1717 AN ACT
1818 Relating to Lee County; to amend Sections 45-41-130,
1919 45-41-130.01, 45-41-130.02, and 45-41-130.03, Code of Alabama
2020 1975, to further provide for the functions, duties, and
2121 responsibilities of the county engineer and county commission.
2222 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
2323 Section 1. Sections 45-41-130, 45-41-130.01,
2424 45-41-130.02, and 45-41-130.03, Code of Alabama 1975, are
2525 amended to read as follows:
2626 "§45-41-130
2727 (a) The Lee County Commission shall employ a county
2828 engineer who shall be a thoroughly qualified and competent
2929 civil engineer possessing all of the qualifications as
3030 specified for county engineers under the general laws of the
3131 State of Alabama and who shall reside in Lee County during his
3232 or her employment ; and the commission shall delegate authority
3333 to the.
3434 (b) The county engineer to manageshall be responsible
3535 for the management of the county highway department and
3636 maintainthe maintenance of county roads, highways, bridges,
3737 and ferries in Lee County at the discretion of the county

7070 Before commencing his or her duties, the county
7171 engineer shall enter into a bond for faithful performance of
7272 his or her duties in such amount and with such sureties as
7373 shall be approved by the commission ; and in. In carrying out
7474 his or her duties , he or she shall report to the county
7575 commission as a whole or its designee ."
7676 "§45-41-130.02
7777 (a) All functions, duties, and responsibilities for the
7878 construction, maintenance, and repair of county roads,
7979 highways, bridges, and ferries in Lee County are hereby vested
8080 inshall be delegated to the county engineer, who shall,
8181 insofar as possible, construct and maintain suchthe roads,
8282 highways, bridges, and ferries for the benefit of the county
8383 as a whole or as a unit, without regard to district or beat
8484 lines.
8585 (b) Each member of the Lee County Commission shall be
8686 authorized to inspect the roads in his or her district from
8787 time to time and report their condition to the county
8888 engineer."
8989 "§45-41-130.03
9090 The county engineer shall have the following duties and
9191 authority, but shall not be limited to such duties It shall be
9292 the duty of the county engineer to carry out the following as
9393 determined by the county commission or its designee :
9494 (1) To employ, supervise, and direct all such personnel
9595 and such assistants as are necessary and authorized to

125125 and such assistants as are necessary and authorized to
126126 properly maintain and construct the county roads, highways,
127127 bridges, and ferries of the county ,; to have the authority to
128128 prescribe their duties ; and to discharge employees for cause
129129 or when not needed.
130130 (2) To perform or have performed such engineering and
131131 surveying services as may be required; and to prepare and
132132 maintain the necessary maps and records.
133133 (3) To prepare and present to the county commission on
134134 or before September 15 each year a proposed budget for the
135135 county highway department and to maintain the necessary
136136 records to show the expenditures made in constructing and
137137 maintaining of the county highway system.
138138 (4) To build or construct new roads, or change old
139139 roads, upon the order of the county commission
140140 (5) Insofar as is feasible to To construct and maintain
141141 all county roads for the benefit of the county as a whole or
142142 as a unit.
143143 (6) To have the authority, under the laws of the State
144144 of Alabama, to receive and evaluate bids and present to county
145145 commission for approval.
146146 (7) To have authority to promulgate adopt rules and
147147 requirements regarding the approval, design, and construction
148148 of roads, highways, and bridges that are to be accepted into
149149 the county road system for permanent maintenance.
150150 (8) To have full power and authority within Unless
151151 otherwise determined by the county commission or its designee,
152152 to expend budgeted funds to make purchases of all
153153 materialmaterials, machinery, equipment, and supplies needed
