This bill would require mobile food vendors to meet all of the requirements for operating a mobile food vendor in the jurisdiction where the vendor has established its permanent commissary, that is, its permanent location where the vendor parks when not in service. This bill would otherwise exempt a mobile food vendor from obtaining individual licenses or other requisite permissions from local jurisdictions when the mobile food vendor travels outside the jurisdiction of its permanent commissary. BE IT ENACTED BY THE LEGISLATURE OF ALABAMA: Section 1. (a) As used in this section, the following terms have the following meanings: (1) COMMISSARY. A fixed location as designated by the operator of a mobile food vendor where the mobile food vendor is parked when not in use. (2) MOBILE FOOD VENDOR. The term includes any mobile food establishment regulated by the Alabama Department of Public Health, any structure housed on a motor vehicle chassis or on a trailer that a motor vehicle pulls to transport the cooking equipment or food service establishment, or a cart used for food services which is not motorized. (b)(1) On and after October 1, 2025, a mobile food vendor shall be subject to all applicable state and local laws, rules, regulations, and ordinances necessary to operate only in the jurisdiction where the mobile food vendor operator has established its commissary. A mobile food vendor shall be otherwise exempt from obtaining any other license, permit, or other permission, including undergoing an inspection, in any other jurisdiction in the state where the mobile food vendor temporarily operates.
