1515 SYNOPSIS:
1616 This bill would authorize any Class 2 municipality
1717 to establish a delegation agreement with the Alabama
1818 Department of Environmental Management for the local
1919 enforcement of the Alabama Scrap Tire Environmental
2020 Quality Act.
2121 This bill would also provide for jurisdiction of
2222 violations in the municipal court of the Class 2
2323 municipality and for criminal penalties.

2626 AN ACT
2727 Relating to Class 2 municipalities; to amend Section
2828 22-40A-12 of the Code of Alabama 1975, relating to the Alabama
2929 Scrap Tire Environmental Quality Act, to authorize the
3030 governing body of a Class 2 municipality to establish a
3131 delegation agreement with the Alabama Department of
3232 Environmental Management to enforce the act; to authorize
3333 enforcement in a Class 2 municipality in municipal court; and
3434 to provide for criminal penalties of certain violations.

6565 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
6666 Section 1. Section 22-40A-12 of the Code of Alabama
6767 1975, is amended to read as follows:
6868 "ยง22-40A-12
6969 (a) County commissions and the governing body of any
7070 Class 2 municipality may request primacy on enforcement and
7171 establish delegation agreements with the department for
7272 enforcement of this chapter. The department shall establish by
7373 regulation rule the procedures for delegation. Counties A
7474 county or a Class 2 municipality that wish to voluntarily
7575 establish such establishes a delegation agreements agreement
7676 with the department for local enforcement shall have all of
7777 the following responsibilities:
7878 (1) Provide quarterly reports to the department on all
7979 scrap tire activities within that quarter on a form prepared
8080 and provided by the department.
8181 (2) Provide a written investigation reports report to
8282 the department within 10 days of the an initial investigation.
8383 (3) Investigate all reports and complaints regarding
8484 scrap tires within the respective county or Class 2
8585 municipality.
8686 (4) Investigate illegal dumping of scrap tires.
8787 (5) Review manifests of scrap tires at businesses
8888 (b) Notwithstanding any other provision of law, in a
8989 Class 2 municipality, the municipal court shall have
9090 jurisdiction over violations of this chapter.
9191 (c) In any Class 2 municipality, in lieu of the
9292 penalties provide in Section 22-40A-19, the following
9393 penalties shall apply:

123123 penalties shall apply:
124124 (1) A person who accumulates scrap tires in violation
125125 of this chapter as provided in Section 22-40A-19(a)(1), upon
126126 conviction, shall be guilty of a Class C misdemeanor.
127127 (2) A person who processes scrap tires in violation of
128128 this chapter as provided in Section 22-40A-19(a)(2), upon
129129 conviction, shall be guilty of a Class B misdemeanor.
130130 (3) A person who transports scrap tires in violation of
131131 this chapter as provided in Section 22-40A-19(a)(3), upon
132132 conviction, shall be guilty of a Class A misdemeanor. "
133133 Section 2. This act shall become effective June 1,
