1515 SYNOPSIS:
1616 Under existing law, it is unlawful for certain
1717 employees to engage in sexual conduct with a person in
1818 the custody of the Department of Corrections, the
1919 Department of Youth Services, a sheriff, a county, or a
2020 municipality.
2121 This bill would make it unlawful for any person
2222 who has access to a person in custody by virtue of his
2323 or her profession to engage in sexual conduct with a
2424 person in the custody of the Department of Corrections,
2525 the Department of Youth Services, a sheriff, a county,
2626 or a municipality .

3030 Relating to custodial sexual misconduct; to amend
3131 Section 14-11-31, Code of Alabama 1975, to prohibit any person
3232 who has access to a person in custody by virtue of his or her
3333 profession to engage in sexual conduct with a person who is in
3434 the custody of the Department of Corrections, the Department
3535 of Youth Services, a sheriff, a county, or a municipality.

6666 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
6767 Section 1. Section 14-11-31, Code of Alabama 1975, is
6868 amended to read as follows:
6969 "ยง14-11-31
7070 (a) It shall be unlawful for any person who has access
7171 to a person in custody by virtue of his or her profession or
7272 any employee to engage in sexual conduct with a person who is
7373 in the custody of the Department of Corrections, the
7474 Department of Youth Services, a sheriff, a county, or a
7575 municipality.
7676 (b) It shall be unlawful for any probation or parole
7777 officer to engage in sexual conduct with a person who is under
7878 the supervisory, disciplinary, or custodial authority of the
7979 officer engaging in the sexual conduct with the person.
8080 (c) Any person violating subsection (a) or (b) shall,
8181 upon conviction, shall be guilty of custodial sexual
8282 misconduct.
8383 (d) Custodial sexual misconduct is a Class C felony.
8484 (e) For purposes of this article, the consent of the
8585 person in custody of the Department of Corrections, the
8686 Department of Youth Services, a sheriff, a county, or a
8787 municipality, or a person who is on probation or on parole,
8888 shall not be a defense to a prosecution under this article."
8989 Section 2. This act shall become effective on October
