1717 SYNOPSIS:
1818 Cannabidiol (CBD) is naturally produced in hemp
1919 in significant amounts, and delta-9
2020 tetrahydrocannabinol (delta-9 THC) is naturally
2121 produced in very low amounts. Compounds, including
2222 delta-8-tetrahydrocannabinol (delta-8 THC) and
2323 delta-10-tetrahydrocannabinol (delta-10 THC) can be
2424 synthesized from CBD, and delta-9 THC can be
2525 concentrated into significant amounts. All of these THC
2626 compounds are pscyhoactive.
2727 Under existing law, these THC compounds, which
2828 are found in or derived from hemp and termed
2929 "psychoactive cannabinoids," may be sold in Alabama,
3030 but may not be sold to minors and must be located in an
3131 area where minors cannot access the products.
3232 This bill would prohibit any possession and sale
3333 of psychoactive cannabinoids, except as permitted under
3434 the medical cannabis laws.
3535 This bill would also provide criminal penalties
3636 for violations.

7070 Relating to cannabis; to amend Section 13A-12-214.4,
7171 Code of Alabama 1975, and add Sections 13A-12-214.5 and
7272 13A-12-214.6 to the Code of Alabama 1975; to prohibit the
7373 possession and sale of psychoactive cannabinoids; and provide
7474 for criminal penalties.
7575 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
7676 Section 1. Section 13A-12-214.4, Code of Alabama 1975,
7777 is amended to read as follows:
7878 "§13A-12-214.4
7979 (a) As used in For purposes of this section and
8080 Sections 13A-12-214.5 and 13A-12-214.6 , "psychoactive
8181 cannabinoids" means cannabinoids derived from or found in hemp
8282 as defined in Section 2-8-381, including, but not limited to,
8383 delta-8-tetrahydrocannabinol , delta-9tetrahydrocannabinol, and
8484 delta-10-tetrahydrocannabinol.
8585 (b) Except as provided in Chapter 2A of Title 20,
8686 psychoactive cannabinoids shall not be sold, distributed, or
8787 marketed to, or possessed by an individual who is under 21
8888 years of age.
8989 (c) Any psychoactive cannabinoids lawfully sold in this
9090 state must be located in an area in which individuals under
9191 the age of 21 years are not permitted access.
9292 (d) Any person who sells, distributes, or markets
9393 psychoactive cannabinoids to individuals under 21 years of age
9494 shall be guilty of a Class B misdemeanor.
9595 (e) Any individual under 21 years of age who is in
9696 possession of psychoactive cannabinoids shall be issued a

126126 possession of psychoactive cannabinoids shall be issued a
127127 citation similar to a uniform nontraffic citation and shall be
128128 fined not less than fifty dollars ($50) nor more than two
129129 hundred dollars ($200) for each violation or community service
130130 in equal value of the fine and shall be assessed no other
131131 court costs or fees. In addition, on a third or subsequent
132132 conviction, including convictions in district court or
133133 municipal court, the individual shall be issued a citation
134134 similar to a uniform nontraffic citation and shall be fined
135135 four hundred dollars ($400) for each violation or community
136136 service in equal value of the fine.
137137 (f) Any psychoactive cannabinoids sold in this state
138138 shall be packaged in child-resistant containers
139139 (b) Except as otherwise authorized under Chapter 2A of
140140 Title 20, a person commits the crime of unlawful possession of
141141 psychoactive cannabinoids in the first degree if:
142142 (1) He or she possesses psychoactive cannabinoids for
143143 other than personal use; or
144144 (2) He or she possesses psychoactive cannabinoids for
145145 his or her personal use only after having been previously
146146 convicted of unlawful possession of psychoactive cannabinoids
147147 in the second degree or unlawful possession of psychoactive
148148 cannabinoids for his or her personal use only.
149149 (c) Unlawful possession of psychoactive cannabinoids in
150150 the first degree pursuant to subdivision (b)(1) is a Class C
151151 felony.
152152 (d) Unlawful possession of psychoactive cannabinoids in
153153 the first degree pursuant to subdivision (b)(2) is a Class D

188188 (a) Except as otherwise authorized under Chapter 2A of
189189 Title 20, a person commits the crime of unlawful possession of
190190 psychoactive cannabinoids in the second degree if he or she
191191 possesses psychoactive cannabinoids for his or her personal
192192 use only.
193193 (b) Unlawful possession of psychoactive cannabinoids in
194194 the second degree is a Class A misdemeanor.

196196 (a) Except as otherwise authorized under Chapter 2A of
197197 Title 20, a person commits the crime of unlawful sale of
198198 psychoactive cannabinoids if he or she produces, manufactures,
199199 sells, offers for sale, delivers, or brings into the state any
200200 psychoactive cannabinoids.
201201 (b) Unlawful sale of psychoactive cannabinoids is a
202202 Class D felony.
203203 Section 3. This act shall become effective on October
204204 1, 2025.
