1717 SYNOPSIS:
1818 This bill would require individuals in
1919 possession of a firearm to secure the firearm in a
2020 manner that a reasonable individual would know that an
2121 unauthorized individual is not likely to gain access to
2222 the firearm.
2323 This bill would also provide a criminal penalty
2424 for securing a firearm in violation of this
2525 requirement.

2929 Relating to firearms; to establish firearm storage
3030 requirements; and to establish criminal penalties for
3131 violations.
3232 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
3333 Section 1. (a) For the purposes of this section, the
3434 following terms have the following meanings:
3535 (1) FIREARM. The same meaning as provided in Section
3636 13A-8-1, Code of Alabama 1975.
3737 (2) UNAUTHORIZED PERSON. Any individual whom a
3838 possessor of a firearm has not authorized to possess the

6868 possessor of a firearm has not authorized to possess the
6969 firearm or any individual not legally permitted to possess a
7070 particular firearm under state or federal law.
7171 (b) An individual shall at all times secure a firearm
7272 in his or her possession, control, care, or custody in a
7373 manner and location where the individual knows, or reasonably
7474 should know, that an unauthorized person is not likely to gain
7575 access to the firearm.
7676 (c) A violation of subsection (b) is a Class C felony.
7777 (d) Neither of the following shall be construed to have
7878 been stored in violation of subsection (b):
7979 (1) A firearm stored with a gun lock.
8080 (2) A firearm carried on one's person.
8181 Section 2. This act shall become effective on October
8282 1, 2025.
