28 | 28 | | SECTION 1. Arkansas Code § 12 -9-209 is amended to read as follows: 26 |

37 | 37 | | training in a position requiring a certificate of training from a state -35 |

45 | 45 | | commission for all or a portion of the costs or expenses incurred by the 5 |

46 | 46 | | county, city, town, or state agency, or other law enforcement agency 6 |

47 | 47 | | recognized by the commission for the training of the law enforcement officer 7 |
---|
48 | 48 | | at the state-funded or municipally operated law enforcement training academy, 8 |
---|
49 | 49 | | unless the law enforcement officer has been terminated by the county, city, 9 |
---|
50 | 50 | | town, or state agency, or other law enforcement agency recognized by the 10 |
---|
51 | 51 | | commission that paid the costs or expenses of training, in which case no 11 |
---|
52 | 52 | | reimbursement is required from the county, city, town, or state agency, or 12 |
---|
53 | 53 | | other law enforcement agency recognized by the commission employing the law 13 |
---|
54 | 54 | | enforcement officer. 14 |
---|
55 | 55 | | (2) Reimbursement may be sought only from the first county, 15 |
---|
56 | 56 | | city, town, or state agency, or other law enforcement agency recognized by 16 |
---|
57 | 57 | | the commission that employed the law enforcement officer after the county, 17 |
---|
58 | 58 | | city, town, or state agency, or other law enforcement agency recognized by 18 |
---|
59 | 59 | | the commission paid the costs or expenses of training. 19 |
---|
60 | 60 | | (3) Reimbursement shall include any salary, travel expenses, 20 |
---|
61 | 61 | | food, lodging, or other costs required to be paid by the county, city, town, 21 |
---|
62 | 62 | | or state agency, or other law enforcement agency recognized by the commission 22 |
---|
63 | 63 | | as follows: 23 |
---|
64 | 64 | | (A) If the law enforcement officer is employed within two 24 |
---|
65 | 65 | | (2) months after completion of the training, the employing agency shall 25 |
---|
66 | 66 | | reimburse the total of the costs or expenses of training; 26 |
---|
67 | 67 | | (B) If the law enforcement officer is employed more than 27 |
---|
68 | 68 | | two (2) months but not more than six (6) months after completion of the 28 |
---|
69 | 69 | | training, the employing agency shall reimburse eighty percent (80%) of the 29 |
---|
70 | 70 | | costs or expenses of training; 30 |
---|
71 | 71 | | (C) If the law enforcement officer is employed more than 31 |
---|
72 | 72 | | six (6) months but not more than ten (10) months after completion of the 32 |
---|
73 | 73 | | training, the employing agency shall reimburse sixty percent (60%) of the 33 |
---|
74 | 74 | | costs or expenses of training; 34 |
---|
75 | 75 | | (D) If the law enforcement officer is employed more than 35 |
---|
76 | 76 | | ten (10) months but not more than fourteen (14) months after completion of 36 HB1421 |

---|

81 | 81 | | (E) If the law enforcement officer is employed more than 3 |
---|
82 | 82 | | fourteen (14) months but not more than eighteen (18) months after completion 4 |
---|
83 | 83 | | of the training, the employing agency shall reimburse twenty percent (20%) of 5 |
---|
84 | 84 | | the costs or expenses of training. 6 |
---|
85 | 85 | | (b)(1) If any county, city, town, or state agency, or other law 7 |
---|
86 | 86 | | enforcement agency recognized by the commission that employs a law 8 |
---|
87 | 87 | | enforcement officer whose costs or expenses of training were paid by another 9 |
---|
88 | 88 | | county, city, town, or state agency, or other law enforcement agency 10 |
---|
89 | 89 | | recognized by the commission fails to make reimbursement for the costs or 11 |
---|
90 | 90 | | expenses of training as required in subsection (a) of this section, the 12 |
---|
91 | 91 | | county, city, town, or state agency, or other law enforcement agency 13 |
---|
92 | 92 | | recognized by the commission entitled to reimbursement shall notify the 14 |
---|
93 | 93 | | Treasurer of State. 15 |
---|
94 | 94 | | (2) The Treasurer of State shall then withhold the amount of the 16 |
---|
95 | 95 | | reimbursement due for training the law enforcement officer from the county or 17 |
---|
96 | 96 | | municipal aid of the employing county, city, town, or state agency, or other 18 |
---|
97 | 97 | | law enforcement agency recognized by the commission or from funds 19 |
---|
98 | 98 | | appropriated to the employing state agency and shall remit the amount to the 20 |
---|
99 | 99 | | county, city, town, or state agency, or other law enforcement agency 21 |
---|
100 | 100 | | recognized by the commission that is entitled to the reimbursement under the 22 |
---|
101 | 101 | | provisions of this section. 23 |
---|
102 | 102 | | (c)(1) A private community with a population of more than five 24 |
---|
103 | 103 | | thousand (5,000) persons that employs certified law enforcement officers is 25 |
---|
104 | 104 | | entitled to reimbursement under this section and may remit the reimbursed 26 |
---|
105 | 105 | | costs or expenses under subsection (a) of this section to an entity 27 |
---|
106 | 106 | | contracting with the private community that paid the training costs or 28 |
---|
107 | 107 | | expenses of the certified law enforcement officers. 29 |
---|
108 | 108 | | (2) As used in this subsection, “private community” means the 30 |
---|
109 | 109 | | same as defined in § 14 -14-814. 31 |
