BY THE ARKANSAS PUBLIC EMPLOYEES' 21

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS: 24

SECTION 1. Arkansas Code § 26-36-303(1)(A), concerning the definition 26
of "claimant agency" applicable to setoffs against state tax refunds, is 27
amended to add additional subdivisions to read as follows: 28
(xxvi) Arkansas Judicial Retirement System; and 29
(xxvii) State Police Retirement System. 30

SECTION 2. Arkansas Code § 26 -36-303(2)(H), concerning the definition 32
of "debt" applicable to setoffs against state tax refunds, is amended to read 33
as follows: 34
(H) Any overpayment of a monthly benefit or lump sum from 35
a state retirement system administered by the Arkansas Public Employees' 36 HB1208
