.
143	143	(d) The director, subject to the direction and control
144	144	of the Governor, shall be the executive head of the Emergency
145	145	Management Agency and shall be responsible to the Governor for
146	146	carrying out the program for emergency management of this
147	147	state. The director shall coordinate the activities of all
148	148	organizations of emergency management within the state, and
149	149	shall maintain liaison with and cooperate with major
150	150	commanders of the armed forces within the state , the Alabama
151	151	State Law Enforcement Agency, the State Military Department,
152	152	and with emergency management agencies and organizations of

183	183	other states and of the federal government, and shall have
184	184	such additional authority, duties, and responsibilities
185	185	authorized by this article as may be prescribed by the
186	186	Governor.
187	187	(e) The director shall also hold the position of
188	188	Assistant Director of Homeland Security for Emergency
189	189	Preparedness and Response."
190	190	Section 2. This act shall become effective on October
191	191	1, 2025.
