17	17	SYNOPSIS:
18	18	Under existing law, the Commissioner of
19	19	Conservation and Natural Resources is authorized to
20	20	issue a game breeder license to certain persons to
21	21	engage in the business of raising protected game
22	22	animals and game birds, including certain cervids.
23	23	This bill would prohibit state agencies from
24	24	killing, testing, and prohibiting the transfer of these
25	25	deer due to disease except under certain circumstances.
26	26	This bill would establish that deer possessed by
27	27	a licensee are the personal property of that licensee.
28	28	This bill would also make nonsubstantive,
29	29	technical revisions to update the existing code
30	30	language to current style.

33	33	AN ACT
34	34	Relating to game breeder licensees; to amend Section
35	35	9-11-30, Code of Alabama 1975, to prohibit state agencies from
36	36	killing, testing, and prohibiting the transfer of cervids due
37	37	to disease, subject to exceptions; to provide that cervids
38	38	possessed by a licensee are the personal property of that

69	69	licensee; and to make nonsubstantive, technical revisions to
70	70	update the existing code language to current style.
71	71	BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
72	72	Section 1. Section 9-11-30, Code of Alabama 1975, is
73	73	amended to read as follows:
74	74	"§9-11-30
75	75	(a) For the purposes of this section, Section 9-11-31,
76	76	and Section 9-11-31.1, the term "protected game animals and
77	77	game birds" means any following terms have the following
78	78	meanings:
79	79	(1) CERVID. Any member of the family Cervidae possessed
80	80	by or under the care of a licensed game breeder pursuant to
81	81	this section, Section 9-11-31, and Section 9-11-31.1.
82	82	(2) PROTECTED GAME ANIMALS AND GAME BIRDS. Any species
83	83	of bird or animal designated by the Commissioner of
84	84	Conservation and Natural Resources by regulation rule pursuant
85	85	to Section 9-2-7, species of the family Cervidae documented by
86	86	the department to exist in the wild in this state prior to May
87	87	1, 2006, which are whitetail deer, elk, and fallow deer, or
88	88	species of nonindigenous animals lawfully brought into this
89	89	state prior to May 1, 2006, and their offspring.
90	90	(b)(1) Pursuant to the requirements and restrictions of
91	91	subdivisions (2) and (3), the Commissioner of Conservation and
92	92	Natural Resources shall issue an annual game breeder's breeder
93	93	license to any properly accredited person , firm, corporation,
94	94	or association authorizing a game breeder to engage in the
95	95	business of raising protected game birds, game animals, or
96	96	fur-bearing animals, for propagating propagation purposes in

126	126	fur-bearing animals, for propagating propagation purposes in
127	127	this state.
128	128	(2) Before a license is issued, the Commissioner of
129	129	Conservation and Natural Resources shall make or cause to be
130	130	made a thorough investigation and to determine the
131	131	qualifications, responsibility, and equipment of the applicant
132	132	for entering upon the business of breeding, raising, and
133	133	handling of game birds and game or fur-bearing animals.
134	134	(3) No license shall be issued or renewed for any
135	135	person, firm, corporation, or association or any principal
136	136	officer or partner in a firm, corporation, or association
137	137	which thereof that is convicted of violating subsection (c) of
138	138	Section 9-2-13(c) after May 1, 2006, or for the premises of
139	139	any person, firm, corporation, or association whose license
140	140	privileges are revoked after May 1, 2006.
141	141	(4) A game breeder's breeder license shall expire on
142	142	September 30 of the year in which issued, unless renewed,
143	143	except that any license issued pursuant to this section
144	144	between May 1, 2006, and September 30, 2006, shall expire on
145	145	September 30, 2006.
146	146	(5) The commissioner shall promulgate adopt rules for
147	147	engaging in the business of breeding, raising, producing, and
148	148	handling of protected game birds and game animals or
149	149	fur-bearing animals or their eggs, embryos, or semen.
150	150	(c)(1) The fees for issuance of licenses pursuant to
151	151	this section shall be two hundred fifty dollars ($250) for all
152	152	species, except members of the family Cervidae.
153	153	(2) The license fee for breeding members of the family
154	154	Cervidae shall be two hundred fifty dollars ($250) for the

184	184	Cervidae shall be two hundred fifty dollars ($250) for the
185	185	first 50 animals, five hundred dollars ($500) for 51 to 100
186	186	animals, and one thousand dollars ($1,000) for any number of
187	187	animals in excess of more than 100 animals.
188	188	(3) License fees under this section shall be based on
189	189	the number of animals on hand as of the immediately preceding
190	190	April 1 of each year.
191	191	(d) The department and any other agency of this state
192	192	may not do any of the following unless: (i) the specific
193	193	disease has been detected in another cervid possessed by or
194	194	under the care of the licensee; or (ii) the cervid has been
195	195	transferred to the licensee from another licensee and is
196	196	epidemiologically linked to a diseased cervid possessed by or
197	197	under the care of the transferring licensee:
198	198	(1) Require the killing of a cervid due to a disease.
199	199	(2) Require the antemortem disease testing of a cervid.
200	200	(3) Prohibit or restrict the transfer of a cervid from
201	201	the premises of a licensee to another person due to disease.
202	202	(e) All cervids possessed by or under the care of a
203	203	licensee on October 1, 2025, and their offspring, are the
204	204	personal property of the licensee and are not the property of
205	205	this state."
206	206	Section 2. This act shall become effective immediately.
