AN ACT TO AMEND ARKANSAS LAW CONCERNING PERSONS WHO 9 
MAY REGISTER TO VOTE; AMENDING PROVISIONS OF ARKANSAS 10 
CONSTITUTION, AMENDMENT 51, UNDER THE AUTHORITY 11 
GRANTED BY ARKANSAS CONSTITUTION, AMENDMENT 51, § 19; 12 
AND FOR OTHER PURPOSES. 13

TO AMEND ARKANSAS LAW CONCERNING PERSONS 17 
WHO MAY REGISTER TO VOTE; AND AMENDING 18 
PROVISIONS OF ARKANSAS CONSTITUTION, 19 
AMENDMENT 51, UNDER THE AUTHORITY 20 
GRANTED BY ARKANSAS CONSTITUTION, 21 
AMENDMENT 51, § 19.  22

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS: 24 
 25 
 SECTION 1.  Arkansas Constitution, Amendment 51, § 6(a)(6)(B), 26 
concerning voter registration application forms, is amended under the 27 
authority granted by Arkansas Constitution, Amendment 51, § 19, to read as 28 
follows:   29 
 (B) “Will you be eighteen (18) years of age on or before 30 
election day Are you sixteen (16) years of age or older ?”; 31 
 32 
 SECTION 2.  Arkansas Constitution, Amendment 51, § 9(a), concerning 33 
applications to register to vote, is amended under the authority granted by 34 
Arkansas Constitution, Amendment 51, § 19, to read as follows:  35 
 (a) All persons may register who: 36    	HB1037

 (1)  Have not been convicted of a felony unless the person's 1 
sentence has been discharged or the person has been pardoned; 2 
 (2)  Have not been adjudged mentally incompetent by a court of 3 
competent jurisdiction; and 4 
 (3)  Meet one (1) of the following requirements: 5 
 (A)  Are qualified electors who have not previously 6 
registered; 7 
 (B)  Will Except as provided in subsection (m) of this 8 
section, will become qualified electors during the thirty -day period 9 
immediately prior to the next election scheduled within the county; 	or 10 
 (C)  Are sixteen (16) or seventeen (17) years of age and 11 
eligible to register under subsection (m) of this section; or 12 
 (C)(D) Are otherwise qualified electors but whose 13 
registration has been cancelled in a manner provided for by this amendment. 14 
 (4)  Are citizens of the United States. 15

 SECTION 3.  Arkansas Constitution, Amendment 51, § 9, concerning 17 
applications to register to vote, is amended under the authority granted by 18 
Arkansas Constitution, Amendment 51, § 19, to add an additional subsection to 19 
read as follows:   20 
 (m)(1)(A)  A person who is sixteen (16) or seventeen (17) years of age 21 
who is otherwise eligible to register to vote under subsection (a) of this 22 
section may register under this section.  23 
 (B)  A registered voter who is sixteen (16) or seventeen 24 
(17) years of age shall not vote in an election before turning eighteen (18) 25 
years of age. 26 
 (2)(A)  A person who is sixteen (16) or seventeen (17) years of 27 
age and registers under this section shall be added to the voter registration 28 
list with a designation that the person is not eligible to vote until the 29 
date he or she turns eighteen (18) years of age. 30 
 (B)  The designation under subdivision (m)(2)(A) of this 31 
section shall be removed when the person turns eighteen (18) years of age.         32

 SECTION 4.  Arkansas Constitution, Amendment 41, § 14, is amended under 34 
the authority granted by Arkansas Constitution, Amendment 51, §  19, to read 35

 § 14. Voter registration lists. 1 
 (a)(1) By the first day of June of each year, and at such other times 2 
as may be practicable, all Permanent Registrars shall, and at their 3 
discretion at other times may, print or otherwise duplicate and publish lists 4 
of registered voters by precincts, and may distribute such lists pursuant to 5 
§§ 7-5-105 and 7-5-109.   6 
 (2) A copy of the most current such list in each precinct shall 7 
be furnished to the election officials at each precinct at the time the 8 
ballot boxes are delivered and such election officials shall post said list 9 
at a conspicuous place in the polling area. 10 
 (b)(1) By the first day of June of each year, the Permanent Registrar 11 
shall certify to the Secretary of State the total number of registered voters 12 
in the county, including persons who are sixteen (16) or seventeen (17) years 13 
of age and have registered under § 9(m) of this amendment .  14 
 (2) The Secretary of State shall tabulate the total number of 15 
registered voters in the state and shall make such information available to 16 
interested persons upon request. 17 
 (3)  The tabulation of registered voters shall include persons 18 
who are sixteen (16) or seventeen (17) years of age and have registered under 19 
§ 9(m) of this amendment.  20
