34 | 34 | | organization, a public organization, a nonprofit organization, or a for -32 |

59 | 59 | | (A) An employee of a healthcare facility; or 19 |
---|
60 | 60 | | (B) A person who is licensed, certified, or otherwise 20 |
---|
61 | 61 | | authorized by the laws of this state to administer health care in the 21 |
---|
62 | 62 | | ordinary course of the practice of his or her profession; and 22 |
---|
63 | 63 | | (3) "Healthcare service" means clinically related services 23 |
---|
64 | 64 | | provided within this state to a person, including without limitation 24 |
---|
65 | 65 | | diagnostic, treatment, or rehabilitative services and alcohol, drug abuse, 25 |
---|
66 | 66 | | and mental health services. 26 |
---|
67 | 67 | | (b) A healthcare professional who is providing a healthcare service 27 |
---|
68 | 68 | | and is otherwise lawfully acting is immune from criminal liability for any 28 |
---|
69 | 69 | | harm or damages to the person receiving the healthcare service alleged to 29 |
---|
70 | 70 | | arise from a negligent act or omission related to providing the healthcare 30 |
---|
71 | 71 | | service. 31 |
---|
72 | 72 | | (c) This section does not amend, repeal, or alter any other immunity, 32 |
---|
73 | 73 | | defense, limitation of liability, or procedure available or required under 33 |
---|
74 | 74 | | any other law or contract. 34 |
