2422 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS: 20

2624 SECTION 1. Arkansas Code Title 20, Chapter 77, Subchapter 1, is 22
2725 amended to add an additional section to read as follows: 23
2826 20-77-154. High complexity oral health care — Reimbursement — 24
2927 Definitions. 25
3028 (a) As used in this section: 26
3129 (1) "Healthcare provider" means: 27
3230 (A) An oral maxillofacial surgeon; 28
3331 (B) A dentist; 29
3432 (C) A dental specialist such as a endodontist, 30
3533 orthodontist, periodontist, or prosthodontist; 31
36- (D) An anesthesiologist or other anesthesia provider; 32
37- (E) A pediatric dentist; or 33
38- (F) Support staff for an oral maxillofacial surgeon, 34
39-dentist, specialty dentist, pediatric dentist, or anesthesiologist, or other 35

34+ (D) An anesthesiologist or other anesthesia provider; or 32

45- (2) "High complexity oral health care" means any oral health 1
46-care that is complicated due to: 2
47- (A) A craniofacial condition as diagnosed by a plastic 3
48-surgeon, oral and maxillofacial surgeon, otolaryngologist, or geneticist who 4
49-is a member of a nationally approved cleft -craniofacial team of the American 5
50-Cleft Palate-Craniofacial Association and has evaluated the patient; or 6
51- (B) An intellectual or developmental disability; and 7
52- (3) “Intellectual or developmental disability” means the same as 8
53-defined in § 20-48-202. 9
54- (b)(1) The Arkansas Medicaid Program shall reimburse the dental 10
55-schools who are accredited by the Commission on Dental Accreditation and 11
56-academic medical centers for dental and anesthesia costs not to exceed three 12
57-thousand seven hundred fifty dollars ($3,750) per episode of care for 13
58-individuals with high complexity oral health care who are eighteen (18) years 14
59-of age or older and who require sedation dentistry with an annual cap per 15
60-individual of five thousand dollars ($5,000). 16
61- (2) The dental and anesthesia costs under subdivision (b)(1) of 17
62-this section: 18
63- (A) Shall only be reflective of professional fees and 19
64-supply costs; and 20
65- (B) Shall not include discounts or rebates received by the 21
66-dental schools who are accredited by the Commission on Dental Accreditation 22
67-and academic medical centers. 23
68- (3) The dental and anesthesia costs under subdivision (b)(1) of 24
69-this section that exceed the annual cap of five thousand dollars ($5,000) may 25
70-be approved by the Department of Human Services through a request for an 26
71-extension of benefits. 27
72- (c) The department shall apply for any federal waiver, Medicaid state 28
73-plan amendment, or other authorization necessary to implement this section. 29

41+care that is complicated due to: 1
42+ (A) A craniofacial condition as diagnosed by an 2
43+otolaryngologist or by genetics testing; 3
44+ (B) An intellectual or developmental disability; or 4
45+ (C) An complex medical condition that significantly 5
46+impacts oral health, including without limitation diabetes, heart conditions, 6
47+severe allergies, radiation therapy side effects, or organ transplantation. 7
48+ (b)(1) The Arkansas Medicaid Program shall reimburse healthcare 8
49+providers in a dental school in this state that is accredited by the 9
50+Commission on Dental Accreditation for dental and anesthesia costs for 10
51+individuals who are twelve (12) years of age or older that require high 11
52+complexity oral health care or whose oral health care is complicated by 12
53+craniofacial conditions, intellectual or developmental disabilities, or 13
54+complex medical conditions. 14
55+ (2) The reimbursement shall be equal to one hundred one percent 15
56+(101%) of the actual costs incurred by the healthcare providers. 16
57+ (c) The Department of Human Services shall apply for any federal 17
58+waiver, Medicaid state plan amendment, or other authorization necessary to 18
59+implement this section. 19
