17	17	AN ACT
18	18	Relating to Jefferson County; to amend Sections
19	19	45-37-72.20 and 45-37-72.21, Code of Alabama 1975, to further
20	20	provide for the filling of vacancies on the county commission;
21	21	and to repeal Sections 45-37-72.22 and 45-72.23, Code of
22	22	Alabama 1975, relating to election dates.
23	23	BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
24	24	Section 1. Sections 45-37-72.20 and 45-37-72.21, Code
25	25	of Alabama 1975, are amended to read as follows:
26	26	"§45-37-72.20
27	27	As herein used, the following terms have the meanings
28	28	hereby ascribed to them:
29	29	(1) COUNTY. Jefferson County, Alabama.
30	30	(2) COUNTYWIDE ELECTION. Any election, whether general,
31	31	special, or primary, including runoff elections, where
32	32	qualified electors throughout the county are entitled to vote
33	33	and which is held to elect a federal, state, or county officer
34	34	or to nominate a candidate or candidates, for a federal,
35	35	state, or county office or offices, to submit one or more
36	36	questions, including, but not limited to, the question of
37	37	adopting a proposed amendment to the Constitution of Alabama

67	67	adopting a proposed amendment to the Constitution of Alabama
68	68	of 19012022, and the question of whether general obligation
69	69	bonds, or revenue bonds, of the state or county shall be
70	70	issued.
71	71	(3) ELECTION COMMISSION. The election commission of the
72	72	county.
73	73	(4) FIRST PRIMARY ELECTION. The first primary election
74	74	for which this act subpart provides to fill a vacancy as
75	75	distinguished from the runoff election held hereunder, if a
76	76	runoff election is necessary.
77	77	(5) RUNOFF GENERAL ELECTION. The runoff general
78	78	election for which this subpart provides , if no candidate at
79	79	the first election receives a majority of the votes cast after
80	80	the party nomination .
81	81	(6) SCHEDULED COUNTYWIDE ELECTION. A countywide
82	82	election which is scheduled to be held on a date definitely
83	83	determined when a vacancy occurs.
84	84	(7) VACANCY. A vacancy on the governing body of the
85	85	county caused by death, resignation, impeachment, or any cause
86	86	except normal expiration of terms."

88	88	(a)(1) Within Except as provided in subsection (b),
89	89	within seven days from the occurrence of any vacancy, the
90	90	election commission, by a majority vote thereof, shall adopt a
91	91	resolution stating the dates on which date of the first
92	92	primary election which shall be held not less than 45 days nor
93	93	more than 60 days after the adoption of the resolution and the
94	94	runoff primary election, if necessary, which shall be held not

125	125	less than four weeks thereafter . The dates shall be determined
126	126	as provided for in Sections 45-37-72.22 and 45-37-72.23 The
127	127	resolution shall also set the date of the general election
128	128	which shall be held not less than three weeks nor more than
129	129	five weeks after the last primary election .
130	130	(2) The election commission may schedule the date of
131	131	the first primary election, a runoff primary election if
132	132	needed, and the general election on the date of any previously
133	133	scheduled countywide election provided the time for holding
134	134	the election meets the requirements of this section. The
135	135	ballot used by the judge of probate may be a special ballot
136	136	used only for an election under this section.
137	137	(b) When a vacancy occurs with more than six months
138	138	remaining on the unexpired term, the position shall remain
139	139	vacant until filled at the next scheduled countywide general
140	140	election. The election commission may provide for the conduct
141	141	of a special primary election and runoff primary election if
142	142	needed for the purposes of qualifying a candidate for the
143	143	general election. "
144	144	Section 2. Sections 45-37-72.22 and 45-37-72.23, Code
145	145	of Alabama 1975, relating to election dates, are repealed.
146	146	Section 3. This act shall become effective on June 1,
147	147	2025.
