1717 SYNOPSIS:
1818 Under existing law, the Department of
1919 Conservation and Natural Resources is authorized to
2020 issue certain hunting, fishing, and related licenses.
2121 This bill would prohibit individuals from using
2222 any license issued by the Department of Conservation
2323 and Natural Resources as a valid or supplemental form
2424 of government issued identification.

2828 Relating to conservation and natural resources; to
2929 amend Sections 9-11-32 and 16-64-3, Code of Alabama 1975; to
3030 further provide for the scope of certain licenses; and to
3131 repeal Section 9-11-33, Code of Alabama 1975, relating to
3232 hunting and fishing licenses.
3333 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
3434 Section 1. Sections 9-11-32 and 16-64-3, Code of
3535 Alabama 1975, are amended to read as follows:

3737 (a) Unless specifically provided otherwise by law, all

6868 annual wildlife heritage, hunting, and fishing licenses issued
6969 pursuant to this chapter shall be dated when issued and shall
7070 authorize the person individual named on the license to
7171 participate in the licensed activities from September 1 or the
7272 date of issuance to the next August 31, and then only within
7373 the regulations rules and restrictions provided by law.
7474 (b)(1) An individual may not use any license issued by
7575 the Department of Conservation and Natural Resources as a
7676 valid or supplemental form of government issued identification
7777 for any purpose other than participation in the licensed
7878 activities authorized by the department.
7979 (2) The department may adopt rules to implement this
8080 subsection."
8181 "§16-64-3
8282 (a) An individual claiming to be a resident for
8383 purposes of this chapter shall certify by a signed statement
8484 each of the following:
8585 (1) A specific address or location within the State of
8686 Alabama as his or her residence.
8787 (2) An intention to remain at this address
8888 indefinitely.
8989 (3) Possession of more substantial connections with the
9090 State of Alabama than with any other state.
9191 (b) Though certification of an address and an intent to
9292 remain in the state indefinitely shall be prerequisites to
9393 establishing status as a resident, ultimate determination of
9494 that status shall be made by the institution by evaluating the
9595 presence or absence of connections with the State of Alabama.
9696 This evaluation shall include the consideration of all of the

126126 This evaluation shall include the consideration of all of the
127127 following connections.
128128 (1) Consideration of the location of high school
129129 graduation.
130130 (2) Payment of Alabama state income taxes as a
131131 resident.
132132 (3) Ownership of a residence or other real property in
133133 the state and payment of state ad valorem taxes on the
134134 residence or property.
135135 (4) Full-time employment in the state.
136136 (5) Residence in the state of a spouse, parents, or
137137 children.
138138 (6) Previous periods of residency in the state
139139 continuing for one year or more.
140140 (7) Voter registration and voting in the state; more
141141 significantly, continuing voter registration in the state that
142142 initially occurred at least one year prior to the initial
143143 registration of the student in Alabama at a public institution
144144 of higher education.
145145 (8) Possession of state or local licenses to do
146146 business or practice a profession in the state.
147147 (9) Ownership of personal property in the state,
148148 payment of state taxes on the property, and possession of
149149 state license plates.
150150 (10) Continuous physical presence in the state for a
151151 purpose other than attending school, except for temporary
152152 absences for travel, military service, and temporary
153153 employment.
154154 (11) Membership in religious, professional, business,

186186 (12) Maintenance in the state of checking and savings
187187 accounts, safe deposit boxes, or investment accounts.
188188 (13) In-state address shown on selective service
189189 registration, driver's driver license, automobile title
190190 registration, hunting and fishing licenses, insurance
191191 policies, stock and bond registrations, last will and
192192 testament, annuities, or retirement plans."
193193 Section 2. Section 9-11-33, Code of Alabama 1975,
194194 relating to hunting and fishing licenses, is repealed.
195195 Section 3. This act shall become effective on June 1,
196196 2025.
