27	27	BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS: 25

29	29	SECTION 1. Arkansas Code § 12 -13-108 is amended to read as follows: 27
30	30	12-13-108. Ex officio deputies. 28
31	31	(a) All The State Fire Marshal and all mayors, members of fire 29
32	32	departments, and peace officers shall be ex officio deputies to the Director 30
33	33	of the Division of Arkansas State Police. 31
34	34	(b) They An ex officio deputy shall be subject to the duties and 32
35	35	obligations imposed by law in fire prevention and in the investigation of the 33
36	36	cause, origin, and circumstances of fires within their jurisdiction. 34

41	41	investigations, is amended to read as follows: 1
42	42	(a)(1) When the Director of the Division of Arkansas State Police or 2
43	43	any officer or deputy has reason to believe that a crime or other offense has 3
44	44	been committed in connection with any fire, the director or his or her deputy 4
45	45	may conduct an inquiry in relation thereto. 5
46	46	(2) The State Fire Marshal may request that the Division of 6
47	47	Arkansas State Police conduct an inquiry under this section if he or she has 7
48	48	reason to believe arson has been committed. 8
