17	17	SYNOPSIS:
18	18	State and local law may establish deadlines for
19	19	when a government agency must take action on an
20	20	application for a license, permit, or other
21	21	certification.
22	22	This bill would require a state or local
23	23	governmental body, if no law provides for a time frame,
24	24	to approve or deny any application for a license,
25	25	permit, or other certification within 45 days of
26	26	receiving the application, unless this time frame is
27	27	waived by the applicant.
28	28	This bill would also provide that if the
29	29	governmental body does not take action within 45 days,
30	30	the license, permit, or other certification shall be
31	31	deemed approved.

36	36	require state and local governmental bodies in certain
37	37	circumstances to approve or deny licenses and permits within a
38	38	prescribed time frame and if a governmental body fails to do

68	68	prescribed time frame and if a governmental body fails to do
69	69	so, deem the license or permit approved.
70	70	BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
71	71	Section 1. (a) For the purposes of this section, the
72	72	following terms have the following meanings:
73	73	(1) LICENSE. Any license, permit, or other
74	74	certification issued by a state governmental body which is
75	75	necessary by law to operate a business, engage in an
76	76	occupation, or undertake a specific activity.
77	77	(2) STATE GOVERNMENTAL BODY. The state and any agency,
78	78	department, board, or commission of the state responsible for
79	79	approving and issuing any license.
80	80	(b) Unless a law specifies otherwise, a state
81	81	governmental body shall:
82	82	(1) Upon receiving an application for a license,
83	83	determine whether the application is complete and if not,
84	84	within 15 calendar days after receiving the application,
85	85	respond to the applicant in writing with a description of the
86	86	deficiencies in the application.
87	87	(2) Within 45 calendar days after receiving a completed
88	88	application for a license, approve or deny the application.
89	89	(c) Unless waived by the applicant, if a state
90	90	governmental body fails to approve or deny an application for
91	91	license within the 45-day period described in subdivision
92	92	(b)(2), the application for the license shall be deemed
93	93	approved, and the state governmental body shall forthwith
94	94	issue the license upon the payment of any applicable fee.

132	132	governing body of a municipality, or any agency, department,
133	133	board, or commission of the county or municipality responsible
134	134	for approving and issuing any license.

136	136	governmental body shall:
137	137	(1) Upon receiving an application for a license,
138	138	determine whether the application is complete and if not,
139	139	within 15 calendar days after receiving the application,
140	140	respond to the applicant in writing with a description of the
