Davis 6 7 For An Act To Be Entitled 8 AN ACT TO REQUIRE MEDICAID COVERAGE FOR POSTPARTUM 9 MOTHERS FOR ONE YEAR AFTER GIVING BIRTH; AND FOR 10 OTHER PURPOSES. 11 12 13 Subtitle 14 TO REQUIRE MEDICAID COVERAGE FOR 15 POSTPARTUM MOTHERS FOR ONE YEAR AFTER 16 GIVING BIRTH. 17 18 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS: 19 20 SECTION 1. Arkansas Code Title 20, Chapter 77, Subchapter 1, is 21 amended to add an additional section to read as follows: 22 20-77-154. Extension of one year for postpartum coverage. 23 (a) The Department of Human Services shall: 24 (1)(A) Extend postpartum Medicaid coverage for mothers to one 25 (1) year in duration. 26 (B) If a mother is eligible to be enrolled under the 27 Arkansas Health and Opportunity for Me Act of 2021, § 23 -61-1001 et seq., the 28 extended postpartum Medicaid coverage shall be delivered as provided under 29 the Arkansas Health and Opportunity for Me Act of 2021,§ 23 -61-1001 et seq. 30 (C) If a mother is not eligible to be enrolled under the 31 Arkansas Health and Opportunity for Me Act of 2021, § 23 -61-1001 et seq., the 32 extended postpartum Medicaid coverage shall be delivered through the 33 traditional Arkansas Medicaid Program; and 34 (2) Take necessary action, including without limitation 35 submitting and applying for a state plan amendment or waiver, to obtain 36 HB1004 2 11/20/2024 8:45:14 AM federal approval to adopt one -year postpartum Medicaid coverage for a mother 1 who has recently given birth. 2 (b) The department shall promulgate rules to administer this section. 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36
