308307 YEAR 2020 BUDGET STABILIZATION LOAN REPAYMENT. 1
309308 (a) It is the intent of this section to provide for the repayment by 2
310309 Henderson State University of a loan received from the Budget Stabilization 3
311310 Trust Fund in fiscal year 2020. 4
312311 (b) As repayment for the outstanding loan received from the Budget 5
313312 Stabilization Trust Fund in fiscal year 2020, Henderson State University 6
314313 shall make payments of nine hundred fifty -eight thousand three hundred 7
315314 thirty-three dollars and thirty -three cents ($958,333.33) from any legal fund 8
316315 of Henderson State University to the Budget Stabilization Trust Fund on the 9
317316 following dates unless modifications are made under subsection (d) of this 10
318317 section: 11
319318 (1) December 1, 20245; 12
320319 (2) December 1, 20256; 13
321320 (3) December 1, 20267; 14
322321 (4) December 1, 20278; 15
323322 (5) December 1, 20289; and 16
324323 (6) December 1, 202930. 17
325324 (c) Henderson State University shall provide a report to the 18
326325 Legislative Council or, if the General Assembly is in regular, fiscal, or 19
327326 extraordinary session, the Joint Budget Committee, no later than June 30 of 20
328327 each year regarding the status of the loan received from the Budget 21
329328 Stabilization Trust Fund. 22
330329 (d)(1) Loan payments under subsection (b) of this section may be 23
331330 modified by the Legislative Council or, if the General Assembly is in 24
332331 regular, fiscal, or extraordinary session, the Joint Budget Committee, based 25
333332 upon its review of the status of the loan received from the Budget 26
334333 Stabilization Trust Fund. 27
335334 (2) A modification to a loan payment under subdivision (2)(A) of 28
336335 this section may include without limitation: 29
337336 (A) The amount of one (1) or more loan payments; and 30
338337 (B) The timing of one (1) or more loan payments. 31
339338 (e) This section shall expire upon the final payment by Henderson 32
340339 State University to the Budget Stabilization Trust Fund under subsection (b) 33

343342 SECTION 6. COMPLIANCE WITH OTHER LAWS. Disbursement of funds 36 HB1266

346345 authorized by this act shall be limited to the appropriation for such agency 1
347346 and funds made available by law for the support of such appropriations; and 2
348347 the restrictions of the State Procurement Law, the General Accounting and 3
349348 Budgetary Procedures Law, the Revenue Stabilization Law, the Regular Salary 4
350349 Procedures and Restrictions Act, the Higher Education Expenditure Restriction 5
351350 Act, or their successors, and other fiscal control laws of this State, where 6
352351 applicable, and regulations promulgated by the Department of Finance and 7
353352 Administration, as authorized by law, shall be strictly complied with in 8
354353 disbursement of said funds. 9

356355 SECTION 7. LEGISLATIVE INTENT. It is the intent of the General 11
357356 Assembly that any funds disbursed under the authority of the appropriations 12
358357 contained in this act shall be in compliance with the stated reasons for 13
359358 which this act was adopted, as evidenced by the Agency Requests, Executive 14
360359 Recommendations and Legislative Recommendations contained in the budget 15
361360 manuals prepared by the Department of Finance and Administration, letters, or 16
362361 summarized oral testimony in the official minutes of the Arkansas Legislative 17
363362 Council or Joint Budget Committee which relate to its passage and adoption. 18

365364 SECTION 8. EMERGENCY CLAUSE. It is found and determined by the General 20
366365 Assembly, that the Constitution of the State of Arkansas prohibits the 21
367366 appropriation of funds for more than a one (1) year period; that the 22
368367 effectiveness of this Act on July 1, 2025 is essential to the operation of 23
369368 the agency for which the appropriations in this Act are provided, and that in 24
370369 the event of an extension of the legislative session, the delay in the 25
371370 effective date of this Act beyond July 1, 2025 could work irreparable harm 26
372371 upon the proper administration and provision of essential governmental 27
373372 programs. Therefore, an emergency is hereby declared to exist and this Act 28
374373 being necessary for the immediate preservation of the public peace, health 29
375374 and safety shall be in full force and effect from and after July 1, 2025. 30
