1717 AN ACT
1818 Relating to Jackson County; to authorize the sheriff to
1919 establish procedures for using a credit card or debit card to
2020 make purchases pursuant to procedures provided for in this
2121 act.
2222 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
2323 Section 1. (a) For purposes of this section, the
2424 following terms have the following meanings:
2525 (1) CREDIT CARD. A line of credit issued by a domestic
2626 lender or credit card bank.
2727 (2) DEBIT CARD. A card issued by a bank in relation to
2828 a checking or savings account authorized by law to be expended
2929 at the discretion of the Jackson County Sheriff's Office.
3030 (b) To provide for convenience in making purchases of
3131 tangible personal property or services approved by the
3232 sheriff, the Sheriff of Jackson County may establish
3333 procedures to make certain purchases through the use of a
3434 credit card or debit card issued to the sheriff's office.
3535 (c) The sheriff shall adopt written policies and
3636 procedures governing the use of a credit card or debit card,
3737 which, at a minimum, shall include each of the following:

6767 which, at a minimum, shall include each of the following:
6868 (1) A monetary limit on the amount of any individual
6969 purchase which may be made with a credit card or debit card.
7070 (2) A monetary limit on the total monthly amount that
7171 may be purchased with a credit card or debit card taking into
7272 consideration the monetary limit of the discretionary fund
7373 used.
7474 (3) Procedures to ensure that the sheriff, or his or
7575 her designee, has sole access to any credit card or debit
7676 card, credit card or debit card numbers, access codes, or
7777 security codes.
7878 (4) Procedures to keep accurate records of all
7979 purchases made with a credit card or debit card which shall be
8080 periodically reviewed during required audits.
8181 (5) Procedures to ensure that all credit card or debit
8282 card bills are carefully reviewed by the sheriff each month to
8383 ensure that no unauthorized charges appear on the bill.
8484 (6) Procedures to ensure that all credit card or debit
8585 card bills are paid in full on a timely basis each month to
8686 avoid service charges, late fees, or interest payments.
8787 (d) The sheriff shall select a credit card or debit
8888 card provider or providers taking into consideration each of
8989 the following:
9090 (1) Whether the credit card or debit card issuer
9191 requires an annual fee for using the card.
9292 (2) Whether the credit card or debit card issuer offers
9393 rewards or rebates based upon purchases made using the
9494 account.
9595 (3) The interest rates, service charges, finance

125125 (3) The interest rates, service charges, finance
126126 charges, or late fees that will be assessed if a bill from the
127127 credit card or debit card issuer is paid late or the balance
128128 is not paid in full.
129129 (4) Whether penalties or fees will be assessed against
130130 the sheriff if the sheriff decides to terminate the credit
131131 card or debit card.
132132 (5) Any other consideration deemed relevant by the
133133 sheriff.
134134 (e) If a credit card or debit card provides rewards or
135135 rebates based upon the use of the card, any rewards or rebates
136136 earned from the card or cards shall be deposited in the
137137 discretionary account of the sheriff's office.
138138 (f) The sole purpose of this section is to provide the
139139 sheriff a more efficient method of making payment for
140140 authorized purchases of tangible property or services. Nothing
141141 in this section shall authorize the sheriff to expend funds in
142142 excess of those otherwise validly appropriated by law nor
143143 shall anything in this section authorize the sheriff to
144144 establish a debt of the Jackson County Commission.
145145 Section 2. This act shall become effective on June 1,
146146 2025.
