25	24		BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS: 22

27	26		SECTION 1. REGULAR SALARIES. There is hereby established for the 24
28	27		Department of Health - Health Services Permit Agency for the 2025-2026 fiscal 25
29	28		year, the following maximum number of regular employees. 26

43	42		SECTION 2. APPROPRIATION - STATE OPERATIONS. There is hereby 2
44	43		appropriated, to the Department of Health , to be payable from the 3
45	44		Miscellaneous Agencies Fund Account , for personal services and operating 4
46	45		expenses of the Department of Health - Health Services Permit Agency - State 5
47	46		Operations for the fiscal year ending June 30, 2026, the following: 6

61	60		SECTION 3. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS 20
62	61		CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. CARRY 21
63	62		FORWARD. Any unexpended balance of funds generated by fees and fines pursuant 22
64	63		to Arkansas Code 20-8-103 et. seq. deposited into the Miscellaneous Agencies 23
65	64		Fund Account which remain at the close of each state fiscal year shall be 24
66	65		carried forward to the next state fiscal year to be used for the same intent 25
67	66		and purposes as set forth in law. 26
68	67		Any carry forward of unexpended balance funding as authorized herein, may 27
69	68		be carried forward under the following conditions: 28
70	69		(1) Prior to June 30, 2025 2026 the Agency shall by written statement set 29
71	70		forth its reason(s) for the need to carry forward said funding to the 30
72	71		Department of Finance and Administration Office of Budget; 31
73	72		(2) The Department of Finance and Administration Office of Budget shall 32
74	73		report to the Arkansas Legislative Council all amounts carried forward by the 33
75	74		September Arkansas Legislative Council or Joint Budget Committee meeting, 34
76	75		which report shall include the name of the Agency, Board, Commission or 35
77	76		Institution and the amount of the funding carried forward, the program name 36 HB1093

80	79		or line item, the funding source of that appropriation and a copy of the 1
81	80		written request set forth in (1) above; 2
82	81		(3) Each Agency, Board, Commission or Institution shall provide a written 3
83	82		report to the Arkansas Legislative Council or Joint Budget Committee 4
84	83		containing all information set forth in item (2) above, along with a written 5
85	84		statement as to the current status of the project, contract, purpose etc. for 6
86	85		which the carry forward was originally requested no later than thirty (30) 7
87	86		days prior to the time the Agency, Board, Commission or Institution presents 8
88	87		its budget request to the Arkansas Legislative Council/Joint Budget 9
89	88		Committee; and 10
90	89		(4) Thereupon, the Department of Finance and Administration shall include 11
91	90		all information obtained in item (3) above in the budget manuals and/or a 12
92	91		statement of non-compliance by the Agency, Board, Commission or Institution. 13
93	92		The provisions of this section shall be in effect only from July 1, 2024 14
94	93		2025 through June 30, 2025 2026. 15

96	95		SECTION 4. COMPLIANCE WITH OTHER LAWS. Disbursement of funds 17
97	96		authorized by this act shall be limited to the appropriation for such agency 18
98	97		and funds made available by law for the support of such appropriations; and 19
99	98		the restrictions of the State Procurement Law, the General Accounting and 20
100	99		Budgetary Procedures Law, the Revenue Stabilization Law, the Regular Salary 21
101	100		Procedures and Restrictions Act, or their successors, and other fiscal 22
102	101		control laws of this State, where applicable, and regulations promulgated by 23
103	102		the Department of Finance and Administration, as authorized by law, shall be 24
104	103		strictly complied with in disbursement of said funds. 25

106	105		SECTION 5. LEGISLATIVE INTENT. It is the intent of the General 27
107	106		Assembly that any funds disbursed under the authority of the appropriations 28
108	107		contained in this act shall be in compliance with the stated reasons for 29
109	108		which this act was adopted, as evidenced by the Agency Requests, Executive 30
110	109		Recommendations and Legislative Recommendations contained in the budget 31
111	110		manuals prepared by the Department of Finance and Administration, letters, or 32
112	111		summarized oral testimony in the official minutes of the Arkansas Legislative 33
113	112		Council or Joint Budget Committee which relate to its passage and adoption. 34

115	114		SECTION 6. EMERGENCY CLAUSE. It is found and determined by the General 36 HB1093

118	117		Assembly, that the Constitution of the State of Arkansas prohibits the 1
119	118		appropriation of funds for more than a one (1) year period; that the 2
120	119		effectiveness of this Act on July 1, 2025 is essential to the operation of 3
121	120		the agency for which the appropriations in this Act are provided, and that in 4
122	121		the event of an extension of the legislative session, the delay in the 5
123	122		effective date of this Act beyond July 1, 2025 could work irreparable harm 6
124	123		upon the proper administration and provision of essential governmental 7
125	124		programs. Therefore, an emergency is hereby declared to exist and this Act 8
126	125		being necessary for the immediate preservation of the public peace, health 9
127	126		and safety shall be in full force and effect from and after July 1, 2025. 10
