1717 SYNOPSIS:
1818 State and local law may establish deadlines for
1919 when a government agency must take action on an
2020 application for a license, permit, or other
2121 certification.
2222 This bill would require a state or local
2323 governmental body, if no law provides for a time frame,
2424 to approve or deny any application for a license,
2525 permit, or other certification within 45 days of
2626 receiving the application, unless this time frame is
2727 waived by the applicant.
2828 This bill would also provide that if the
2929 governmental body does not take action within 45 days,
3030 the license, permit, or other certification shall be
3131 deemed approved.

6868 prescribed time frame and if a governmental body fails to do
6969 so, deem the license or permit approved.
7070 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
7171 Section 1. (a) For the purposes of this section, the
7272 following terms have the following meanings:
7373 (1) LICENSE. Any license, permit, or other
7474 certification issued by a state governmental body which is
7575 necessary by law to operate a business, engage in an
7676 occupation, or undertake a specific activity.
7777 (2) STATE GOVERNMENTAL BODY. The state and any agency,
7878 department, board, or commission of the state responsible for
7979 approving and issuing any license.
8080 (b) Unless a law specifies otherwise, a state
8181 governmental body shall:
8282 (1) Upon receiving an application for a license,
8383 determine whether the application is complete and if not,
8484 within 15 calendar days after receiving the application,
8585 respond to the applicant in writing with a description of the
8686 deficiencies in the application.
8787 (2) Within 45 calendar days after receiving a completed
8888 application for a license, approve or deny the application.
8989 (c) Unless waived by the applicant, if a state
9090 governmental body fails to approve or deny an application for
9191 license within the 45-day period described in subdivision
9292 (b)(2), the application for the license shall be deemed
9393 approved, and the state governmental body shall forthwith
9494 issue the license upon the payment of any applicable fee.
9595 Section 2. (a) For the purposes of this section, the

133133 board, or commission of the county or municipality responsible

135135 (b) Unless a law specifies otherwise, a local
136136 governmental body shall:
137137 (1) Upon receiving an application for a license,
138138 determine whether the application is complete and if not,
139139 within 15 calendar days after receiving the application,
140140 respond to the applicant in writing with a description of the
