BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS: 23

 SECTION 1. REGULAR SALARIES.  There is hereby established for the 25 
Department of Commerce - Arkansas Development Finance Authority for the 2025-26 
2026 fiscal year, the following maximum number of regular employees. 27

 SECTION 2. EXTRA HELP.  There is hereby authorized, for the Department 20 
of Commerce - Arkansas Development Finance Authority for the 2025-2026 fiscal 21 
year, the following maximum number of part -time or temporary employees, to be 22 
known as "Extra Help", payable from funds appropriated herein for such 23 
purposes: five (5) temporary or part-time employees, when needed, at rates of 24 
pay not to exceed those provided in the Uniform Classification and 25 
Compensation Act, or its successor, or this act for the appropriate 26 
classification. 27

 SECTION 3. APPROPRIATION - OPERATIONS.  There is hereby appropriated, 29 
to the Department of Commerce , to be payable from the cash funds as defined 30 
by Arkansas Code 19-4-801, for personal services, operating expenses, data 31

 SECTION 6. APPROPRIATION - EMERGENCY SOLUTIONS GRANT .  There is hereby 10 
appropriated, to the Department of Commerce - Arkansas Development Finance 11 
Authority, to be payable from the federal funds as designated by the Chief 12 
Fiscal Officer of the State , to provide funding to engage homeless 13 
individuals and families, improve the number and quality of emergency 14 
shelters for homeless individuals and families, provide essential services to 15 
shelter residents and rapidly re -house homeless individuals and families for 16 
the fiscal year ending June 30, 2026, the following: 17

 SECTION 7. COMPLIANCE WITH OTHER LAWS.  Disbursement of funds 23 
authorized by this act shall be limited to the appropriation for such agency 24 
and funds made available by law for the support of such appropriations; and 25 
the restrictions of the State Procurement Law, the General Accounting and 26 
Budgetary Procedures Law, the Revenue Stabilization Law, the Regular Salary 27 
Procedures and Restrictions Act, or their successors, and other fiscal 28 
control laws of this State, where applicable, and regulations promulgated by 29 
the Department of Finance and Administration, as authorized by law, shall be 30 
strictly complied with in disbursement of said funds. 31

 SECTION 8. LEGISLATIVE INTENT.  It is the intent of the General 33 
Assembly that any funds disbursed under the authority of the appropriations 34 
contained in this act shall be in compliance with the stated reasons for 35 
which this act was adopted, as evidenced by the Agency Requests, Executive 36    	HB1090

Recommendations and Legislative Recommendations contained in the budget 1 
manuals prepared by the Department of Finance and Administration, letters, or 2 
summarized oral testimony in the official minutes of the Arkansas Legislative 3 
Council or Joint Budget Committee which relate to its passage and adoption. 4

 SECTION 9. EMERGENCY CLAUSE.  It is found and determined by the General 6 
Assembly, that the Constitution of the State of Arkansas prohibits the 7 
appropriation of funds for more than a one (1) year period; that the 8 
effectiveness of this Act on July 1, 2025 is essential to the operation of 9 
the agency for which the appropriations in this Act are provided, and that in 10 
the event of an extension of the legislative session, the delay in the 11 
effective date of this Act beyond July 1, 2025 could work irreparable harm 12 
upon the proper administration and provision of essential governmental 13 
programs. Therefore, an emergency is hereby declared to exist and this Act 14 
being necessary for the immediate preservation of the public peace, health 15 
and safety shall be in full force and effect from and after July 1, 2025. 16
