1717 AN ACT
1818 Relating to Baldwin County; to amend Sections 45-2-190
1919 and 45-2-244.183, Code of Alabama 1975; to further provide for
2020 the Baldwin County Legislative Office Fund; and to further
2121 provide for distributions from the privilege license tax.
2222 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
2323 Section 1. Sections 45-2-190 and 45-2-244.183, Code of
2424 Alabama 1975, are amended to read as follows:
2525 "§45-2-190
2626 (a) There is hereby established the Baldwin County
2727 Legislative Office. The County Commission of Baldwin County
2828 shall provide office space, office furniture, office
2929 equipment, telephone service, and accommodation for the
3030 members of the legislative delegation from the county. The
3131 personnel for the legislative delegation office shall be
3232 selected by the members of the legislative delegation. The
3333 personnel may or may not be considered county employees for
3434 the purposes of being eligible to participate in and be
3535 eligible for benefits available to county employees. The
3636 county commission or members of the legislative delegation may
3737 contract for services or employment with such personnel. The

6767 contract for services or employment with such personnel. The
6868 personnel shall serve at the pleasure of the legislative
6969 delegation. The amount of compensation for each of the
7070 assistants shall be fixed by the members of the legislative
7171 delegation and such compensation and benefits shall be paid by
7272 the county from the special fund established in Section
7373 45-2-220.05Baldwin County Legislative Office Fund .
7474 (b) The county commission shall maintain a Baldwin
7575 County Legislative Office Fund to be used for the purposes of
7676 establishing, operating, and maintaining the county
7777 legislative delegation office. Disbursements from the fund
7878 shall be made by the county commission only upon direction of
7979 a majority of the members of the county legislative
8080 delegation. Any unexpended balance in the fund at the end of
8181 the county fiscal year shall not revert to any other state or
8282 local fund.
8383 (c) The county commission may make any appropriations
8484 it deems necessary from time to time from the county general
8585 fund to the Baldwin County Legislative Office Fund.
8686 (d) If, at the end of any county fiscal year, the
8787 Baldwin County Legislative Office Fund contains more than
8888 three hundred thousand dollars ($300,000), the excess balance
8989 up to one hundred thousand dollars ($100,000) per year shall
9090 be distributed to the Baldwin County Historic Development
9191 Commission for the purposes of capital improvements,
9292 maintenance, and repairs to the items and properties the
9393 commission oversees. The commission, before the conclusion of
9494 each fiscal year where the commission received funds pursuant
9595 to this subsection, shall send a report to the legislative

125125 to this subsection, shall send a report to the legislative
126126 delegation detailing how the funds were used. "

128128 (a) The privilege license tax levied hereunder, except
129129 where otherwise provided, shall be due and payable in monthly
130130 installments on or before the twentieth day of the month next
131131 succeeding the month in which the privilege license tax
132132 accrues. On or before such twentieth day, every person on whom
133133 the amounts levied hereunder are imposed shall render to the
134134 county, on a form or forms prescribed by the county commission
135135 or State Department of Revenue, a true and correct statement
136136 showing the gross proceeds of his or her business for the next
137137 preceding month, the amount of gross proceeds which are not
138138 subject to the privilege license tax, or are not to be used as
139139 a measurement of the amounts due by such person and the nature
140140 thereof, together with such other information as the county
141141 commission may require, and at the time of making such monthly
142142 report such person shall compute the privilege license taxes
143143 due and shall pay the Baldwin County Commission the amounts
144144 shown to be due. All taxes of the county shall be deposited
145145 into the general fund of the county treasury to be distributed
146146 as follows:
147147 (1) Seventy-five percent shall be distributed to the
148148 county general fund to be expended, as approved by the Baldwin
149149 County Commission, for general purposes; however, and per
150150 fiscal year from the foregoing distribution, the Baldwin
151151 County Commission shall appropriate two hundred thousand
152152 dollars ($200,000) into a separate county fund to be used for
153153 the operation of the Baldwin County Legislative Office,

183183 the operation of the Baldwin County Legislative Office,
184184 established by Section 45-2-190, including, but not limited
185185 to, office equipment, communication equipment, salary
186186 supplements for personnel of the legislative delegation
187187 office, training, and official public travel for House and
188188 Senate members of the Baldwin County Legislative Delegation
189189 and personnel of the legislative delegation office and other
190190 expenses deemed appropriate only by written direction provided
191191 the Baldwin County Commission by the House and Senate members
192192 of the Baldwin County Legislative Delegation. The members and
193193 personnel of the office may be eligible for reimbursement
194194 where applicable under the same policies, procedures, and
195195 conditions as county elected officials as provided in County
196196 Commission Policy No. 8.6 and subsequent policies. All of the
197197 policies shall be subject to the same audit provisions as
198198 provided for the office. Notwithstanding the foregoing, the
199199 expenses for official travel by a member of the House of
200200 Representatives representing Baldwin County outside of his or
201201 her district shall not exceed two thousand dollars ($2,000)
202202 per House of Representatives member during a county fiscal
203203 year, shall be subject to a majority vote of the House
204204 delegation, and shall be subject to periodic audits by the
205205 Department of Examiners of Public Accounts. Expenses for
206206 official travel by a member of the Senate representing Baldwin
207207 County outside of his or her district shall not exceed seven
208208 thousand five hundred dollars ($7,500) per senator during a
209209 county fiscal year and shall be subject to periodic audits by
210210 the Department of Examiners of Public Accounts.
211211 (2) Twelve percent shall be distributed into a separate

241241 (2) Twelve percent shall be distributed into a separate
242242 county fund to be expended for historic sites in Baldwin
243243 County as follows: At least ten 10 percent shall be expended
244244 for the Historic Blakeley Authority and up to two percent
245245 shall be expended for other historic sites in Baldwin County.
246246 The Baldwin County Commission shall produce a report annually
247247 for the House and Senate members of the Baldwin County
248248 Legislative Delegation detailing the disbursement of these
249249 funds.
250250 (3) Eight percent shall be distributed to the Baldwin
251251 County Economic Development Alliance for the purposes of
252252 growing and improving the county's economy.
253253 (4) One and one-half percent shall be distributed to
254254 the Baldwin County Historic Development Commission for the
255255 purposes of capital improvements, maintenance, and repairs to
256256 the properties and items the commission oversees.
257257 (4)(5) The remaining balance in the fund at the end of
258258 the county fiscal year shall revert to the Baldwin County
259259 Legislative Delegation Office established by Section 45-2-190,
260260 to be expended as provided in subdivision (1) in addition to
261261 any other sums provided.
262262 (b) Privilege or license taxes collected and expended
263263 under authority of this subpart shall be audited by the
264264 Department of Examiners of Public Accounts.
265265 (c) If any person subject hereto should fail to render
266266 any report, return, statement, or form required hereby or
267267 should willfully make false statement of facts in the report,
268268 return, statement, or form required hereunder, he or she shall
269269 upon conviction be punished by a fine of not more than five
