2725 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS: 23

2927 SECTION 1. Arkansas Code Title 20, Chapter 77, Subchapter 27, is 25
3028 amended to add an additional section to read as follows: 26
3129 20-77-2709. Independent assessments for home - and community-based 27

3331 (a) The Department of Human Services shall implement an abbreviated 29
34-independent assessment process for beneficiaries who have been previously 30
35-approved for services through an independent assessment, including without 31
36-limitation a desk review, for beneficiaries who have chronic, long -term 32
37-conditions and receive services through enrollment in a risk -based provider 33
38-organization. 34
39- (b) The department shall apply for any federal waiver, Medicaid state 35
