1717 SYNOPSIS:
1818 Existing law provides that local emergency
1919 management organizations, through the director, may
2020 enter into mutual aid agreements with other public and
2121 private agencies for reciprocal emergency aid when the
2222 size of a disaster requires such aid.
2323 This bill would transfer the authority to enter
2424 into mutual aid agreements to the governing body of the
2525 local emergency management organization; and would also
2626 provide that mutual aid agreements can be developed
2727 with other agencies for reciprocal aid to protect
2828 public peace and safety.
2929 This bill would also provide that employees of
3030 other political subdivisions have the same power and
3131 immunity when they render assistance under such a
3232 mutual aid agreement outside their political
3333 subdivision.
3434 This bill would further make nonsubstantive
3535 changes to update the existing code language to current
3636 style.

7070 Relating to local emergency management organizations;
7171 to amend Section 31-9-9, Code of Alabama 1975, to further
7272 provide for mutual aid agreements with other public or private
7373 agencies for reciprocal aid to protect public health and
7474 safety; to vest the authority in the governing body; to amend
7575 Section 31-9-11, Code of Alabama 1975, to further provide that
7676 employees of political subdivisions have the same powers and
7777 immunities when they act outside of the political subdivision
7878 pursuant to a mutual aid agreement; and to make nonsubstantive
7979 changes to update the existing code language to current style.
8080 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
8181 Section 1. Sections 31-9-9 and 31-9-11, Code of Alabama
8282 1975, are amended to read as follows:
8383 "§31-9-9
8484 (a) The directorgoverning body of each local
8585 organization for emergency management may develop or cause to
8686 be developed mutual aid agreements with other public and
8787 private agencies within this state for reciprocal emergency
8888 management aid and assistance in case of disaster too great to
8989 be dealt with unassisted. The governing body may also develop
9090 or cause to be developed mutual aid agreements with other
9191 public or private agencies within the state for reciprocal aid
9292 and assistance to protect the public peace, health, and
9393 safety, and to preserve the lives and property of the people
9494 of the state. Such agreements shall be consistent with the
9595 state emergency management plan and program, and a copy of
9696 each such agreement shall be filed with the State Director of

126126 each such agreement shall be filed with the State Director of
127127 Emergency Management immediately after being entered into. In
128128 time of emergency it shall be the duty of each Each local
129129 organization for emergency management toshall render
130130 assistance in accordance with the provisions of suchthe mutual
131131 aid agreements.
132132 (b) The directorgoverning body of each local
133133 organization for emergency management may assist in
134134 negotiation of reciprocal mutual aid agreements between the
135135 Governor and adjoining states or political subdivisions
136136 thereof, and shall carry out any such agreement relating to
137137 the local and political subdivision.
138138 (c) The directorsgoverning body of each local
139139 organization for emergency management may develop or cause to
140140 be developed mutual aid agreements with federally recognized
141141 Indian tribes located within the state .
142142 (d) For purposes of this section, "governing body"
143143 means the political subdivision establishing the local
144144 organization for emergency management pursuant to Section
145145 31-9-10."

147147 Whenever the employees of any political subdivision are
148148 rendering outside aid pursuant to a mutual aid agreement
149149 authorized by Section 31-9-9 or the authority contained in
150150 Section 31-9-10, suchthe employees shall have the same powers,
151151 duties, rights, privileges, and immunities as if they were
152152 performing their duties in the political subdivisions in which
153153 they are normally employed."
154154 Section 2. This act shall become effective on October
