AN ACT CONCERNING RECURRING REPORTS SUBMITTED TO THE 9 
GENERAL ASSEMBLY; AND FOR OTHER PURPOSES.  10

CONCERNING RECURRING REPORTS SUBMITTED 14 
TO THE GENERAL ASSEMBLY. 15

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS: 17 
 18 
 SECTION 1.  Arkansas Code Title 25, Chapter 1, Subchapter 2, is amended 19 
to add an additional section to read as follows:  20 
 25-1-207.  Submission of recurring reports to General Assembly — 21 
Definition. 22 
 (a)  As used in this section, "recurring report" means a report that is 23 
to be filed more than one (1) time and is: 24 
 (1)  Required by statute; or 25 
 (2)  Requested by the General Assembly, one (1) or more 26 
committees or subcommittees of the General Assembly, or one (1) or more 27 
officers of the General Assembly.      28 
 (b)  If a state agency is required to file a recurring report with the 29 
General Assembly, one (1) or more committees or subcommittees of the General 30 
Assembly, or one (1) or more officers of the General Assembly, the state 31 
agency shall file the recurring report three (3) times in the required 32 
manner.   33 
 (c)(1)  Following the third submission of a recurring report under 34 
subsection (b) of this section, the state agency shall not file subsequent 35 
reports unless requested by the entity or individual receiving the report.   36    	HB1459

 (2)  Upon the third submission of a recurring report, the state 1 
agency shall inform the entity or individual receiving the report that no 2 
subsequent reports will be filed unless requested under subdivision (c)(1) of 3 
this section.  4 
 (d)  This section does not prohibit the General Assembly, one (1) or 5 
more committees or subcommittees of the General Assembly, or one (1) or more 6 
officers of the General Assembly from directing a state agency to resume 7 
filing a recurring report following the cessation of reporting under this 8 
section.   9

 SECTION 2.  DO NOT CODIFY.  IMPLEMENTATION.  11 
 (a)  Except as provided in subsection (b) of this section, this act 12 
shall be applied prospectively so that a state agency shall file a recurring 13 
report three (3) times on or following the effective date of this act before 14 
ceasing reporting under this act. 15 
 (b)  If the General Assembly, one (1) or more committees or 16 
subcommittees of the General Assembly, or one (1) or more officers of the 17 
General Assembly has received a report from a state agency more than three 18 
(3) times before the effective date of this act, the entity or individual may 19 
request that the state agency not file subsequent reports unless requested by 20 
the entity or individual.      21
