1515 SYNOPSIS:
1616 Under existing law, the Alabama Athlete Agents
1717 Commission is composed of the Secretary of State and 18
1818 other members.
1919 This bill would authorize the Secretary of State
2020 to designate an individual to serve in his her place on
2121 the commission.
2222 This bill would also make nonsubstantive,
2323 technical revisions to update the existing code
2424 language to current style.

2828 Relating to the Alabama Athlete Agents Commission; to

6565 Section 1. Section 8-26B-30, Code of Alabama 1975, is

6868 (a) The Alabama Athlete Agents Commission is continued
6969 in existence. The commission shall consist of the Secretary of
7070 State or an individual designated by the Secretary of State
7171 and 18 members to be appointed as follows:
7272 (1) One member appointed by the Governor.
7373 (2) One member appointed by the Lieutenant Governor.
7474 (3) One member appointed by the Speaker of the House of
7575 Representatives.
7676 (4) The athletic director or an individual appointed by
7777 the athletic director at each of the following institutions of
7878 higher education:
7979 a. Auburn University.
8080 b. University of Alabama, Tuscaloosa.
8181 c. University of South Alabama.
8282 d. Alabama State University.
8383 e. Alabama A & M University.
8484 f. Tuskegee University.
8585 g. Troy University.
8686 h. Jacksonville State University.
8787 i. University of North Alabama.

123123 (5) One member appointed by the Alabama High School
124124 Athletic Association.
125125 (b) In appointing members to the board, the appointing
126126 power shall select those persons individuals whose
127127 appointments, to the extent possible, ensure that the
128128 membership of the board is inclusive and reflects the racial,
129129 gender, urban/rural urban, rural, and economic diversity of
130130 the state. All appointed members of the commission shall be
131131 citizens of the United States and residents of Alabama. The
132132 term of each appointed commission member shall be three years
133133 and members are eligible for reappointment. If a vacancy
134134 occurs, the appointing power for the vacant position shall
135135 appoint a successor who shall take office immediately and
136136 serve the remainder of the unexpired term. Members of the
137137 Alabama Athlete Agents Commission serving on October 1, 2016,
138138 shall continue to serve on the Alabama Athlete Agents
139139 Commission until their term expires.
140140 (c) Within 15 days after their appointment, the members
141141 of the commission shall take an oath before any person
142142 individual lawfully authorized to administer oaths in this
143143 state to faithfully and impartially perform their duties as
144144 members of the commission, and the same shall be filed with
145145 the Secretary of State.
146146 (d) The Governor may remove from the commission any
147147 appointed member for neglect of duty or other just cause.
148148 (e) The commission shall elect annually a chair, a vice
149149 chair, and a secretary-treasurer from its members.
150150 (f) A majority of the commission shall constitute a
151151 quorum for the transaction of business.

181181 quorum for the transaction of business.
182182 (g) The Secretary of State shall keep records of the
183183 proceedings of the commission; and, in any proceeding in
184184 court, civil or criminal, arising out of or founded upon any
185185 provision of this chapter, copies of those records certified
186186 as correct by the Secretary of State shall be admissible in
187187 evidence as tending to prove the content of the records.
188188 (h) The Secretary of State shall have printed and
189189 published for distribution an annual register which shall
190190 contain the names, arranged alphabetically, of all persons
191191 registered under this chapter. The Secretary of State shall
192192 also provide a quarterly report to the commission of all
193193 agents registered during the quarter, any suspension or
194194 revocation of registered agents during the quarter, and other
195195 disciplinary action taken against an agent.
196196 (i) The Secretary of State may employ personnel and
197197 arrange for assistance, service, and supplies as the Secretary
198198 of State may require for the performance of the duties of the
199199 commission.
200200 (j) The commission may promulgate adopt and, from time
201201 to time, amend rules and standards of conduct for athlete
202202 agents appropriate for the protection of the residents of the
203203 state. At least 35 days prior to the completion of notice of
204204 any rule or amendment, the Secretary of State shall mail
205205 copies of the proposed rule or amendment to all persons
206206 registered under this chapter, with a notice advising them of
207207 the completion of notice of the rule or amendment and
208208 requesting that they submit advisory comments thereon at least
209209 15 days prior to the completion of notice. Failure to receive

239239 15 days prior to the completion of notice. Failure to receive
240240 by mail a rule, amendment, or notice by all persons registered
241241 under this chapter shall not affect the validity of the rule
242242 or amendment.
243243 (k) Except for the Secretary of State, each member of
244244 the commission, who is not otherwise reimbursed by public
245245 funds for services provided to this commission , shall be paid
246246 fifty dollars ($50) for each day the member is actively
247247 engaged in the discharge of official duties as a member of the
248248 commission, and shall also be entitled to, and shall receive,
249249 reimbursement for actual necessary expenses incurred in the
250250 discharge of official duties on behalf of the commission.
251251 (l) The Alabama Athlete Agents Commission shall be
252252 subject to the Alabama Sunset Law, Chapter 20, Title 41, as an
253253 enumerated agency as provided in Section 41-20-3, and shall
254254 have a termination date of October 1, 2019, and every four
255255 years thereafter, unless continued pursuant to the Alabama
256256 Sunset Law."
257257 Section 2. This act shall become effective on June 1,
258258 2025.
