1515 SYNOPSIS:
1616 Under existing law, the Director of the Alabama
1717 Emergency Management Agency is authorized to spend
1818 public monies to carry out the emergency preparedness
1919 and emergency response functions of the agency.
2020 This bill would specify that this authorization
2121 extends to the purchase from public funds of
2222 promotional and educational materials that further
2323 public awareness of the agency and emergency
2424 preparedness.
2525 This bill would also delete duplicative language
2626 and make nonsubstantive, technical revisions to update
2727 the existing code language to current style.

3131 Relating to the Emergency Management Agency; to amend

6868 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
6969 Section 1. Section 31-9-4, Code of Alabama 1975, is
7070 amended to read as follows:
7171 "ยง31-9-4
7272 (a) There is hereby created within the executive branch
7373 of the state government a department of emergency management,
7474 hereinafter called the "Emergency Management Agency," with a
7575 Director of Emergency Management, hereinafter called the
7676 "director," who shall be the head thereof. The director shall
7777 be appointed by the Governor. The director shall devote his or
7878 her entire time to the duties of the office of director shall
7979 be a full-time position . The director shall not hold another
8080 office under the government of the United States or any other
8181 state, or of this state , or any political subdivision thereof,
8282 during his or her incumbency in such tenure in the office, and
8383 shall not hold any position of trust or profit, or engage in
8484 any occupation or business the conduct of which shall that
8585 would interfere or be inconsistent with the duties of Director
8686 of Emergency Management under the provisions of this article.
8787 The director shall hold office during serve at the pleasure of
8888 the Governor.
8989 (b)(1) The director may employ, subject to the
9090 provisions of the Merit System Act Article 1, Chapter 26, Title
9191 36, such technical, clerical, stenographic, and other all
9292 necessary personnel and may make such expenditures expend
9393 within the appropriation therefor, or from other funds made
9494 available to him or her for purposes of emergency management ,

124124 available to him or her for purposes of emergency management ,
125125 as may bethe funds necessary to carry out the purposes of this
126126 article; provided, that the state shall not pay the
127127 compensation, if any, of block wardens, fire guards, first aid
128128 specialists, auxiliary firemen, auxiliary policemen, and
129129 similar emergency management personnel, nor shall it pay the
130130 compensation of personnel employed by or for a local
131131 organization for emergency management.
132132 (2) The director's authority pursuant to this
133133 subsection includes the use of appropriated funds to purchase
134134 items that are reasonably necessary to promote the functions
135135 assigned to the Emergency Management Agency by this article,
136136 including materials to educate the public on emergency
137137 preparedness.
138138 (c) The director and other personnel of the Emergency
139139 Management Agency shall be provided with appropriate office
140140 space, furniture, equipment, supplies, stationery, and
141141 printing in the same manner as provided for personnel of other
142142 state agencies.
143143 (d) The director, subject to the direction and control
144144 of the Governor, shall be the executive head of the Emergency
145145 Management Agency and shall be responsible to the Governor for
146146 carrying out the program for emergency management of this
147147 state. The director shall coordinate the activities of all
148148 organizations of emergency management within the state, and
149149 shall maintain liaison with and cooperate with major
150150 commanders of the armed forces within the state , the Alabama
151151 State Law Enforcement Agency, the State Military Department,
152152 and with emergency management agencies and organizations of

183183 other states and of the federal government, and shall have
184184 such additional authority, duties, and responsibilities
185185 authorized by this article as may be prescribed by the
186186 Governor.
187187 (e) The director shall also hold the position of
188188 Assistant Director of Homeland Security for Emergency
189189 Preparedness and Response."
190190 Section 2. This act shall become effective on October
191191 1, 2025.
