2220 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS: 18

2422 SECTION 1. Arkansas Code ยง 21-8-304 is amended to read as follows: 20
2523 21-8-304. Prohibited activities. 21
2624 (a) No public servant shall use or attempt to use his or her official 22
2725 position to secure special privileges or exemptions for himself or herself or 23
2826 his or her spouse, child, parents, or other persons standing in the first 24
2927 degree of relationship, or for those with whom he or she has a substantial 25
3028 financial relationship that are not available to others except as may be 26
3129 otherwise provided by law. 27
3230 (b) No public servant shall accept employment or engage in any public 28
3331 or professional activity while serving as a public official which he or she 29
3432 might reasonably expect would require or induce him or her to disclose any 30
3533 information acquired by him or her by reason of his or her official position 31
3634 that is declared by law or rule to be confidential. 32
3735 (c) No public servant shall disclose any such information gained by 33
3836 reason of his or her position, nor shall he or she otherwise use such 34
3937 information for his or her personal gain or benefit. 35

45-inspection to be conducted by a governmental body to any person, business, or 1
46-entity subject to an inspection when the purpose of the disclosure is to 2
47-improperly influence the outcome of the inspection. 3
48- (2) A public employee violates subdivision (d)(1) of this 4
49-section when he or she knowingly communicates information, directly or 5
50-indirectly, regarding the timing, scope, or details of an upcoming inspection 6
51-with the intent to: 7
52- (A) Alter or manipulate conditions to evade detection of 8
53-noncompliance or violations; 9
54- (B) Provide an unfair advantage to the inspected party; or 10
55- (C) Otherwise interfere with the integrity or impartiality 11
56-of the inspection process. 12
57- (3) A public employee found in violation of subdivision (d)(1) 13
58-of this section shall be subject to disciplinary action, including without 14
59-limitation suspension, termination, and any penalties provided by law. 15
60- (4) Subdivision (d)(1) of this section does not prohibit: 16
61- (A) Routine scheduling disclosures required by law; 17
62- (B) Public safety notifications; or 18
63- (C) Official communications necessary for the proper 19
64-administration of inspections. 20
