18 | 18 | | Cannabidiol (CBD) is naturally produced in hemp |
---|
19 | 19 | | in significant amounts, and delta-9 |
---|
20 | 20 | | tetrahydrocannabinol (delta-9 THC) is naturally |
---|
21 | 21 | | produced in very low amounts. Compounds, including |
---|
22 | 22 | | delta-8-tetrahydrocannabinol (delta-8 THC) and |
---|
23 | 23 | | delta-10-tetrahydrocannabinol (delta-10 THC) can be |
---|
24 | 24 | | synthesized from CBD, and delta-9 THC can be |
---|
25 | 25 | | concentrated into significant amounts. All of these THC |
---|
26 | 26 | | compounds are pscyhoactive. |
---|
27 | 27 | | Under existing law, these THC compounds, which |
---|
28 | 28 | | are found in or derived from hemp and termed |
---|
29 | 29 | | "psychoactive cannabinoids," may be sold in Alabama, |
---|
30 | 30 | | but may not be sold to minors and must be located in an |
---|
31 | 31 | | area where minors cannot access the products. |

32 | 32 | | This bill would prohibit any possession and sale |

33 | 33 | | of psychoactive cannabinoids, except as permitted under |

34 | 34 | | the medical cannabis laws. |

75 | 75 | | BE IT ENACTED BY THE LEGISLATURE OF ALABAMA: |

76 | 76 | | Section 1. Section 13A-12-214.4, Code of Alabama 1975, |
---|
77 | 77 | | is amended to read as follows: |

78 | 78 | | "§13A-12-214.4 |
---|
79 | 79 | | (a) As used in For purposes of this section and |

80 | 80 | | Sections 13A-12-214.5 and 13A-12-214.6 , "psychoactive |

81 | 81 | | cannabinoids" means cannabinoids derived from or found in hemp |

82 | 82 | | as defined in Section 2-8-381, including, but not limited to, |

83 | 83 | | delta-8-tetrahydrocannabinol , delta-9tetrahydrocannabinol, and |

84 | 84 | | delta-10-tetrahydrocannabinol. |

85 | 85 | | (b) Except as provided in Chapter 2A of Title 20, |

86 | 86 | | psychoactive cannabinoids shall not be sold, distributed, or |
---|
87 | 87 | | marketed to, or possessed by an individual who is under 21 |
---|
88 | 88 | | years of age. |
---|
89 | 89 | | (c) Any psychoactive cannabinoids lawfully sold in this |
---|
90 | 90 | | state must be located in an area in which individuals under |
---|
91 | 91 | | the age of 21 years are not permitted access. |
---|
92 | 92 | | (d) Any person who sells, distributes, or markets |
---|
93 | 93 | | psychoactive cannabinoids to individuals under 21 years of age |

94 | 94 | | shall be guilty of a Class B misdemeanor. |

142 | 142 | | (1) He or she possesses psychoactive cannabinoids for |

144 | 144 | | (2) He or she possesses psychoactive cannabinoids for |
