1717 SYNOPSIS:
1818 This bill would require law enforcement agencies
1919 to collect fingerprints and DNA from any illegal alien
2020 in the agency's custody and submit the fingerprints and
2121 DNA for testing or cataloging.
2222 This bill would also further provide for certain
2323 court costs.

2727 Relating to immigration; to amend Section 31-13-3, Code
2828 of Alabama 1975; to further provide definitions; to amend
2929 Section 36-18-32, Code of Alabama 1975; to further provide for
3030 the collection and disbursement of certain fees; and to add
3131 Section 31-13-36 to the Code of Alabama 1975; to require law
3232 enforcement agencies to collect fingerprints and DNA from any
3333 illegal alien in the agency's custody and submit the
3434 fingerprints and DNA for testing or cataloging.
3535 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
3636 Section 1. Sections 31-13-3 and 36-18-32, Code of

6868 "§31-13-3
6969 For the purposes of this chapter, the following words
7070 shall have the following meanings:
7171 (1) ALIEN. Any person who is not a citizen or national
7272 of the United States, as described in 8 U.S.C. § 1101, et
7373 seq., and any amendments thereto.
7474 (2) BUSINESS ENTITY. Any person or group of persons
7575 employing one or more persons performing or engaging in any
7676 activity, enterprise, profession, or occupation for gain,
7777 benefit, advantage, or livelihood, whether for profit or not
7878 for profit. Business entity shall include, but not be limited
7979 to, the following:
8080 a. Self-employed individuals, business entities filing
8181 articles of incorporation, partnerships, limited partnerships,
8282 limited liability companies, foreign corporations, foreign
8383 limited partnerships, foreign limited liability companies
8484 authorized to transact business in this state, business
8585 trusts, and any business entity that registers with the
8686 Secretary of State.
8787 b. Any business entity that possesses a business
8888 license, permit, certificate, approval, registration, charter,
8989 or similar form of authorization issued by the state, any
9090 business entity that is exempt by law from obtaining such a
9191 business license, and any business entity that is operating
9292 unlawfully without a business license.
9393 (3) CONTRACTOR. A person, employer, or business entity
9494 that enters into an agreement to perform any service or work
9595 or to provide a certain product in exchange for valuable
9696 consideration. This definition shall include, but not be

126126 consideration. This definition shall include, but not be
127127 limited to, a general contractor, subcontractor, independent
128128 contractor, contract employee, project manager, or a
129129 recruiting or staffing entity.
130130 (4) EMPLOYEE. Any person directed, allowed, or
131131 permitted to perform labor or service of any kind by an
132132 employer. The employees of an independent contractor working
133133 for a business entity shall not be regarded as the employees
134134 of the business entity , for the purposes of this chapter. This
135135 term does not include any inmate in the legal custody of the
136136 state, a county, or a municipality.
137137 (5) EMPLOYER. Any person, firm, corporation,
138138 partnership, joint stock association, agent, manager,
139139 representative, foreman, or other person having control or
140140 custody of any employment, place of employment, or of any
141141 employee, including any person or entity employing any person
142142 for hire within the State of Alabama, including a public
143143 employer. This term shall not include the occupant of a
144144 household contracting with another person to perform casual
145145 domestic labor within the household.
146146 (6) EMPLOYMENT. The act of employing or state of being
147147 employed, engaged, or hired to perform work or service of any
148148 kind or character within the State of Alabama, including any
149149 job, task, work, labor, personal services, or any other
150150 activity for which compensation is provided, expected, or due,
151151 including, but not limited to, all activities conducted by a
152152 business entity or employer. This term shall not include
153153 casual domestic labor performed in a household on behalf of
154154 the occupant of the household or the relationship between a

185185 contractor and the employees of a subcontractor performing
186186 work for the contractor.
187187 (7) E-VERIFY. The electronic verification of federal
188188 employment authorization program of the Illegal Immigration
189189 Reform and Immigrant Responsibility Act of 1996, P.L. 104-208,
190190 Division C, Section 403(a); 8 U.S.C. § 1324(a), and operated
191191 by the United States Department of Homeland Security, or its
192192 successor program.
193193 (8) FEDERAL WORK AUTHORIZATION PROGRAM. Any of the
194194 electronic verification of work authorization programs
195195 operated by the United States Department of Homeland Security
196196 or an equivalent federal work authorization program operated
197197 by the United States Department of Homeland Security to verify
198198 information of newly hired employees, under the Immigration
199199 Reform and Control Act of 1986 (IRCA), P.L. 99-603 or the
200200 Illegal Immigration Reform and Immigrant Responsibility Act of
201201 1996, P.L. 104-208, Division C, Section 403(a); 8 U.S.C. §
202202 1324(a).
203203 (9) ILLEGAL ALIEN. An alien who is not lawfully present
204204 in the United States under any federal law, regulation, order,
205205 or directive.
206206 (9)(10) KNOWS or KNOWINGLY. A person acts knowingly or
207207 with knowledge with respect to either of the following:
208208 a. The person's conduct or to attendant circumstances
209209 when the person is aware of the nature of the person's conduct
210210 or that those circumstances exist.
211211 b. A result of the person's conduct when the person is
212212 reasonably aware that the person's conduct is likely to cause

242242 reasonably aware that the person's conduct is likely to cause
243243 that result.
244244 (10)(11) LAWFUL PRESENCE or LAWFULLY PRESENT. A person
245245 shall be regarded as an alien unlawfully present in the United
246246 States only if the person's unlawful immigration status has
247247 been verified by the federal government pursuant to 8 U.S.C. §
248248 1373(c). No officer of this state or any political subdivision
249249 of this state shall attempt to independently make a final
250250 determination of an alien's immigration status. An alien
251251 possessing self-identification in any of the following forms
252252 is entitled to the presumption that he or she is an alien
253253 lawfully present in the United States:
254254 a. A valid, unexpired Alabama driver's driver license.
255255 b. A valid, unexpired Alabama nondriver identification
256256 card.
257257 c. A valid tribal enrollment card or other form of
258258 tribal identification bearing a photograph or other biometric
259259 identifier.
260260 d. Any valid United States federal or state government
261261 issued identification document bearing a photograph or other
262262 biometric identifier, including a valid Uniformed Services
263263 Privileges and Identification Card if issued by an entity that
264264 requires proof of lawful presence in the United States before
265265 issuance.
266266 e. A foreign passport with an unexpired United States
267267 Visa and a corresponding stamp or notation by the United
268268 States Department of Homeland Security indicating the bearer's
269269 admission to the United States.
270270 f. A foreign passport issued by a visa waiver country

300300 f. A foreign passport issued by a visa waiver country
301301 with the corresponding entry stamp and unexpired duration of
302302 stay annotation or an I-94W form by the United States
303303 Department of Homeland Security indicating the bearer's
304304 admission to the United States.
305305 (11)(12) POLICY OR PRACTICE. A guiding principle or
306306 rule that may be written or adopted through repeated actions
307307 or customs.
308308 (12)(13) PROTECTIVE SERVICES PROVIDER. A child
309309 protective services worker; adult protective services worker;
310310 protective services provider; or provider of services to
311311 victims of domestic violence, stalking, sexual assault, or
312312 human trafficking that receives federal grants under the
313313 Victim of Crimes Act, the Violence Against Women Act, or the
314314 Family Violence Prevention and Services Act.
315315 (13)(14) PUBLIC EMPLOYER. Every department, agency, or
316316 instrumentality of the state or a political subdivision of the
317317 state including counties and municipalities.
318318 (14)(15) STATE-FUNDED ENTITY. Any governmental entity
319319 of the state or a political subdivision thereof or any other
320320 entity that receives any monies from the state or a political
321321 subdivision thereof; provided, however, an entity that merely
322322 provides a service or a product to any governmental entity of
323323 the state or a political subdivision thereof, and receives
324324 compensation for the same, shall not be considered a
325325 state-funded entity.
326326 (15)(16) SUBCONTRACTOR. A person, business entity, or
327327 employer who is awarded a portion of an existing contract by a
328328 contractor, regardless of its tier.

359359 (16)(17) UNAUTHORIZED ALIEN. An alien who is not
360360 authorized to work in the United States as defined in 8 U.S.C.
361361 § 1324a(h)(3)."
362362 "§36-18-32
363363 (a) There is hereby established a special fund in the
364364 State Treasury to be known as the Alabama DNA Database Fund.
365365 (b) The fund shall be placed under the management or
366366 administration of the Director of the Alabama Department of
367367 Forensic Sciences for the exclusive purposes of implementing
368368 the provisions of this article.
369369 (c) The fund shall consist of all moneys monies
370370 received by the director pursuant to the provisions of this
371371 section.
372372 (d) The director shall have control of those funds as
373373 shall not be inconsistent with the provisions of subject to
374374 this article and with the laws of the State of Alabama.
375375 (e) Monies deposited in the Alabama DNA Database Fund
376376 may be expended by the Director of the Alabama Department of
377377 Forensic Sciences in accordance with the provisions of this
378378 article. The investment of monies in the fund by the State
379379 Treasurer shall remain in the Alabama DNA Database Fund. At
380380 the end of each fiscal year any unexpended or unencumbered
381381 monies shall remain in the fund. However, no funds shall be
382382 withdrawn or expended except as budgeted and allotted
383383 according to law and only in the amounts authorized by the
384384 Legislature in the general appropriation bill or other
385385 appropriation bills.
386386 (f) Neither the director nor any member of the

416416 (f) Neither the director nor any member of the
417417 director's staff nor any employee of the Alabama Department of
418418 Forensic Sciences shall have any financial interest in any
419419 such investments or receive any reward, thing of value, or
420420 commission in respect thereto.
421421 (g) It shall be the duty of the The director to shall
422422 keep detailed permanent records of all expenditures and
423423 disbursements from such the fund or account.
424424 (h) In all municipal, district, and circuit court civil
425425 cases, and upon initiation of attachment, garnishment, or
426426 execution proceedings, a fee in the amount of two dollars ($2)
427427 shall be assessed and collected. In all municipal, district,
428428 and circuit court criminal cases, in bond forfeiture
429429 proceedings, and upon the issuance of any alias or capias
430430 warrant of arrest, a fee in the amount of twelve dollars ($12)
431431 fifteen dollars ($15) shall be assessed and collected. The fee
432432 shall be collected by the court clerk and remitted as follows:
433433 (1) Alabama DNA Database Fund.
434434 a. For fiscal years 2009 and 2010, seven dollars ($7).
435435 b. For fiscal year 2011, eight dollars ($8).
436436 c. For fiscal year years 2012 and thereafterthrough
437437 2025, eleven dollars ($11).
438438 d. For fiscal year 2026 and thereafter, fourteen
439439 dollars ($14).
440440 (2) Citizenship Trust pursuant to Section 16-44A-30,
441441 for the purposes described in Section 36-18-32.1.
442442 a. For fiscal years 2009 and 2010, five dollars ($5).
443443 b. For fiscal year 2011, four dollars ($4).
444444 c. For fiscal year 2012 and thereafter, one dollar

474474 c. For fiscal year 2012 and thereafter, one dollar
475475 ($1).
476476 Provided, however, that there shall be no additional
477477 fees imposed for violations relating to parking tickets or
478478 small claims cases.
479479 (i) The amount of the fees shall be remitted by the
480480 person or authority collecting the same to the director on the
481481 10th day of each month next succeeding that in which the fee
482482 is paid. It shall be the duty of the clerk or other authority
483483 collecting those court fees to keep accurate records of the
484484 amounts due the director for the benefit of the fund
485485 established under this section."
486486 Section 2. Section 31-13-36 is added to the Code of
487487 Alabama 1975, to read as follows:
488488 §31-13-36
489489 (a) Whenever a law enforcement agency in this state has
490490 an illegal alien in its custody, the agency may not release
491491 the illegal alien until the agency has collected a full set of
492492 fingerprints and a known DNA reference sample from the
493493 individual, if a sample has not previously been collected.
494494 (b) Following the collection of fingerprints or DNA
495495 pursuant to this section, a law enforcement agency shall
496496 submit the fingerprints to the Alabama State Law Enforcement
497497 Agency for cataloging and shall submit the known DNA reference
498498 sample to the Alabama Department of Forensic Sciences for
499499 analysis and entry into the appropriate database.
500500 Section 3. This act shall become effective on June 1,
501501 2025.
