1717 AN ACT
1818 Relating to Barbour County; to provide for new court
1919 costs; to provide for disbursement of fees; and conditioning
2020 operation on voter approval at a referendum.
2121 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
2222 Section 1. (a) Immediately upon approval by a majority
2323 of the voting qualified electors of Barbour County, in
2424 addition to any other court costs authorized in the county,
2525 there shall be taxed a fee as follows:
2626 (1) Twenty-five dollars ($25) in each civil case filed
2727 in any court, except for the small claims division of the
2828 district court.
2929 (2) Twenty-five dollars ($25) in all misdemeanor and
3030 felony criminal cases, including traffic offenses, upon
3131 conviction.
3232 (3) Ten dollars ($10) for each case filed in the small
3333 claims division of the district court.
3434 (b) This fee shall not be waived by any court unless
3535 all other fees, assessments, costs, fines, and charges
3636 associated with the case are waived.
3737 (c) The fees collected pursuant to this section shall

6767 (c) The fees collected pursuant to this section shall
6868 be paid into a special fund created by the sheriff known as
6969 the Sheriff's Office Hazardous Duty Fund and shall be
7070 earmarked for hazardous duty payments to nonclerical employees
7171 of the sheriff's office who perform hazardous duties,
7272 excluding the sheriff. This fund shall be maintained by the
7373 sheriff or an individual designated by the sheriff and shall
7474 be audited by the Department of Examiners of Public Accounts
7575 on the same schedule as other similar audits.
7676 (d)(1) The sheriff shall certify to the county
7777 commission each employee who has engaged in hazardous duty and
7878 an amount sufficient to pay the employees. The funds shall
7979 then be disbursed from the Hazardous Duty Fund.
8080 (2) At any time after the first disbursement of
8181 hazardous duty pay pursuant to subdivision (1), the commission
8282 and the sheriff may make hazardous duty payments
8383 semi-annually, quarterly, or monthly as they agree
8484 circumstances warrant, but may not make payments less often
8585 than once per year.
8686 (3) The commission shall not take this act into
8787 consideration when considering salary increases for sheriff's
8888 office employees based on surveys, studies, or any other means
8989 when it comes to other county employees receiving salary
9090 increases.
9191 (4) The commission shall not take this act into
9292 consideration when it comes to the annual budgetary funds
9393 issued to the sheriff's office for funds used for the everyday
9494 functioning of the sheriff's office.
9595 Section 2. Section 1 shall become operative only if

125125 Section 2. Section 1 shall become operative only if
126126 approved by a majority of the qualified electors of Barbour
127127 County who vote in an election to be held on the day
128128 designated by the Judge of Probate of Barbour County. The
129129 notice of the election shall be given by the judge of probate,
130130 and the election shall be held, conducted, and the results
131131 canvassed in the same manner as other county elections. The
132132 election shall be held in conjunction with the next regularly
133133 scheduled election to be held in the county. The question
134134 shall be, "Do you favor the adoption of Act No. ____, of the
135135 2025 Regular Session of the Alabama Legislature, to provide
136136 hazardous duty pay to the nonclerical employees of the Barbour
137137 County Sheriff's Office, excluding the sheriff, by issuing a
138138 new court cost in Barbour County of no more than twenty-five
139139 dollars ($25)? Yes( ) No( )." The county shall pay any costs
140140 and expenses not otherwise reimbursed by a governmental agency
141141 which are incidental to the election. If a majority of the
142142 votes cast in the election are "Yes," Section 1 shall become
143143 operative immediately. If the majority of the votes are "No,"
144144 this act shall be repealed and shall have no further effect.
145145 The Judge of Probate of Barbour County shall certify the
146146 results of the election to the Secretary of State.
147147 Section 3. This act shall become effective on June 1,
148148 2025.
