17	17	AN ACT
18	18	Relating to Barbour County; to provide for new court
19	19	costs; to provide for disbursement of fees; and conditioning
20	20	operation on voter approval at a referendum.
21	21	BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
22	22	Section 1. (a) Immediately upon approval by a majority
23	23	of the voting qualified electors of Barbour County, in
24	24	addition to any other court costs authorized in the county,
25	25	there shall be taxed a fee as follows:
26	26	(1) Twenty-five dollars ($25) in each civil case filed
27	27	in any court, except for the small claims division of the
28	28	district court.
29	29	(2) Twenty-five dollars ($25) in all misdemeanor and
30	30	felony criminal cases, including traffic offenses, upon
31	31	conviction.
32	32	(3) Ten dollars ($10) for each case filed in the small
33	33	claims division of the district court.
34	34	(b) This fee shall not be waived by any court unless
35	35	all other fees, assessments, costs, fines, and charges
36	36	associated with the case are waived.

67	67	(c) The fees collected pursuant to this section shall
68	68	be paid into a special fund created by the sheriff known as
69	69	the Sheriff's Office Hazardous Duty Fund and shall be
70	70	earmarked for hazardous duty payments to nonclerical employees
71	71	of the sheriff's office who perform hazardous duties,
72	72	excluding the sheriff. This fund shall be maintained by the
73	73	sheriff or an individual designated by the sheriff and shall
74	74	be audited by the Department of Examiners of Public Accounts
75	75	on the same schedule as other similar audits.
76	76	(d)(1) The sheriff shall certify to the county
77	77	commission each employee who has engaged in hazardous duty and
78	78	an amount sufficient to pay the employees. The funds shall
79	79	then be disbursed from the Hazardous Duty Fund.
80	80	(2) At any time after the first disbursement of
81	81	hazardous duty pay pursuant to subdivision (1), the commission
82	82	and the sheriff may make hazardous duty payments
83	83	semi-annually, quarterly, or monthly as they agree
84	84	circumstances warrant, but may not make payments less often
85	85	than once per year.
86	86	(3) The commission shall not take this act into
87	87	consideration when considering salary increases for sheriff's
88	88	office employees based on surveys, studies, or any other means
89	89	when it comes to other county employees receiving salary
90	90	increases.
91	91	(4) The commission shall not take this act into
92	92	consideration when it comes to the annual budgetary funds
93	93	issued to the sheriff's office for funds used for the everyday
94	94	functioning of the sheriff's office.
95	95	Section 2. Section 1 shall become operative only if

125	125	Section 2. Section 1 shall become operative only if
126	126	approved by a majority of the qualified electors of Barbour
127	127	County who vote in an election to be held on the day
128	128	designated by the Judge of Probate of Barbour County. The
129	129	notice of the election shall be given by the judge of probate,
130	130	and the election shall be held, conducted, and the results
131	131	canvassed in the same manner as other county elections. The
132	132	election shall be held in conjunction with the next regularly
133	133	scheduled election to be held in the county. The question
134	134	shall be, "Do you favor the adoption of Act No. ____, of the
135	135	2025 Regular Session of the Alabama Legislature, to provide
136	136	hazardous duty pay to the nonclerical employees of the Barbour
137	137	County Sheriff's Office, excluding the sheriff, by issuing a
138	138	new court cost in Barbour County of no more than twenty-five
139	139	dollars ($25)? Yes( ) No( )." The county shall pay any costs
140	140	and expenses not otherwise reimbursed by a governmental agency
141	141	which are incidental to the election. If a majority of the
142	142	votes cast in the election are "Yes," Section 1 shall become
143	143	operative immediately. If the majority of the votes are "No,"
144	144	this act shall be repealed and shall have no further effect.
145	145	The Judge of Probate of Barbour County shall certify the
146	146	results of the election to the Secretary of State.
147	147	Section 3. This act shall become effective on June 1,
148	148	2025.
