SYNOPSIS:
Under existing law, food trucks and similar
mobile food vendors must obtain business licenses and
be inspected by local health officials and fire
officials in all counties and municipalities in which
the mobile food vendors temporarily operate.
This bill would require mobile food vendors to
meet all of the requirements for operating a mobile
food vendor in the jurisdiction where the vendor has
established its permanent commissary, that is, its
permanent location where the vendor parks when not in
service. 
This bill would otherwise exempt a mobile food
vendor from obtaining individual licenses or other
requisite permissions from local jurisdictions when the
mobile food vendor travels outside the jurisdiction of
its permanent commissary.

Relating to food trucks and other mobile food vendors;
to exempt mobile food vendors from obtaining licenses and

to exempt mobile food vendors from obtaining licenses and
other permissions to operate in various locations throughout
the state so long as the vendors meet the requirements for
operating in the jurisdiction where the vendors establish
their permanent commissary.
BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
Section 1. (a) As used in this section, the following
terms have the following meanings:
(1) COMMISSARY. A fixed location as designated by the
operator of a mobile food vendor where the mobile food vendor
is parked when not in use.
(2) MOBILE FOOD VENDOR. A mobile food service
establishment from which a vendor prepares, cooks, sells, or
serves food. The term includes any mobile food establishment
regulated by the Alabama Department of Public Health, any
structure housed on a motor vehicle chassis or on a trailer
that a motor vehicle pulls to transport the cooking equipment
or food service establishment, or a cart used for food
services which is not motorized.
(b)(1) On and after October 1, 2025, a mobile food
vendor shall be subject to all applicable state and local
laws, rules, regulations, and ordinances necessary to operate
only in the jurisdiction where the mobile food vendor operator
has established its commissary. A mobile food vendor shall be
otherwise exempt from obtaining any other license, permit, or
other permission, including undergoing an inspection, in any
other jurisdiction in the state where the mobile food vendor
temporarily operates. 
(2) Notwithstanding subdivision (1), a mobile food

(2) Notwithstanding subdivision (1), a mobile food
vendor shall be subject to all applicable municipal zoning
ordinances at all times. 
(c) To the extent that a mobile food vendor is required
by law, rule, regulation, or ordinance to be licensed,
permitted, or inspected, or any combination thereof, by any
governmental body, whether state or local, in order to conduct
business on a temporary basis in a specific jurisdiction, this
section shall supersede any such provision that conflicts with
this section but shall otherwise be construed in pari materia
with such provision. 
Section 2. This act shall become effective on October
1, 2025.
