| 24 | 23 | | SECTION 1. Arkansas Code § 20 -10-702 is amended to read as follows: 21 |

| 27 | 26 | | (1) “General nursing experience” means nursing experience 24 |
|---|
| 28 | 27 | | obtained through employment, internship, externship, or other means and 25 |
|---|
| 29 | 28 | | includes without limitation employment in a nursing assistant education 26 |
|---|
| 30 | 29 | | program or employment in or supervision of nursing students in a nursing 27 |
|---|
| 31 | 30 | | facility or unit, a geriatrics department excluding a geriatric psychiatry 28 |
|---|
| 32 | 31 | | department, a long-term acute care hospital, home healthcare, hospice care, 29 |
|---|
| 33 | 32 | | or other long-term care setting; 30 |
|---|
| 34 | 33 | | (2) “Long-term care facility” means a nursing home, a 31 |
|---|
| 35 | 34 | | residential care facility, an assisted living facility, an adult daycare 32 |
|---|
| 36 | 35 | | facility, or any other facility which provides long -term medical or personal 33 |
|---|
| 37 | 36 | | care; and 34 |
|---|
| 38 | 37 | | (2)(3) “Primary instructor” means a registered nurse who: 35 |
|---|

| 44 | 43 | | Licensure Compact, §17 -87-601 et seq., to Arkansas and meets all requirements 3 |
|---|
| 45 | 44 | | for licensure in Arkansas; 4 |
|---|
| 46 | 45 | | (B) Does not have any disciplinary action regarding his or 5 |
|---|
| 47 | 46 | | her license by the licensing entity or authority; and 6 |
|---|
| 48 | 47 | | (C)(i) Possesses a minimum of two (2) years' general 7 |
|---|
| 49 | 48 | | nursing experience as a registered nurse including at least one (1) year of 8 |
|---|
| 50 | 49 | | long-term care nursing services in a nursing facility setting within the last 9 |
|---|
| 51 | 50 | | five (5) ten (10) years; and 10 |
|---|
| 52 | 51 | | (D) Annually attends an eight (8) hour class authorized by 11 |
|---|
| 53 | 52 | | the Department of Human Services regarding updates to applicable laws and 12 |
|---|
| 54 | 53 | | rules, best practices, and common issues encountered in long -term care 13 |
|---|
| 55 | 54 | | facilities. 14 |
|---|
| 56 | 55 | | (ii) As used in this section, “general nursing 15 |
|---|
| 57 | 56 | | experience” may include without limitation employment in a nursing assistant 16 |
|---|
| 58 | 57 | | education program or employment in or supervision of nursing students in a 17 |
|---|
| 59 | 58 | | nursing facility or unit, geriatrics department excluding a geriatric 18 |
|---|
| 60 | 59 | | psychiatry department, long -term acute care hospital, home healthcare, 19 |
