22	22	BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS: 20

24	24	SECTION 1. Arkansas Code Title 20, Chapter 77, Subchapter 1, is 22
25	25	amended to add an additional section to read as follows: 23
26	26	20-77-153. Reimbursement for remote ultrasound procedures and remote 24
27	27	fetal nonstress tests. 25
28	28	(a)(1) The Arkansas Medicaid Program shall reimburse for remote 26
29	29	ultrasound procedures and remote fetal nonstress tests utilizing established 27
30	30	Current Procedural Terminology codes for remote ultrasound procedures and 28
31	31	fetal nonstress tests when the patient is in a residence or other off -site 29
32	32	location from the healthcare provider of the patient and the same standard of 30
33	33	care is met. 31
34	34	(2) Subdivision (a)(1) of this section shall apply to the fee -32
35	35	for-service categories of the program and any managed care plan within the 33
36	36	program. 34
37	37	(b) A remote ultrasound and remote fetal nonstress test shall be 35
38	38	reimbursable when the healthcare provider uses digital technology that: 36 HB1053

41	41	(1) Collects medical and other forms of health data from a 1
42	42	patient and electronically transmits the information securely to a healthcare 2
43	43	provider in a different location for interpretation and recommendation; 3
44	44	(2) Is compliant with the Health Insurance Portability and 4
45	45	Accountability Act of 1996, 42 U.S.C. § 1320d et seq., as it existed on 5
46	46	January 1, 2025; and 6
47	47	(3) Is approved by the United States Food and Drug 7
48	48	Administration. 8
49	49	(c) A remote fetal nonstress test shall be reimbursed under a Current 9
50	50	Procedural Terminology code 5905 in the same manner as an in -person clinic 10
51	51	fetal nonstress test with the place of service at home and shall use remote 11
52	52	monitoring solutions that are approved by the United States Food and Drug 12
53	53	Administration for on -label use for monitoring fetal heart rate, maternal 13
54	54	heart rate, and uterine activity. 14
55	55	(d) The Department of Human Services shall: 15
56	56	(1) Apply for any federal waiver, Medicaid state plan 16
57	57	amendments, or other authority necessary to implement this section; and 17
58	58	(2) Adopt rules to implement this section. 18

60	60	SECTION 2. DO NOT CODIFY. Rules. 20
61	61	(a) When adopting the initial rules required under this act, the 21
62	62	Department of Human Services shall file the final rules with the Secretary of 22
63	63	State for adoption under § 25 -15-204(f): 23
64	64	(1) On or before January 1, 2026; or 24
65	65	(2) If approval under § 10 -3-309 has not occurred by January 1, 25
66	66	2026, as soon as practicable after approval under § 10 -3-309. 26
67	67	(b) The department shall file the proposed rules with the Legislative 27
68	68	Council under § 10-3-309(c) sufficiently in advance of January 1, 2026, so 28
69	69	that the Legislative Council may consider the rules for approval before 29
70	70	January 1, 2026. 30
