17	17	SYNOPSIS:
18	18	Under existing law, the Department of
19	19	Conservation and Natural Resources is authorized to
20	20	issue certain hunting, fishing, and related licenses.
21	21	This bill would prohibit individuals from using
22	22	any license issued by the Department of Conservation
23	23	and Natural Resources as a valid or supplemental form
24	24	of government issued identification.
25	25	A BILL
26	26	TO BE ENTITLED
27	27	AN ACT
28	28	Relating to conservation and natural resources; to
29	29	amend Sections 9-11-32 and 16-64-3, Code of Alabama 1975; to
30	30	further provide for the scope of certain licenses; and to
31	31	repeal Section 9-11-33, Code of Alabama 1975, relating to
32	32	hunting and fishing licenses.
33	33	BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
34	34	Section 1. Sections 9-11-32 and 16-64-3, Code of
35	35	Alabama 1975, are amended to read as follows:
36	36	"§9-11-32
37	37	(a) Unless specifically provided otherwise by law, all
38	38	annual wildlife heritage, hunting, and fishing licenses issued

68	68	annual wildlife heritage, hunting, and fishing licenses issued
69	69	pursuant to this chapter shall be dated when issued and shall
70	70	authorize the person individual named on the license to
71	71	participate in the licensed activities from September 1 or the
72	72	date of issuance to the next August 31, and then only within
73	73	the regulations rules and restrictions provided by law.
74	74	(b)(1) An individual may not use any license issued by
75	75	the Department of Conservation and Natural Resources as a
76	76	valid or supplemental form of government issued identification
77	77	for any purpose other than participation in the licensed
78	78	activities authorized by the department.
79	79	(2) The department may adopt rules to implement this
80	80	subsection."
81	81	"§16-64-3
82	82	(a) An individual claiming to be a resident for
83	83	purposes of this chapter shall certify by a signed statement
84	84	each of the following:
85	85	(1) A specific address or location within the State of
86	86	Alabama as his or her residence.
87	87	(2) An intention to remain at this address
88	88	indefinitely.
89	89	(3) Possession of more substantial connections with the
90	90	State of Alabama than with any other state.
91	91	(b) Though certification of an address and an intent to
92	92	remain in the state indefinitely shall be prerequisites to
93	93	establishing status as a resident, ultimate determination of
94	94	that status shall be made by the institution by evaluating the
95	95	presence or absence of connections with the State of Alabama.
96	96	This evaluation shall include the consideration of all of the

126	126	This evaluation shall include the consideration of all of the
127	127	following connections.
128	128	(1) Consideration of the location of high school
129	129	graduation.
130	130	(2) Payment of Alabama state income taxes as a
131	131	resident.
132	132	(3) Ownership of a residence or other real property in
133	133	the state and payment of state ad valorem taxes on the
134	134	residence or property.
135	135	(4) Full-time employment in the state.
136	136	(5) Residence in the state of a spouse, parents, or
137	137	children.
138	138	(6) Previous periods of residency in the state
139	139	continuing for one year or more.
140	140	(7) Voter registration and voting in the state; more
141	141	significantly, continuing voter registration in the state that
142	142	initially occurred at least one year prior to the initial
143	143	registration of the student in Alabama at a public institution
144	144	of higher education.
145	145	(8) Possession of state or local licenses to do
146	146	business or practice a profession in the state.
147	147	(9) Ownership of personal property in the state,
148	148	payment of state taxes on the property, and possession of
149	149	state license plates.
150	150	(10) Continuous physical presence in the state for a
151	151	purpose other than attending school, except for temporary
152	152	absences for travel, military service, and temporary
153	153	employment.
154	154	(11) Membership in religious, professional, business,

184	184	(11) Membership in religious, professional, business,
185	185	civic, or social organizations in the state.
186	186	(12) Maintenance in the state of checking and savings
187	187	accounts, safe deposit boxes, or investment accounts.
188	188	(13) In-state address shown on selective service
189	189	registration, driver's driver license, automobile title
190	190	registration, hunting and fishing licenses, insurance
191	191	policies, stock and bond registrations, last will and
192	192	testament, annuities, or retirement plans."
193	193	Section 2. Section 9-11-33, Code of Alabama 1975,
194	194	relating to hunting and fishing licenses, is repealed.
195	195	Section 3. This act shall become effective on June 1,
196	196	2025.
