2523 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS: 21

2725 SECTION 1. Arkansas Code § 6 -18-317 is repealed. 23
2826 6-18-317. Prohibited transfers. 24
2927 (a) Boards of directors of local school districts are prohibited from 25
3028 granting legal transfers under § 6-18-316 when: 26
3129 (1) Either the resident district or the receiving district is 27
3230 under a desegregation -related court order; and 28
3331 (2) The transfer in question would violate the court order. 29
3432 (b) Each form filed with the Division of Elementary and Secondary 30
3533 Education reporting a legal student transfer must be accompanied by an 31
3634 affidavit signed by each member of both school district boards of directors 32
3735 stating that the transfer does not violate the prohibition set forth in 33
3836 subsection (a) of this section. 34
3937 (c) If the transfer fails to comply with subsection (b) of this 35
