15+SYNOPSIS:
16+Existing law provides that a tall structure may
17+not have an adverse impact on the operations of a
18+military installation.
19+Existing law also requires a local government,
20+before approving a tall structure near a military
21+installation, to notify the Federal Aviation
22+Administration; however, the governing body of counties
23+do not have a uniform process in place requiring
24+approval of constructing these tall structures.
25+This bill would require a person seeking to
26+construct a tall structure within a minimum distance of
27+a military installation to receive approval from the
28+local government before construction may begin.
29+This bill would authorize a local government to
30+seek enjoinment of the construction of a tall structure
31+if prior approval was not granted.
32+This bill would also make conforming changes.

1735 AN ACT
1836 Relating to military installations; to amend Sections
19-11-106-3, 11-106-4, and 11-106-6, Code of Alabama 1975, to
20-revise the definition of the term "military installation"; to
21-require persons to obtain the approval of a local government
22-before constructing a tall structure within a certain distance
23-of a military installation; to authorize local governments to
24-seek enjoinment of the construction of a tall structure in
25-certain circumstances; and to make conforming changes.
26-BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
27-Section 1. Sections 11-106-3, 11-106-4, and 11-106-6,
28-Code of Alabama 1975, are amended to read as follows:
29-"§11-106-3
30-As used in this chapter, the following words shall have
31-the following meanings:
32-(1) ADVERSE IMPACT ON MILITARY OPERATIONS AND
33-READINESS. The same meaning as provided for that term in 10
34-U.S.C. § 183a(h), and consistent with Section 3.1.a.4 of DoD
35-Instruction 4180.02.
36-(2) DEPARTMENT OF DEFENSE SITING CLEARINGHOUSE. The
37-Military Aviation and Installation Assurance Siting

68-Clearinghouse of the Department of Defense, as established by
69-10 U.S.C. § 183a.
70-(3) LOCAL GOVERNMENT. Any county or municipality.
71-(4) LOCAL IMPACT ISSUE. Any adoption or amendment by a
72-local government of a proposed zoning plan, comprehensive
73-master plan, or land development regulations that, if
74-approved, may or will significantly affect any area or
75-airspace that is within two miles of a military installation.
76-(5) MILITARY INSTALLATION. Any base, camp, post,
77-station, airfield, yard, center, or any other land area under
78-the jurisdiction of the United States Department of Defense,
79-including any leased facility , the total acreage of which
80-installation is in excess of 500 acres . The term military
81-installation does not include any facility used primarily for
82-civil works, river projects, or flood control projects.
83-(6) NOTICE OF PRESUMED RISK. The notice provided by the
84-Department of Defense Siting Clearinghouse to an owner of an
85-energy facility pursuant to 10 U.S.C. § 183a(c)(2).
86-(7) TALL STRUCTURE. Any building, structure, or unit
87-within a multiunit building with a vertical height of more
88-than 200 feet measured from the top of the foundation of the
89-building, structure, or unit to the uppermost point of the
90-building, structure, or unit. The term does not include: wind
91-energy facilities, electrical transmission towers, slender
92-structures, or minor vertical projections of a parent
93-building, including, but not limited to, chimneys, flagpoles,
94-flues, spires, steeples, belfries, cupolas, antennas, poles,
95-lines, or wires, except that no such structure or vertical

73+BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
74+Section 1. Sections 11-106-4 and 11-106-6, Code of
75+Alabama 1975, are amended to read as follows:
76+"§11-106-4
77+(a) Each local government whose territorial boundaries
78+are within two miles of all or any portion of a military
79+installation shall provide written notice to the military
80+installation's commanding officer and the flying mission
81+commanding officer if applicable, or their designees, of any
82+local impact issue.
83+(b) Prior to approving any proposed tall structure or
84+wind energy facility, the local government shall follow the
85+requirements of Section 11-106-6. The requirements of Section
86+11-106-6 shall apply regardless of the distance of the tall
87+structure or wind energy facility from any military
88+installation and regardless of whether the local government’s
89+territorial boundaries are within two miles of all or any
90+portion of a military installation. "

92+(a) The construction or operation of any tall structure
93+or wind energy facility in this state shall not encroach upon
94+or otherwise have an adverse impact on military operations and

125-lines, or wires, except that no such structure or vertical
126-projection may project more than 20 vertical feet above the
127-parent building. The term also does not include any
128-communications structures requiring antenna structure
129-registration pursuant to 47 C.F.R. § 17.4.
130-(8) WIND ENERGY FACILITY. Facilities for the generation
131-of electricity by wind power."

131+(b)(c) A governing body of a local government , prior to
132+approving an application for the construction of a tall
133+structure shall may not approve an application to commence
134+construction of a tall structure within two miles of a
135+military installation unless require the applicant to file has
136+filed an application with the Federal Aviation Administration
137+under 49 U.S.C. § 44718, and provide provided the governing
138+body of the local government either of the following:
139+(1) A written "Determination of No Hazard to Air
140+Navigation" issued by the Federal Aviation Administration
141+pursuant to 14 C.F.R. Part 77, Subpart D.
142+(2) In coordination with any affected military
143+installation and the state Military Department, a written
144+determination resolving any adverse impact to military
145+operations identified during the aeronautics study conducted
146+pursuant to 14 C.F.R. Part 77, Subpart D.
147+(3) The tall structure shall be in compliance with
148+subsection (a) even if the local government either does not
149+require an application prior to the construction of a tall
150+structure or does not require the application outlined in this
151+subsection if the applicant has otherwise complied with the
152+requirements of subdivision (1) or (2).

184-unless the person has obtained approval from the governing
185-body of the local government in which the tall structure will
186-be located as further provided in this section.
187-(b)(c) A governing body of a local government , prior to
188-approving an application for the construction of a tall
189-structure shall approve an application to commence
190-construction of a tall structure within two miles of a
191-military installation once require the applicant to file has
192-filed an application with the Federal Aviation Administration
193-under 49 U.S.C. § 44718, and provide provided the governing
194-body of the local government either of the following:
195-(1) A written "Determination of No Hazard to Air
196-Navigation" issued by the Federal Aviation Administration
197-pursuant to 14 C.F.R. Part 77, Subpart D.
198-(2) In coordination with any affected military
199-installation and the state Military Department, a written
200-determination resolving any adverse impact to military
201-operations identified during the aeronautics study conducted
202-pursuant to 14 C.F.R. Part 77, Subpart D.
203-(3) The tall structure shall be in compliance with
204-subsection (a) even if the local government either does not
205-require an application prior to the construction of a tall
206-structure or does not require the application outlined in this
207-subsection if the applicant has otherwise complied with the
208182 requirements of subdivision (1) or (2).
209183 (d) A local government may bring an action for
210184 injunctive relief against any person that commences the
211185 construction of a tall structure without obtaining prior
186+approval as required pursuant to this section.
187+(c)(e) A local government considering an application
188+for the construction of a wind energy facility shall require
189+the applicant to provide the following at least 270 days prior
190+to planned construction:
191+(1) Documentation that the owner or applicant has
192+transmitted notice relating to the construction of the wind
193+energy facility to the Department of Defense Siting
194+Clearinghouse, the state Military Department, and the state
195+Department of Transportation.
196+(2) A map showing the specific location and tower hub
197+height with rotor diameter for each proposed wind turbine.
198+(3) Documentation that the facility owner has either
199+initiated an informal review with the Department of Defense
200+Siting Clearinghouse under 32 C.F.R. § 211.7 or filed for a
201+formal review with the Secretary of Transportation and the
202+Federal Aviation Administration pursuant to 49 U.S.C. § 44718.
203+(d)(f) A local government may not approve an
204+application for the construction of a wind energy facility
205+prior to receiving documentation of one of the following:
206+(1) A completed Department of Defense Siting
207+Clearinghouse informal review resulting in a determination of
208+no presumed risk.
209+(2) A mitigation agreement between the owner or
210+applicant and the Department of Defense Siting Clearinghouse

242-approval as required pursuant to this section.
243-(c)(e) A local government considering an application
244-for the construction of a wind energy facility shall require
245-the applicant to provide the following at least 270 days prior
246-to planned construction:
247-(1) Documentation that the owner or applicant has
248-transmitted notice relating to the construction of the wind
249-energy facility to the Department of Defense Siting
250-Clearinghouse, the state Military Department, and the state
251-Department of Transportation.
252-(2) A map showing the specific location and tower hub

245+(e)(g) Notwithstanding subsection (d) (f), a local
246+government may approve an application for the construction of
247+a wind energy facility conditioned upon the applicant
248+providing documentation of one of the requirements set out in
249+subsection (d) (f).
250+(f)(h) If any dispute arises between a local government
251+and an applicant or military installation relating to the
252+approval of any tall structure or wind energy facility, the
253+local government shall provide notice to the Governor or the
254+Governor’s Governor's designee to facilitate resolution of the
255+dispute.
256+(g)(i) A local government may not require any other
257+formal written approval from a military installation to
258+approve an application for the construction of a tall
259+structure or wind energy facility."
260+Section 2. This act shall become effective on October
261+1, 2025.
