BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS: 25 
 26 
 SECTION 1.  Arkansas Code Title 26, Chapter 51, is amended to add an 27 
additional subchapter to read as follows: 28 
 29 
 Subchapter 29 — Preceptor Tax Incentive Program 30 
 31 
 26-51-2901.  Definitions. 32 
 As used in this subchapter: 33 
 (1)  "Counseling student" means on individual who is 34 
participating in a training program in this state that is accredited by a 35

licensed professional counselor, licensed associate counselor, or licensed 1 
marriage and family therapist under § 17 -27-101 et seq.; 2 
 (2)  "Faculty preceptor" means an individual who is licensed as 3 
a:  4 
 (A)  Physician licensed under the Arkansas Medical 5 
Practices Act,  17-95-401 et seq.;  6 
 (B)  Registered nurse, advanced practice registered nurse, 7 
or registered nurse practitioner under § 17 -87-301 et seq.; 8 
 (C)  Physician assistant licensed under § 17 -105-101 et 9 
seq.; or 10 
 (D)  A licensed professional counselor, licensed associate 11 
counselor, or licensed marriage and family therapist by the Arkansas Board of 12 
Examiners in Counseling under § 17 -27-101 et seq.;  13 
 (3)  "Medical student" means an individual participating in a 14 
training program in this state that is approved by the Arkansas State Medical 15 
Board for the training of physicians; 16 
 (4)  "Nursing student" means an individual participating in a 17 
training program in this state that is accredited by a nationally recognized 18 
accrediting body for training a student to become a registered nurse, 19 
advanced practice registered nurse, or registered nurse practitioner under § 20 
17-87-101 et seq.; 21 
 (5)  "Physician" means an individual licensed to practice 22 
medicine under the Arkansas Medical Practices Act, § 17 -95-201 et seq.; 23 
 (6)  "Physician assistant student" means an individual 24 
participating in a training program  in this state that is approved by the 25 
Arkansas State Medical Board for the training of individuals to become 26 
physician assistants as defined in § 17 -105-101 et seq.; 27 
 (7)  "Preceptorship rotation" means a period of preceptorship 28 
training of one or more medical students, physician assistant students, 29 
counseling students, or nursing students that in aggregate totals at least 30 
one hundred sixty (160) hours; and 31 
 (8)  "Preceptorship training" means community based training of a 32 
medical student, counseling student, nursing student, or physician assistant 33 
student who has matriculated at a training program in Arkansas. 34

 (a)  As used in this section, "uncompensated faculty preceptor" means 1 
the faculty preceptor who: 2 
 (1)  Provides a preceptorship rotation; and 3 
 (2)  Does not receive any kind of financial remuneration from any 4 
party for conducting the preceptorship rotation. 5 
 (b)(1)  An uncompensated faculty preceptor is allowed an income tax 6 
credit against the income tax imposed by this chapter in the amount 7 
determined under subsection (c) of this section for wages he or she receives 8 
as a physician, licensed professional couns elor, licensed associate 9 
counselor, licensed marriage and family therapist, professional nurse, 10 
advanced practice registered nurse, registered nurse practitioner, or 11 
physician assistant. 12 
 (2)  If the amount of the income tax credit allowed under this 13 
section exceeds the taxpayer's income -tax liability, the excess shall not be 14 
refunded to the taxpayer. 15 
 (c)(1)  The amount of the tax credit allowed under subsection (b) of 16 
this section is one thousand dollars ($1,000) per student who participated in 17 
the preceptor training during the calendar year. 18 
 (2)  The taxpayer shall not claim more than ten thousand dollars 19 
($10,000) per year in income tax credits under this section. 20

 26-51-2903.  Compensated faculty preceptor .  22 
 (a)  As used in this section, "compensa ted faculty preceptor" means a 23 
faculty preceptor who: 24 
 (1)  Provides a preceptorship rotation; and 25 
 (2)  Receives payment as an independent contractor as 26 
compensation for conducting the preceptorship rotation paid for by the school 27 
at which the medical student, nursing student, counseling student, or 28 
physician assistant student has matriculated. 29 
 (b)(1)  A compensated faculty preceptor is allowed an income tax credit 30 
against the income tax imposed by this chapter in the amount determined under 31 
subsection (c) of this section for payments he or she receives as an 32 
independent contractor for conducting the preceptor training. 33 
 (2)  If the amount of the income tax credit allowed under this 34 
section exceeds the taxpayer's income -tax liability, the excess shall not be 35

 (c)  Amount of the tax credit allowed under subsection (b) of this 1 
section is equal to the amount the taxpayer received as compensation for 2 
conducting the preceptor training, not to exceed six thousand dollars 3 
($6,000) per taxpayer. 4

 SECTION 2.  Section 1 of this act is effective for tax years beginning 6 
on or after January 1, 2023. 7
