17	17	AN ACT
18	18	Relating to Lee County; to amend Sections 45-41-130,
19	19	45-41-130.01, 45-41-130.02, and 45-41-130.03, Code of Alabama
20	20	1975, to further provide for the functions, duties, and
21	21	responsibilities of the county engineer and county commission.
22	22	BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
23	23	Section 1. Sections 45-41-130, 45-41-130.01,
24	24	45-41-130.02, and 45-41-130.03, Code of Alabama 1975, are
25	25	amended to read as follows:
26	26	"§45-41-130
27	27	(a) The Lee County Commission shall employ a county
28	28	engineer who shall be a thoroughly qualified and competent
29	29	civil engineer possessing all of the qualifications as
30	30	specified for county engineers under the general laws of the
31	31	State of Alabama and who shall reside in Lee County during his
32	32	or her employment ; and the commission shall delegate authority
33	33	to the.
34	34	(b) The county engineer to manageshall be responsible
35	35	for the management of the county highway department and
36	36	maintainthe maintenance of county roads, highways, bridges,
37	37	and ferries in Lee County at the discretion of the county

67	67	and ferries in Lee County at the discretion of the county
68	68	commission or its designee . "
69	69	"§45-41-130.01
70	70	Before commencing his or her duties, the county
71	71	engineer shall enter into a bond for faithful performance of
72	72	his or her duties in such amount and with such sureties as
73	73	shall be approved by the commission ; and in. In carrying out
74	74	his or her duties , he or she shall report to the county
75	75	commission as a whole or its designee ."
76	76	"§45-41-130.02
77	77	(a) All functions, duties, and responsibilities for the
78	78	construction, maintenance, and repair of county roads,
79	79	highways, bridges, and ferries in Lee County are hereby vested
80	80	inshall be delegated to the county engineer, who shall,
81	81	insofar as possible, construct and maintain suchthe roads,
82	82	highways, bridges, and ferries for the benefit of the county
83	83	as a whole or as a unit, without regard to district or beat
84	84	lines.
85	85	(b) Each member of the Lee County Commission shall be
86	86	authorized to inspect the roads in his or her district from
87	87	time to time and report their condition to the county
88	88	engineer."
89	89	"§45-41-130.03
90	90	The county engineer shall have the following duties and
91	91	authority, but shall not be limited to such duties It shall be
92	92	the duty of the county engineer to carry out the following as
93	93	determined by the county commission or its designee :
94	94	(1) To employ, supervise, and direct all such personnel
95	95	and such assistants as are necessary and authorized to

125	125	and such assistants as are necessary and authorized to
126	126	properly maintain and construct the county roads, highways,
127	127	bridges, and ferries of the county ,; to have the authority to
128	128	prescribe their duties ; and to discharge employees for cause
129	129	or when not needed.
130	130	(2) To perform or have performed such engineering and
131	131	surveying services as may be required; and to prepare and
132	132	maintain the necessary maps and records.
133	133	(3) To prepare and present to the county commission on
134	134	or before September 15 each year a proposed budget for the
135	135	county highway department and to maintain the necessary
136	136	records to show the expenditures made in constructing and
137	137	maintaining of the county highway system.
138	138	(4) To build or construct new roads, or change old
139	139	roads, upon the order of the county commission
140	140	(5) Insofar as is feasible to To construct and maintain
141	141	all county roads for the benefit of the county as a whole or
142	142	as a unit.
143	143	(6) To have the authority, under the laws of the State
144	144	of Alabama, to receive and evaluate bids and present to county
145	145	commission for approval.
146	146	(7) To have authority to promulgate adopt rules and
147	147	requirements regarding the approval, design, and construction
148	148	of roads, highways, and bridges that are to be accepted into
149	149	the county road system for permanent maintenance.
150	150	(8) To have full power and authority within Unless
151	151	otherwise determined by the county commission or its designee,
152	152	to expend budgeted funds to make purchases of all
153	153	materialmaterials, machinery, equipment, and supplies needed
