2524 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS: 22

2726 SECTION 1. REGULAR SALARIES. There is hereby established for the 24
2827 Department of Health - Health Services Permit Agency for the 2025-2026 fiscal 25

4342 SECTION 2. APPROPRIATION - STATE OPERATIONS. There is hereby 2
4443 appropriated, to the Department of Health , to be payable from the 3

6160 SECTION 3. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS 20
6261 CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. CARRY 21
6362 FORWARD. Any unexpended balance of funds generated by fees and fines pursuant 22
6463 to Arkansas Code 20-8-103 et. seq. deposited into the Miscellaneous Agencies 23
6564 Fund Account which remain at the close of each state fiscal year shall be 24
6665 carried forward to the next state fiscal year to be used for the same intent 25
6766 and purposes as set forth in law. 26
6867 Any carry forward of unexpended balance funding as authorized herein, may 27
6968 be carried forward under the following conditions: 28
7069 (1) Prior to June 30, 2025 2026 the Agency shall by written statement set 29
7170 forth its reason(s) for the need to carry forward said funding to the 30
7271 Department of Finance and Administration Office of Budget; 31
7372 (2) The Department of Finance and Administration Office of Budget shall 32
7473 report to the Arkansas Legislative Council all amounts carried forward by the 33
7574 September Arkansas Legislative Council or Joint Budget Committee meeting, 34
7675 which report shall include the name of the Agency, Board, Commission or 35
7776 Institution and the amount of the funding carried forward, the program name 36 HB1093

8079 or line item, the funding source of that appropriation and a copy of the 1
8180 written request set forth in (1) above; 2
8281 (3) Each Agency, Board, Commission or Institution shall provide a written 3
8382 report to the Arkansas Legislative Council or Joint Budget Committee 4
8483 containing all information set forth in item (2) above, along with a written 5
8584 statement as to the current status of the project, contract, purpose etc. for 6
8685 which the carry forward was originally requested no later than thirty (30) 7
8786 days prior to the time the Agency, Board, Commission or Institution presents 8
8887 its budget request to the Arkansas Legislative Council/Joint Budget 9
8988 Committee; and 10
9089 (4) Thereupon, the Department of Finance and Administration shall include 11
9190 all information obtained in item (3) above in the budget manuals and/or a 12
9291 statement of non-compliance by the Agency, Board, Commission or Institution. 13
9392 The provisions of this section shall be in effect only from July 1, 2024 14
9493 2025 through June 30, 2025 2026. 15

9695 SECTION 4. COMPLIANCE WITH OTHER LAWS. Disbursement of funds 17
9796 authorized by this act shall be limited to the appropriation for such agency 18
9897 and funds made available by law for the support of such appropriations; and 19
9998 the restrictions of the State Procurement Law, the General Accounting and 20
10099 Budgetary Procedures Law, the Revenue Stabilization Law, the Regular Salary 21
101100 Procedures and Restrictions Act, or their successors, and other fiscal 22
102101 control laws of this State, where applicable, and regulations promulgated by 23
103102 the Department of Finance and Administration, as authorized by law, shall be 24
104103 strictly complied with in disbursement of said funds. 25

106105 SECTION 5. LEGISLATIVE INTENT. It is the intent of the General 27
107106 Assembly that any funds disbursed under the authority of the appropriations 28
108107 contained in this act shall be in compliance with the stated reasons for 29
109108 which this act was adopted, as evidenced by the Agency Requests, Executive 30
110109 Recommendations and Legislative Recommendations contained in the budget 31
111110 manuals prepared by the Department of Finance and Administration, letters, or 32
112111 summarized oral testimony in the official minutes of the Arkansas Legislative 33
113112 Council or Joint Budget Committee which relate to its passage and adoption. 34

115114 SECTION 6. EMERGENCY CLAUSE. It is found and determined by the General 36 HB1093

118117 Assembly, that the Constitution of the State of Arkansas prohibits the 1
119118 appropriation of funds for more than a one (1) year period; that the 2
120119 effectiveness of this Act on July 1, 2025 is essential to the operation of 3
121120 the agency for which the appropriations in this Act are provided, and that in 4
122121 the event of an extension of the legislative session, the delay in the 5
123122 effective date of this Act beyond July 1, 2025 could work irreparable harm 6
124123 upon the proper administration and provision of essential governmental 7
125124 programs. Therefore, an emergency is hereby declared to exist and this Act 8
126125 being necessary for the immediate preservation of the public peace, health 9
127126 and safety shall be in full force and effect from and after July 1, 2025. 10
