2321 SECTION 1. Arkansas Code Title 17, Chapter 87, is amended to add an 19

28- This subchapter shall be known and may be cited as "the "Registered" 24

3230 The purpose of this subchapter is to ensure the health, safety, and 28
3331 welfare of the public by providing for the accurate, cost -effective, and safe 29
3432 utilization of dialysis patient care technicians in the administration of 30

3735 17-87-903. Definition. 33
3836 As used in this subchapter, "dialysis patient care technician" means a 34
3937 person who meets the requirements of § 17 -87-905. 35

47- A dialysis patient care technician may administer direct patient care 3
48-and hemodialysis, including administering associated medications and central 4
49-venous catheter access and care, under the authority of a registered nurse 5
50-licensed in this state who may delegate tasks based on nursing judgment to a 6
51-dialysis patient care technician based on the dialysis patient care 7
52-technician’s education, knowledge, training, and skill. 8
43+ A dialysis patient care technician may administer hemodialysis, 3
44+including administering associated medications and central venous catheter 4
45+access and care, under the authority of a registered nurse licensed in this 5
46+state who may delegate tasks based on nursing judgment to a dialysis patient 6
47+care technician based on the dialysis patient care technician’s education, 7

5450 17-87-905. Registration. 10
5551 (a) To register as a dialysis patient care technician, an individual 11
5652 shall: 12
5753 (1) Possess a high school diploma or a general educational 13
5854 development certificate; 14
59- (2) Demonstrate that he or she: 15
60- (A) Is employed as a dialysis patient care technician; 16
61- (B) Is enrolled in a training course that follows national 17
55+ (2) Demonstrate that he or she is: 15
56+ (A) Employed as a dialysis patient care technician; or 16
57+ (B) Enrolled in a training course that follows national 17
6258 recommendations for dialysis patient care technicians and is conducted 18
63-primarily in a work setting; or 19
64- (C) Has completed a training course that follows national 20
65-recommendations for dialysis patient care technicians with verification of 21
66-competency and a skills checklist signed by the medical director of the 22
67-facility that employs the person; 23
68- (3) (A) Obtain national certification by successful passage of 24
69-a national certification examination within eighteen (18) months of becoming 25
70-employed as a dialysis patient care technician. 26
71- (B)(i) A dialysis patient care technician shall recertify 27
72-national certification at intervals required by the organization providing 28
73-the certification examination. 29
74- (ii) The intervals required under subdivision 30
75-(a)(3)(B)(i) of this section shall include no fewer than thirty (30) and no 31
76-more than forty (40) patient contact hours since the previous certification 32
77-or recertification; 33
78- (4) Submit an application with the Arkansas State Board of 34
79-Nursing; and 35

81+ (c)(1) An applicant or a dialysis patient care technician may report 3
82+any pardon or setting aside of a conviction to the board. 4
83+ (2) If a pardon or setting aside has been obtained, the 5
84+conviction for which the pardon or setting aside was obtained shall not be 6
85+maintained on the Dialysis Patient Care Technician Registry created under § 7
86+17-87-906. 8
87+ (d) If a person registered as a dialysis patient care technician 9
88+becomes licensed as a registered nurse or licensed practical nurse, his or 10
89+her registration as a dialysis patient care technician shall terminate as of 11
90+the date of licensure as a registered nurse or licensed practical nurse. 12

94+ (a)(1) The Arkansas State Board of Nursing shall list each dialysis 16
95+patient care technician registrant on a registry to be named the "Dialysis 17
96+Patient Care Technician Registry". 18
97+ (2) A listing in the registry is valid for the term of the 19
98+registration and upon renewal unless the listing is refused renewal or is 20
99+removed. 21
100+ (b) The registry shall contain the following information on each 22
101+person who is a registered dialysis patient care technician: 23
102+ (1) The individual’s full name; 24
103+ (2) Any conviction of a felony or misdemeanor reported to the 25
104+board; 26
105+ (3) A certificate showing completion of a nationally recognized 27
106+training program; and 28
107+ (4) A certificate of completion of a nationally commercially 29
108+available dialysis patient care technician certification examination. 30

112+ (1) Require a dialysis patient care technician to register as a 34
113+medication assistive person under § 17 -87-701 et seq.; or 35

101- (e)(1) The board shall refuse to register or shall revoke the 17
102-registration of a person who would be disqualified from employment under § 18
103-20-33-213. 19
104- (2) The board may suspend, revoke, or refuse to issue or renew a 20
105-registration of a dialysis patient care technician for: 21
106- (A) Securing a registration under this subchapter through 22
107-fraud or deceit; 23
108- (B) Unprofessional conduct, unethical conduct, gross 24
109-ignorance, or inefficiency in the conduct of his or her practice; 25
110- (C) Using a false name or an alias in his or her practice; 26
111- (D) Violating any provision of this subchapter; or 27
112- (E) Failing to comply with any of the requirements for 28
113-registration. 29
114- (3) Proceedings under this section shall be conducted in 30
115-accordance with the Arkansas Administrative Procedure Act, § 25 -15-201 et 31
116-seq. 32
