2222 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS: 20

2424 SECTION 1. Arkansas Code Title 20, Chapter 77, Subchapter 1, is 22
2525 amended to add an additional section to read as follows: 23
2626 20-77-153. Reimbursement for remote ultrasound procedures and remote 24
2727 fetal nonstress tests. 25
2828 (a)(1) The Arkansas Medicaid Program shall reimburse for remote 26
2929 ultrasound procedures and remote fetal nonstress tests utilizing established 27
3030 Current Procedural Terminology codes for remote ultrasound procedures and 28
3131 fetal nonstress tests when the patient is in a residence or other off -site 29
3232 location from the healthcare provider of the patient and the same standard of 30
3333 care is met. 31
3434 (2) Subdivision (a)(1) of this section shall apply to the fee -32
3535 for-service categories of the program and any managed care plan within the 33
3636 program. 34
3737 (b) A remote ultrasound and remote fetal nonstress test shall be 35
3838 reimbursable when the healthcare provider uses digital technology that: 36 HB1053

4141 (1) Collects medical and other forms of health data from a 1
4242 patient and electronically transmits the information securely to a healthcare 2
4343 provider in a different location for interpretation and recommendation; 3
4444 (2) Is compliant with the Health Insurance Portability and 4
4545 Accountability Act of 1996, 42 U.S.C. § 1320d et seq., as it existed on 5
4646 January 1, 2025; and 6
4747 (3) Is approved by the United States Food and Drug 7
4848 Administration. 8
4949 (c) A remote fetal nonstress test shall be reimbursed under a Current 9
5050 Procedural Terminology code 5905 in the same manner as an in -person clinic 10
5151 fetal nonstress test with the place of service at home and shall use remote 11
5252 monitoring solutions that are approved by the United States Food and Drug 12
5353 Administration for on -label use for monitoring fetal heart rate, maternal 13
5454 heart rate, and uterine activity. 14
5555 (d) The Department of Human Services shall: 15
5656 (1) Apply for any federal waiver, Medicaid state plan 16
5757 amendments, or other authority necessary to implement this section; and 17
5858 (2) Adopt rules to implement this section. 18

6060 SECTION 2. DO NOT CODIFY. Rules. 20
6161 (a) When adopting the initial rules required under this act, the 21
6262 Department of Human Services shall file the final rules with the Secretary of 22
6363 State for adoption under § 25 -15-204(f): 23
6464 (1) On or before January 1, 2026; or 24
6565 (2) If approval under § 10 -3-309 has not occurred by January 1, 25
6666 2026, as soon as practicable after approval under § 10 -3-309. 26
6767 (b) The department shall file the proposed rules with the Legislative 27
6868 Council under § 10-3-309(c) sufficiently in advance of January 1, 2026, so 28
6969 that the Legislative Council may consider the rules for approval before 29
