2221 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS: 19

2423 SECTION 1. Arkansas Code § 20 -10-702 is amended to read as follows: 21
2524 20-10-702. Definitions. 22
2625 As used in this subchapter: 23
2726 (1) “General nursing experience” means nursing experience 24
2827 obtained through employment, internship, externship, or other means and 25
2928 includes without limitation employment in a nursing assistant education 26
3029 program or employment in or supervision of nursing students in a nursing 27
3130 facility or unit, a geriatrics department excluding a geriatric psychiatry 28
3231 department, a long-term acute care hospital, home healthcare, hospice care, 29
3332 or other long-term care setting; 30
3433 (2) “Long-term care facility” means a nursing home, a 31
3534 residential care facility, an assisted living facility, an adult daycare 32
3635 facility, or any other facility which provides long -term medical or personal 33
3736 care; and 34
3837 (2)(3) “Primary instructor” means a registered nurse who: 35
3938 (A)(i) Is licensed in this state; or 36 HB1214

4241 (ii) Holds a multistate privilege to practice if the 1
4342 registered nurse moves from a state that has joined the Interstate Nurse 2
4443 Licensure Compact, §17 -87-601 et seq., to Arkansas and meets all requirements 3
4544 for licensure in Arkansas; 4
4645 (B) Does not have any disciplinary action regarding his or 5
4746 her license by the licensing entity or authority; and 6
4847 (C)(i) Possesses a minimum of two (2) years' general 7
4948 nursing experience as a registered nurse including at least one (1) year of 8
5049 long-term care nursing services in a nursing facility setting within the last 9
5150 five (5) ten (10) years; and 10
5251 (D) Annually attends an eight (8) hour class authorized by 11
5352 the Department of Human Services regarding updates to applicable laws and 12
5453 rules, best practices, and common issues encountered in long -term care 13
5554 facilities. 14
5655 (ii) As used in this section, “general nursing 15
5756 experience” may include without limitation employment in a nursing assistant 16
5857 education program or employment in or supervision of nursing students in a 17
5958 nursing facility or unit, geriatrics department excluding a geriatric 18
6059 psychiatry department, long -term acute care hospital, home healthcare, 19
6160 hospice care, or other long -term care setting. 20
