16	16	Under existing law, the Alabama Athlete Agents
17	17	Commission is composed of the Secretary of State and 18
18	18	other members.
19	19	This bill would authorize the Secretary of State
20	20	to designate an individual to serve in his her place on
21	21	the commission.
22	22	This bill would also make nonsubstantive,
23	23	technical revisions to update the existing code
24	24	language to current style.

27	27	AN ACT
28	28	Relating to the Alabama Athlete Agents Commission; to
29	29	amend Section 8-26B-30, Code of Alabama 1975, to authorize the
30	30	Secretary of State to designate an individual to serve in his
31	31	or her place on the commission; and to make nonsubstantive,
32	32	technical revisions to update the existing code language to
33	33	current style.
34	34	BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:

67	67	"§8-26B-30
68	68	(a) The Alabama Athlete Agents Commission is continued
69	69	in existence. The commission shall consist of the Secretary of
70	70	State or an individual designated by the Secretary of State
71	71	and 18 members to be appointed as follows:
72	72	(1) One member appointed by the Governor.
73	73	(2) One member appointed by the Lieutenant Governor.
74	74	(3) One member appointed by the Speaker of the House of
75	75	Representatives.
76	76	(4) The athletic director or an individual appointed by
77	77	the athletic director at each of the following institutions of
78	78	higher education:
79	79	a. Auburn University.
80	80	b. University of Alabama, Tuscaloosa.
81	81	c. University of South Alabama.
82	82	d. Alabama State University.
83	83	e. Alabama A & M University.
84	84	f. Tuskegee University.
85	85	g. Troy University.
86	86	h. Jacksonville State University.
87	87	i. University of North Alabama.
88	88	j. University of West Alabama.
89	89	k. Miles College.
90	90	l. University of Montevallo.
91	91	m. University of Alabama, Huntsville.

123	123	(5) One member appointed by the Alabama High School
124	124	Athletic Association.
125	125	(b) In appointing members to the board, the appointing
126	126	power shall select those persons individuals whose
127	127	appointments, to the extent possible, ensure that the
128	128	membership of the board is inclusive and reflects the racial,
129	129	gender, urban/rural urban, rural, and economic diversity of
130	130	the state. All appointed members of the commission shall be
131	131	citizens of the United States and residents of Alabama. The
132	132	term of each appointed commission member shall be three years
133	133	and members are eligible for reappointment. If a vacancy
134	134	occurs, the appointing power for the vacant position shall
135	135	appoint a successor who shall take office immediately and
136	136	serve the remainder of the unexpired term. Members of the
137	137	Alabama Athlete Agents Commission serving on October 1, 2016,
138	138	shall continue to serve on the Alabama Athlete Agents
139	139	Commission until their term expires.
140	140	(c) Within 15 days after their appointment, the members
141	141	of the commission shall take an oath before any person
142	142	individual lawfully authorized to administer oaths in this
143	143	state to faithfully and impartially perform their duties as
144	144	members of the commission, and the same shall be filed with
145	145	the Secretary of State.
146	146	(d) The Governor may remove from the commission any
147	147	appointed member for neglect of duty or other just cause.
148	148	(e) The commission shall elect annually a chair, a vice
149	149	chair, and a secretary-treasurer from its members.
150	150	(f) A majority of the commission shall constitute a
151	151	quorum for the transaction of business.

181	181	quorum for the transaction of business.
182	182	(g) The Secretary of State shall keep records of the
183	183	proceedings of the commission; and, in any proceeding in
184	184	court, civil or criminal, arising out of or founded upon any
185	185	provision of this chapter, copies of those records certified
186	186	as correct by the Secretary of State shall be admissible in
187	187	evidence as tending to prove the content of the records.
188	188	(h) The Secretary of State shall have printed and
189	189	published for distribution an annual register which shall
190	190	contain the names, arranged alphabetically, of all persons
191	191	registered under this chapter. The Secretary of State shall
192	192	also provide a quarterly report to the commission of all
193	193	agents registered during the quarter, any suspension or
194	194	revocation of registered agents during the quarter, and other
195	195	disciplinary action taken against an agent.
196	196	(i) The Secretary of State may employ personnel and
197	197	arrange for assistance, service, and supplies as the Secretary
198	198	of State may require for the performance of the duties of the
199	199	commission.
200	200	(j) The commission may promulgate adopt and, from time
201	201	to time, amend rules and standards of conduct for athlete
202	202	agents appropriate for the protection of the residents of the
203	203	state. At least 35 days prior to the completion of notice of
204	204	any rule or amendment, the Secretary of State shall mail
205	205	copies of the proposed rule or amendment to all persons
206	206	registered under this chapter, with a notice advising them of
207	207	the completion of notice of the rule or amendment and
208	208	requesting that they submit advisory comments thereon at least
209	209	15 days prior to the completion of notice. Failure to receive

239	239	15 days prior to the completion of notice. Failure to receive
240	240	by mail a rule, amendment, or notice by all persons registered
241	241	under this chapter shall not affect the validity of the rule
242	242	or amendment.
243	243	(k) Except for the Secretary of State, each member of
244	244	the commission, who is not otherwise reimbursed by public
245	245	funds for services provided to this commission , shall be paid
246	246	fifty dollars ($50) for each day the member is actively
247	247	engaged in the discharge of official duties as a member of the
248	248	commission, and shall also be entitled to, and shall receive,
249	249	reimbursement for actual necessary expenses incurred in the
250	250	discharge of official duties on behalf of the commission.
251	251	(l) The Alabama Athlete Agents Commission shall be
252	252	subject to the Alabama Sunset Law, Chapter 20, Title 41, as an
253	253	enumerated agency as provided in Section 41-20-3, and shall
254	254	have a termination date of October 1, 2019, and every four
255	255	years thereafter, unless continued pursuant to the Alabama
256	256	Sunset Law."
257	257	Section 2. This act shall become effective on June 1,
258	258	2025.
