18 | 18 | | Relating to Baldwin County; to amend Sections 45-2-190 |

22 | 22 | | BE IT ENACTED BY THE LEGISLATURE OF ALABAMA: |
---|
23 | 23 | | Section 1. Sections 45-2-190 and 45-2-244.183, Code of |
---|
24 | 24 | | Alabama 1975, are amended to read as follows: |
---|
25 | 25 | | "§45-2-190 |
---|
26 | 26 | | (a) There is hereby established the Baldwin County |
---|
27 | 27 | | Legislative Office. The County Commission of Baldwin County |
---|
28 | 28 | | shall provide office space, office furniture, office |
---|
29 | 29 | | equipment, telephone service, and accommodation for the |
---|
30 | 30 | | members of the legislative delegation from the county. The |
---|
31 | 31 | | personnel for the legislative delegation office shall be |
---|
32 | 32 | | selected by the members of the legislative delegation. The |
---|
33 | 33 | | personnel may or may not be considered county employees for |
---|
34 | 34 | | the purposes of being eligible to participate in and be |
---|
35 | 35 | | eligible for benefits available to county employees. The |
---|
36 | 36 | | county commission or members of the legislative delegation may |
---|
37 | 37 | | contract for services or employment with such personnel. The |

---|
68 | 68 | | personnel shall serve at the pleasure of the legislative |
---|
69 | 69 | | delegation. The amount of compensation for each of the |
---|
70 | 70 | | assistants shall be fixed by the members of the legislative |
---|
71 | 71 | | delegation and such compensation and benefits shall be paid by |
---|
72 | 72 | | the county from the special fund established in Section |
---|
73 | 73 | | 45-2-220.05Baldwin County Legislative Office Fund . |
---|
74 | 74 | | (b) The county commission shall maintain a Baldwin |
---|
75 | 75 | | County Legislative Office Fund to be used for the purposes of |
---|
76 | 76 | | establishing, operating, and maintaining the county |
---|
77 | 77 | | legislative delegation office. Disbursements from the fund |
---|
78 | 78 | | shall be made by the county commission only upon direction of |
---|
79 | 79 | | a majority of the members of the county legislative |
---|
80 | 80 | | delegation. Any unexpended balance in the fund at the end of |
---|
81 | 81 | | the county fiscal year shall not revert to any other state or |
---|
82 | 82 | | local fund. |
---|
83 | 83 | | (c) The county commission may make any appropriations |
---|
84 | 84 | | it deems necessary from time to time from the county general |
---|
85 | 85 | | fund to the Baldwin County Legislative Office Fund. |
---|
86 | 86 | | (d) If, at the end of any county fiscal year, the |
---|
87 | 87 | | Baldwin County Legislative Office Fund contains more than |
---|
88 | 88 | | three hundred thousand dollars ($300,000), the excess balance |
---|
89 | 89 | | up to one hundred thousand dollars ($100,000) per year shall |
---|
90 | 90 | | be distributed to the Baldwin County Historic Development |
---|
91 | 91 | | Commission for the purposes of capital improvements, |
---|
92 | 92 | | maintenance, and repairs to the items and properties the |
---|
93 | 93 | | commission oversees. The commission, before the conclusion of |
---|
94 | 94 | | each fiscal year where the commission received funds pursuant |
---|
95 | 95 | | to this subsection, shall send a report to the legislative |
---|

---|
128 | 128 | | (a) The privilege license tax levied hereunder, except |
---|
129 | 129 | | where otherwise provided, shall be due and payable in monthly |
---|
130 | 130 | | installments on or before the twentieth day of the month next |
---|
131 | 131 | | succeeding the month in which the privilege license tax |
---|
132 | 132 | | accrues. On or before such twentieth day, every person on whom |
---|
133 | 133 | | the amounts levied hereunder are imposed shall render to the |
---|
134 | 134 | | county, on a form or forms prescribed by the county commission |
---|
135 | 135 | | or State Department of Revenue, a true and correct statement |
---|
136 | 136 | | showing the gross proceeds of his or her business for the next |
---|
137 | 137 | | preceding month, the amount of gross proceeds which are not |
---|
138 | 138 | | subject to the privilege license tax, or are not to be used as |
---|
139 | 139 | | a measurement of the amounts due by such person and the nature |
---|
140 | 140 | | thereof, together with such other information as the county |
---|
141 | 141 | | commission may require, and at the time of making such monthly |
---|
142 | 142 | | report such person shall compute the privilege license taxes |
---|
143 | 143 | | due and shall pay the Baldwin County Commission the amounts |
---|
144 | 144 | | shown to be due. All taxes of the county shall be deposited |
---|
145 | 145 | | into the general fund of the county treasury to be distributed |
---|
146 | 146 | | as follows: |
---|
147 | 147 | | (1) Seventy-five percent shall be distributed to the |
---|
148 | 148 | | county general fund to be expended, as approved by the Baldwin |
---|
149 | 149 | | County Commission, for general purposes; however, and per |
---|
150 | 150 | | fiscal year from the foregoing distribution, the Baldwin |
---|
151 | 151 | | County Commission shall appropriate two hundred thousand |
---|
152 | 152 | | dollars ($200,000) into a separate county fund to be used for |
---|
153 | 153 | | the operation of the Baldwin County Legislative Office, |

188 | 188 | | Senate members of the Baldwin County Legislative Delegation |

190 | 190 | | expenses deemed appropriate only by written direction provided |
---|
191 | 191 | | the Baldwin County Commission by the House and Senate members |
---|
192 | 192 | | of the Baldwin County Legislative Delegation. The members and |
---|
193 | 193 | | personnel of the office may be eligible for reimbursement |
---|
194 | 194 | | where applicable under the same policies, procedures, and |
---|
195 | 195 | | conditions as county elected officials as provided in County |
---|
196 | 196 | | Commission Policy No. 8.6 and subsequent policies. All of the |
---|
197 | 197 | | policies shall be subject to the same audit provisions as |
---|
198 | 198 | | provided for the office. Notwithstanding the foregoing, the |
---|
199 | 199 | | expenses for official travel by a member of the House of |
---|
200 | 200 | | Representatives representing Baldwin County outside of his or |
---|
201 | 201 | | her district shall not exceed two thousand dollars ($2,000) |
---|
202 | 202 | | per House of Representatives member during a county fiscal |
---|
203 | 203 | | year, shall be subject to a majority vote of the House |
---|
204 | 204 | | delegation, and shall be subject to periodic audits by the |
---|
205 | 205 | | Department of Examiners of Public Accounts. Expenses for |
---|
206 | 206 | | official travel by a member of the Senate representing Baldwin |
---|
207 | 207 | | County outside of his or her district shall not exceed seven |
---|
208 | 208 | | thousand five hundred dollars ($7,500) per senator during a |
---|
209 | 209 | | county fiscal year and shall be subject to periodic audits by |
---|
210 | 210 | | the Department of Examiners of Public Accounts. |

243 | 243 | | County as follows: At least ten 10 percent shall be expended |

244 | 244 | | for the Historic Blakeley Authority and up to two percent |
---|
245 | 245 | | shall be expended for other historic sites in Baldwin County. |
---|
246 | 246 | | The Baldwin County Commission shall produce a report annually |
---|
247 | 247 | | for the House and Senate members of the Baldwin County |
---|
248 | 248 | | Legislative Delegation detailing the disbursement of these |
---|
249 | 249 | | funds. |
---|
250 | 250 | | (3) Eight percent shall be distributed to the Baldwin |
---|
251 | 251 | | County Economic Development Alliance for the purposes of |
---|
252 | 252 | | growing and improving the county's economy. |
---|
253 | 253 | | (4) One and one-half percent shall be distributed to |
---|
254 | 254 | | the Baldwin County Historic Development Commission for the |
---|
255 | 255 | | purposes of capital improvements, maintenance, and repairs to |
---|
256 | 256 | | the properties and items the commission oversees. |
---|
257 | 257 | | (4)(5) The remaining balance in the fund at the end of |
---|
258 | 258 | | the county fiscal year shall revert to the Baldwin County |
---|
259 | 259 | | Legislative Delegation Office established by Section 45-2-190, |
---|
260 | 260 | | to be expended as provided in subdivision (1) in addition to |
---|
261 | 261 | | any other sums provided. |
---|
262 | 262 | | (b) Privilege or license taxes collected and expended |
---|
263 | 263 | | under authority of this subpart shall be audited by the |
---|
264 | 264 | | Department of Examiners of Public Accounts. |
---|
265 | 265 | | (c) If any person subject hereto should fail to render |
---|
266 | 266 | | any report, return, statement, or form required hereby or |
---|
267 | 267 | | should willfully make false statement of facts in the report, |
---|
268 | 268 | | return, statement, or form required hereunder, he or she shall |
