2826 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS: 24

3028 SECTION 1. Arkansas Code ยง 20-15-1004(a), establishing quality 26
3129 standards for accreditation of facilities for mammography, is amended to read 27
3230 as follows: 28
3331 (a)(1) The Secretary of the Department of Health shall establish 29
3432 quality standards for accreditation of facilities wherein mammography may be 30
3533 conducted in accordance with according to the Mammography Quality Standards 31
3634 Act of 1992, Pub. L. No. 102 -539 (21 C.F.R. Part 900). 32
3735 (2) The standards applicable to the physician who interprets 33
3836 mammograms shall not be more stringent than those standards listed in the 34
3937 Mammography Quality Standards Act of 1992, Pub. L. No. 102 -539 (21 C.F.R. 35

45- (3)(A) An interpreting physician is not required to be on site 1
46-but shall be immediately available via telecommunication to interpret 2
47-diagnostic mammography to adhere to the quality standard requirements under 3
48-subdivision (a)(2) of this section. 4
49- (B) A patient shall sign a waiver acknowledging that a 5
50-diagnostic evaluation performed via telemedicine or remotely may have 6
51-limitations compared to an in -person diagnostic evaluation. 7
52- (C) The results of the diagnostic evaluation shall be 8
53-provided to the patient before the patient leaves the facility after the 9
54-completion of the diagnostic evaluation. 10

41+ (3) An interpreting physician is only required to adhere to the 1
42+quality standard requirements under subdivision (a)(2) of this section for 2
43+supervision, direct or otherwise, as established by the Arkansas State 3

56- SECTION 2. DO NOT CODIFY. Rule modification. 12
57- (a) The Department of Health shall modify all rules relating to 13
58-performing diagnostic mammography services and the accreditation of 14
59-facilities in which diagnostic mammography may be conducted to allow 15
60-interpreting physicians to be immediately available via telecommunication. 16
61- (b) The department shall remove a requirement to have the interpreting 17
62-physician physically on site for the performance of diagnostic mammography 18
