AN ACT TO CREATE THE BABY OLIVIA ACT; AND FOR OTHER 11 
PURPOSES. 12

TO CREATE THE BABY OLIVIA ACT. 16

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS: 18 
 19 
 SECTION 1.  Arkansas Code Title 6, Chapter 16, Subchapter 10, is 20 
amended to add an additional section to read as follows: 21 
 6-16-1008.  Human growth and development education. 22 
 (a)  As used in this section, "human growth and development discussion" 23 
means an oral, written, or digital lesson, lecture, or presentation regarding 24 
human biology as it relates to pregnancy and human development inside the 25 
womb. 26 
 (b)(1)  Each public school district and open -enrollment public charter 27 
school shall incorporate a human growth and development discussion into an 28 
existing health and safety course, beginning no later than the fifth grade. 29 
 (2)  The human growth and development discussion required by 30 
subdivision (b)(1) of this section shall include: 31 
 (A)  A high-definition ultrasound video that is at least 32 
three (3) minutes in duration, which shows the brain, heart, sex organs, and 33 
other vital organs in early fetal development; and 34 
 (B)  The "Meet Baby Olivia" video developed by Live Action, 35 
which depicts the process of fertilization and every stage of human 36    	HB1180

development inside the uterus and notes significant markers in cell growth 1 
and organ development for every significant marker of pregnancy until birth. 2 
 (c)(1)  Acknowledging the interest of the State of Arkansas in 3 
safeguarding the health and well -being of its residents, the Attorney General 4 
may bring a civil action in the name of the state, as parens patriae on 5 
behalf of natural persons residing in this state, to enforce this section. 6 
 (2)  The Attorney General may bring a cause of action for 7 
injunctive relief and damages, as appropriate, on behalf of a resident of the 8 
State of Arkansas against a person or an entity that violates this section. 9 
 10 
 SECTION 2.  Arkansas Code § 6 -18-703(a)(3), concerning information and 11 
services provided by school -based health clinics that offer sex education, is 12 
amended to read as follows: 13 
 (3)(A) Schools that offer sex education in school -based health 14 
clinics shall include instruction: 15 
 (i)  Instruction in sexual abstinence ,; and no funds 16 
 (ii)  A human growth and development discussion, as 17 
defined in § 6-16-1008(a), which shall include: 18 
 (a)  A high-definition ultrasound video that is 19 
at least three (3) minutes in duration depicting the brain, heart, sex 20 
organs, and other vital organs in early fetal development; and 21 
 (b)  The "Meet Baby Olivia" video developed by 22 
Live Action, which depicts the process of fertilization and every stage of 23 
human development inside the uterus and notes significant markers in cell 24 
growth and organ development for every significant marker of pregnancy until 25 
birth. 26 
 (B)  Funds shall not be utilized for abortion referral. 27 
 28 
 SECTION 3.  Arkansas Code § 6 -18-703, concerning information and 29 
services provided by school -based health clinics, is amended to add an 30 
additional subsection to read as follows: 31 
 (f)(1)  Acknowledging the interest of the State of Arkansas in 32 
safeguarding the health and well -being of its residents, the Attorney General 33 
may bring a civil action in the name of the state, as parens patriae on 34 
behalf of natural persons residing in this state, to enforce this section. 35
