232+ (a)(1) Determining the maximum number of employees, the maximum amount 2
233+of appropriation, for what purposes an appropriation is authorized, and 3
234+general revenue funding for a state agency each fiscal year is the 4
235+prerogative of the General Assembly. 5
236+ (2) The purposes of subsection (a) of this section are typically 6
237+accomplished by: 7
238+ (A) Identifying the purpose in the appropriation act; 8
239+ (B) Delineating such maximums in the appropriation act for a 9
240+state agency; and 10
241+ (C) Delineating the general revenue allocations authorized for 11
242+each fund and fund account by amendment to the revenue stabilization law. 12
243+ (3) It is both necessary and appropriate that the General Assembly 13
244+restrict the use of appropriations authorized in this act. 14
245+ (b)(1) Upon the request of the Governor or the General Assembly, the 15
246+Department of Human Services shall request a waiver from the federal 16
247+government to: 17
248+ (A) Restrict the financial assistance granted to a recipient of 18
249+the Temporary Assistance for Needy Families Program or its successor program 19
250+to purchase goods and services that are considered essential and necessary 20
251+for the welfare of the family, including without limitation: 21
252+ (i) Food; 22
253+ (ii) Clothing; 23
254+ (iii) Housing; 24
255+ (iv) Utilities; 25
256+ (v) Child care; and 26
257+ (vi) Incidentals, including without limitation 27
258+transportation and medicine or medical supplies or equipment not covered by 28
259+either the Arkansas Medicaid Program or the health benefit plan of the 29
260+individual; and 30
261+ (B) Restrict the cash withdrawal from an electronic benefit 31
262+transfer card account that receives financial assistance under the Temporary 32
263+Assistance for Needy Families Program or its successor program by electronic 33
264+benefit transfer system. 34
265+ (2) If the federal government denies the waiver application, this 35

276+ SECTION 11. COMPLIANCE WITH OTHER LAWS. Disbursement of funds 8
277+authorized by this act shall be limited to the appropriation for such agency 9
278+and funds made available by law for the support of such appropriations; and 10
279+the restrictions of the State Procurement Law, the General Accounting and 11
280+Budgetary Procedures Law, the Revenue Stabilization Law, the Regular Salary 12
281+Procedures and Restrictions Act, or their successors, and other fiscal 13
282+control laws of this State, where applicable, and regulations promulgated by 14
283+the Department of Finance and Administration, as authorized by law, shall be 15
284+strictly complied with in disbursement of said funds. 16

286+ SECTION 12. LEGISLATIVE INTENT. It is the intent of the General 18
287+Assembly that any funds disbursed under the authority of the appropriations 19
288+contained in this act shall be in compliance with the stated reasons for 20
289+which this act was adopted, as evidenced by the Agency Requests, Executive 21
290+Recommendations and Legislative Recommendations contained in the budget 22
291+manuals prepared by the Department of Finance and Administration, letters, or 23
292+summarized oral testimony in the official minutes of the Arkansas Legislative 24
293+Council or Joint Budget Committee which relate to its passage and adoption. 25

295+ SECTION 13. EMERGENCY CLAUSE. It is found and determined by the 27
296+General Assembly, that the Constitution of the State of Arkansas prohibits 28
297+the appropriation of funds for more than a one (1) year period; that the 29
298+effectiveness of this Act on July 1, 2025 is essential to the operation of 30
299+the agency for which the appropriations in this Act are provided, and that in 31
300+the event of an extension of the legislative session, the delay in the 32
301+effective date of this Act beyond July 1, 2025 could work irreparable harm 33
302+upon the proper administration and provision of essential governmental 34
303+programs. Therefore, an emergency is hereby declared to exist and this Act 35

286-transportation and medicine or medical supplies or equipment not covered by 2
287-either the Arkansas Medicaid Program or the health benefit plan of the 3
288-individual; and 4
289- (B) Restrict the cash withdrawal from an electronic benefit 5
290-transfer card account that receives financial assistance under the Temporary 6
291-Assistance for Needy Families Program or its successor program by electronic 7
292-benefit transfer system. 8
293- (2) If the federal government denies the waiver application, this 9
294-section shall not be implemented. 10
295- (3) If the division does not request a wavier under subdivision 11
296-(b)(1) of this section, the department shall not allocate, budget, expend, or 12
297-utilize appropriations under this act for the participation of persons in the 13
298-Temporary Assistance for Needy Families Program. 14
299- The provisions of this section shall be in effect only from July 1, 2024 15
300-2025 through June 30, 2025 2026. 16

302- SECTION 12. COMPLIANCE WITH OTHER LAWS. Disbursement of funds 18
303-authorized by this act shall be limited to the appropriation for such agency 19
304-and funds made available by law for the support of such appropriations; and 20
305-the restrictions of the State Procurement Law, the General Accounting and 21
306-Budgetary Procedures Law, the Revenue Stabilization Law, the Regular Salary 22
307-Procedures and Restrictions Act, or their successors, and other fiscal 23
308-control laws of this State, where applicable, and regulations promulgated by 24
309-the Department of Finance and Administration, as authorized by law, shall be 25
310-strictly complied with in disbursement of said funds. 26

312- SECTION 13. LEGISLATIVE INTENT. It is the intent of the General 28
313-Assembly that any funds disbursed under the authority of the appropriations 29
314-contained in this act shall be in compliance with the stated reasons for 30
315-which this act was adopted, as evidenced by the Agency Requests, Executive 31
316-Recommendations and Legislative Recommendations contained in the budget 32
317-manuals prepared by the Department of Finance and Administration, letters, or 33
318-summarized oral testimony in the official minutes of the Arkansas Legislative 34
319-Council or Joint Budget Committee which relate to its passage and adoption. 35

325- SECTION 14. EMERGENCY CLAUSE. It is found and determined by the 1
326-General Assembly, that the Constitution of the State of Arkansas prohibits 2
327-the appropriation of funds for more than a one (1) year period; that the 3
328-effectiveness of this Act on July 1, 2025 is essential to the operation of 4
329-the agency for which the appropriations in this Act are provided, and that in 5
330-the event of an extension of the legislative session, the delay in the 6
331-effective date of this Act beyond July 1, 2025 could work irreparable harm 7
332-upon the proper administration and provision of essential governmental 8
333-programs. Therefore, an emergency is hereby declared to exist and this Act 9
334-being necessary for the immediate preservation of the public peace, health 10
335-and safety shall be in full force and effect from and after July 1, 2025. 11
