17+AN ACT
1618 Relating to crimes and offenses; to amend Section
1719 13A-7-4.3, Code of Alabama 1975, as last amended by Act
1820 2024-395, 2024 Regular Session, and Sections 13A-7-25 and
1921 13A-7-26, Code of Alabama 1975, to further provide for the
2022 definition of "critical infrastructure facility;" to further
2123 provide for the crime of unauthorized entry of a critical
2224 infrastructure facility; and to further provide for the crimes
2325 of criminal tampering in the first and second degrees.
2426 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
2527 Section 1. Section 13A-7-4.3, Code of Alabama 1975, as
2628 last amended by Act 2024-395, 2024 Regular Session, and
2729 Sections 13A-7-25 and 13A-7-26, Code of Alabama 1975, are
2830 amended to read as follows:
2931 "§13A-7-4.3
3032 (a) For the purposes of this section, the following
3133 wordsterms have the following meanings:
3234 (1) CRITICAL INFRASTRUCTURE. A system or asset, whether
3335 physical or virtual, so vital to the United States that the
3436 incapacity or destruction of the system or asset would have a
3537 debilitating impact on security, national economic security,
36-national public health, or national public safety.
37-(2) CRITICAL INFRASTRUCTURE FACILITY. The term
38-includes, but is not limited to, any of the following,
39-including any critical infrastructure located on or in any of
40-the following types of facilities:

69+(2) CRITICAL INFRASTRUCTURE FACILITY. The term
70+includes, but is not limited to, any of the following,
71+including any critical infrastructure located on or in any of
7072 the following types of facilities:
7173 a. A chemical, polymer, or rubber manufacturing
7274 facility.
7375 b. A pipeline.
7476 c. A refinery.
7577 d. An electrical power generating facility.
7678 e. The area surrounding an electrical power generating
7779 facility.
7880 f. An electrical transmission tower.
7981 g. An electrical substation or distribution substation.
8082 h. An electric utility control center.
8183 i. Electrical communication equipment.
8284 j. An electrical switching station.
8385 k. Electric power lines, power storage equipment, or
8486 other utility equipment.
8587 l. Any portion of a public water system or public
8688 wastewater treatment system.
8789 m. A natural gas transmission compressor station.
8890 n. A liquefied natural gas (LNG) terminal or storage
8991 facility.
9092 o. A natural gas distribution facility, including, but
9193 not limited to, a pipeline interconnection, a city gate or
9294 town border station, a metering station, aboveground piping, a
9395 regular station, or a natural gas or hydrocarbon storage or
94-production facility.
95-p. A mining operation.
96-q. Beneficiation infrastructure or mining
97-infrastructure.
98-r. A transportation facility such as a port, airport,

127+p. A mining operation.
128+q. Beneficiation infrastructure or mining
129+infrastructure.
128130 r. A transportation facility such as a port, airport,
129131 railroad operating facility, or trucking terminal.
130132 s. Wireline or wireless communications
131133 infrastructureCommunications service infrastructure or
132134 facilities, as defined under Section 37-17-1 .
133135 t. A gas processing plant, including a plant used in
134136 the processing, treatment, or fractionation of natural gas or
135137 natural gas liquids.
136138 u. A steelmaking facility that uses an electric arc
137139 furnace.
138140 v. A dam that is regulated by the state or federal
139141 government.
140142 w. A crude oil or refined products storage or
141143 distribution facility, including, but not limited to, a valve
142144 site, a pipeline interconnection, a pump station, a metering
143145 station, below ground piping, above ground piping, or a truck
144146 loading or offloading facility.
145147 x. A defense contractor facility.
146148 y. A pulp and paper manufacturing facility.
147149 (3) FRAUDULENT DOCUMENTS FOR IDENTIFICATION PURPOSES. A
148150 document that is presented as being a bona fide document that
149151 provides personal identification information but which, in
150152 fact, is false, forged, altered, or counterfeit.
151153 (4) PERSON. An individual, trust, estate, corporation,
152-partnership, limited partnership, limited liability
153-partnership, limited liability company, or unincorporated
154-nonprofit association having a separate legal existence under
155-state law.
156-(5) UNMANNED AIRCRAFT SYSTEM. A powered, aerial vehicle

183+(4) PERSON. An individual, trust, estate, corporation,
184+partnership, limited partnership, limited liability
185+partnership, limited liability company, or unincorporated
186+nonprofit association having a separate legal existence under
187+state law.
186188 (5) UNMANNED AIRCRAFT SYSTEM. A powered, aerial vehicle
187189 that does not carry a human operator, uses aerodynamic forces
188190 to provide vehicle lift, may fly autonomously through an
189191 onboard computer or be piloted remotely, and may be expendable
190192 or recoverable. The term does not include a satellite orbiting
191193 the Earth or a spacecraft beyond Earth's atmosphere and may
192194 not be construed to implicate the provider of a
193195 telecommunications link between an owner or operator of an
194196 unmanned aircraft system and the unmanned aircraft system.
195197 (b) A person commits the crime of unauthorized entry of
196198 a critical infrastructure facility if the person does any of
197199 the following:
198200 (1) Intentionally enters without authority into any
199201 structure or onto any premises belonging to another that
200202 constitutes in whole or in part a critical infrastructure
201203 facility that is completely enclosed by any type of physical
202204 barrier or clearly marked with a sign or signs that are posted
203205 in a conspicuous manner and indicate that unauthorized entry
204206 is forbidden.
205207 (2) Uses or attempts to use a fraudulent document for
206208 identification for the purpose of entering a critical
207209 infrastructure facility.
208210 (3) Remains on the premises of a critical
209211 infrastructure facility after having been forbidden to do so,
210-either orally or in writing, by any owner, lessee, or
211-custodian of the property or by any other authorized person.
212-(4) Intentionally enters into a restricted area of a
213-critical infrastructure facility whichthat is marked as a
214-restricted or limited access area ,or that is completely

241+infrastructure facility after having been forbidden to do so,
242+either orally or in writing, by any owner, lessee, or
243+custodian of the property or by any other authorized person.
244+(4) Intentionally enters into a restricted area of a
245+critical infrastructure facility whichthat is marked as a
244246 restricted or limited access area ,or that is completely
245247 enclosed by any type of physical barrier , when the person is
246248 not authorized to enter the restricted or limited access area.
247249 (c) A person who commits the crime of unauthorized
248250 entry of a critical infrastructure facility is guilty of a
249251 Class A misdemeanor.
250252 (d) If, during the commission of the crime of
251253 unauthorized entry of a critical infrastructure facility, the
252254 a person intentionally, recklessly, or with criminal
253255 negligence injures, removes, destroys, or breaks critical
254256 infrastructure property, or otherwise interrupts or interferes
255257 with the operations of a critical infrastructure asset, the
256258 person is guilty of a Class C felony.
257259 (e) A person who commits the crime of unauthorized
258260 entry of a critical infrastructure facility while possessing
259261 or operating an unmanned aircraft system with an attached
260262 weapon, firearm, explosive, destructive device, or ammunition
261263 is guilty of a Class C felony.
262264 (f) Nothing in this section shall be construed to
263265 prevent lawful assembly and peaceful and orderly petition for
264266 the redress of grievances, including, but not limited to, any
265267 labor dispute between any employer and its employee.
266268 (g) Nothing in this section shall be construed to
267269 prohibit the state, a county, or a municipality from taking
268-any lawful action on their respective rights-of-way.
269-(h) Nothing in subsection (b) or (d) shall apply to any
270-act committed by a person within the scope of his or her
271-employment. For purposes of this subsection, the scope of a
272-person's employment shall include the performance of actions

299+prohibit the state, a county, or a municipality from taking

301+(h) Nothing in subsection (b) or (d) shall apply to any
302+act committed by a person within the scope of his or her
303+employment. For purposes of this subsection, the scope of a
302304 person's employment shall include the performance of actions
303305 that are necessary for the performance of a lawful work
304306 assignment."
305307 "§13A-7-25
306308 (a) A person commits the crime of criminal tampering in
307309 the first degree if the person does any of the following:
308310 (1) Having no right to do so or any reasonable ground
309311 to believe that he or she has such a right, intentionally or
310312 recklessly causes substantial interruption or impairment of a
311313 service rendered to the public by a utility.
312314 (2) Threatens an individual with a deadly weapon or
313315 dangerous instrument with the intent to obstruct the operation
314316 of a utility. This subdivision only applies if the individual
315317 is working under the procedures and within the scope of his or
316318 her duties as an employee of the utility and has properly
317319 identified himself or herself when asked by stating his or her
318320 name, employer, and purpose of work.
319321 (b) Criminal tampering in the first degree is a Class C
320322 felony.
321323 (c) Nothing in this section shall be construed to
322324 prohibit the state, a county, or a municipality from taking
323325 any lawful action on its respective rights-of-way. "

325327 (a) A person commits the crime of criminal tampering in
326-the second degree if, having no right to do so or any
327-reasonable ground to believe that he or she has such a right,
328-hethe person:
329-(1) Intentionally or recklessly tampers with property
330-of another for the purpose of causing substantial

357+(a) A person commits the crime of criminal tampering in
358+the second degree if, having no right to do so or any
359+reasonable ground to believe that he or she has such a right,
360+hethe person:
361+(1) Intentionally or recklessly tampers with property
360362 of another for the purpose of causing substantial
361363 inconvenience to that person or to another; or
362364 (2) Intentionally or recklessly tampers or makes
363365 connection with property of a utility.
364366 (b) Criminal tampering in the second degree is a Class
365367 B misdemeanor.
366368 (c) Nothing in this section shall be construed to
367369 prohibit the state, a county, or a municipality from taking
368370 any lawful action on its respective rights-of-way. "
369371 Section 2. This act shall become effective on October
370372 1, 2025.
