65 | 64 | | (3) “Consumer electronic item” means an electronic ite m or other 21 |

---|
93 | 92 | | (B) A minimum annual collection of consumer electronic 9 |
---|
94 | 93 | | items in excess of two hundred (200) tons; 10 |
---|
95 | 94 | | (5) “Contractor” means a person who: 11 |
---|
96 | 95 | | (A) Owns or operates a corporate recycling entity with 12 |
---|
97 | 96 | | multiple locations in the state; and 13 |
---|
98 | 97 | | (B) Has a minimum of three (3) years' experience in the 14 |
---|
99 | 98 | | collection, recovery, tra nsport, recycling, refurbishing, marketing, and 15 |
---|
100 | 99 | | distribution for reuse of consumer electronic items; 16 |
---|
101 | 100 | | (6) “Eligible entity” means an entity located in the state and 17 |
---|
102 | 101 | | includes without limitation a: 18 |
---|
103 | 102 | | (A) Single-family or multifamily household; 19 |
---|
104 | 103 | | (B) Small business or nonprofit corporation with less than 20 |
---|
105 | 104 | | five hundred (500) full -time employees; 21 |

106 | 105 | | (C) Planning and development district; 22 |
---|
107 | 106 | | (D) Regional solid waste management district; and 23 |
---|
108 | 107 | | (E) State-supported entity; 24 |

135 | 134 | | (A) Prohibition of a recycling fee at the retail point of 11 |
---|

137 | 136 | | (B) Reasonable and convenient access to recovery and 13 |
---|
138 | 137 | | collection options for an eligible entity, including local and regional 14 |
---|
139 | 138 | | collection options; 15 |
---|
140 | 139 | | (C) Comprehensive, convenient, and environmentally and 16 |
---|
141 | 140 | | economically sound collection system operated by a contractor and supervised 17 |
---|
142 | 141 | | and administered by a contract administrator that may include specific 18 |
---|
143 | 142 | | logistical criteria including without limitation the location, size, and 19 |
---|
144 | 143 | | number of eligible entities; 20 |

145 | 144 | | (D) Plan for marketing and distribution of collected 21 |

174 | 173 | | (3) Be certified or accredited by national and international 10 |
---|
175 | 174 | | electronic and environmental standards and practices organizations, including 11 |
---|

177 | 176 | | (A) e-Stewards Standard for Ethical and Responsible Reuse, 13 |
---|
178 | 177 | | Recycling, and Disposition of Electronic Equipment and Information 14 |
---|

180 | 179 | | (B) ISO 14001:2015 Environmental management systems; or 16 |
---|
181 | 180 | | (C) ISO 45001:2018 Occupational health and safety 17 |
---|

---|

---|
