68 | 68 | | BE IT ENACTED BY THE LEGISLATURE OF ALABAMA: |

69 | 69 | | Section 1. Section 31-9-4, Code of Alabama 1975, is |
---|
70 | 70 | | amended to read as follows: |

72 | 72 | | (a) There is hereby created within the executive branch |
---|
73 | 73 | | of the state government a department of emergency management, |
---|
74 | 74 | | hereinafter called the "Emergency Management Agency," with a |
---|
75 | 75 | | Director of Emergency Management, hereinafter called the |
---|
76 | 76 | | "director," who shall be the head thereof. The director shall |
---|
77 | 77 | | be appointed by the Governor. The director shall devote his or |
---|
78 | 78 | | her entire time to the duties of the office of director shall |
---|
79 | 79 | | be a full-time position . The director shall not hold another |
---|
80 | 80 | | office under the government of the United States or any other |
---|
81 | 81 | | state, or of this state , or any political subdivision thereof, |
---|
82 | 82 | | during his or her incumbency in such tenure in the office, and |
---|
83 | 83 | | shall not hold any position of trust or profit, or engage in |
---|
84 | 84 | | any occupation or business the conduct of which shall that |
---|
85 | 85 | | would interfere or be inconsistent with the duties of Director |
---|
86 | 86 | | of Emergency Management under the provisions of this article. |
---|
87 | 87 | | The director shall hold office during serve at the pleasure of |
---|
88 | 88 | | the Governor. |
---|
89 | 89 | | (b)(1) The director may employ, subject to the |
---|
90 | 90 | | provisions of the Merit System Act Article 1, Chapter 26, Title |
---|
91 | 91 | | 36, such technical, clerical, stenographic, and other all |
---|
92 | 92 | | necessary personnel and may make such expenditures expend |
---|
93 | 93 | | within the appropriation therefor, or from other funds made |
---|
94 | 94 | | available to him or her for purposes of emergency management , |
---|

126 | 126 | | article; provided, that the state shall not pay the |

127 | 127 | | compensation, if any, of block wardens, fire guards, first aid |

128 | 128 | | specialists, auxiliary firemen, auxiliary policemen, and |
---|
129 | 129 | | similar emergency management personnel, nor shall it pay the |
---|
130 | 130 | | compensation of personnel employed by or for a local |
---|
131 | 131 | | organization for emergency management. |
---|
132 | 132 | | (2) The director's authority pursuant to this |
---|
133 | 133 | | subsection includes the use of appropriated funds to purchase |
---|
134 | 134 | | items that are reasonably necessary to promote the functions |
---|
135 | 135 | | assigned to the Emergency Management Agency by this article, |
---|
136 | 136 | | including materials to educate the public on emergency |
---|
137 | 137 | | preparedness. |
---|
138 | 138 | | (c) The director and other personnel of the Emergency |
---|
139 | 139 | | Management Agency shall be provided with appropriate office |
---|
140 | 140 | | space, furniture, equipment, supplies, stationery, and |
---|
141 | 141 | | printing in the same manner as provided for personnel of other |
---|
142 | 142 | | state agencies. |
---|
143 | 143 | | (d) The director, subject to the direction and control |
---|
144 | 144 | | of the Governor, shall be the executive head of the Emergency |
---|
145 | 145 | | Management Agency and shall be responsible to the Governor for |
---|
146 | 146 | | carrying out the program for emergency management of this |
---|
147 | 147 | | state. The director shall coordinate the activities of all |
---|
148 | 148 | | organizations of emergency management within the state, and |
---|
149 | 149 | | shall maintain liaison with and cooperate with major |
---|
150 | 150 | | commanders of the armed forces within the state , the Alabama |
---|
151 | 151 | | State Law Enforcement Agency, the State Military Department, |
---|
152 | 152 | | and with emergency management agencies and organizations of |
---|
