24-BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS: 20

26- SECTION 1. Arkansas Code Title 6, Chapter 16, Subchapter 1, is amended 22
27-to add an additional section to read as follows: 23
28- 6-16-163. Course credit recovery program — Limitation on credits 24
29-obtained. 25
30- (a) Beginning with the entering ninth grade class of 2025 -2026, a 26
31-student participating in a course credit recovery program in order to obtain 27
32-credit toward high school graduation requirements shall not obtain more than 28
33-ten (10) total credits in the course credit recovery program during grades 29
34-nine through twelve (9 -12). 30
35- (b) However, this section shall not apply to a: 31
36- (1) Student with an individualized education program if the 32
37-student's individualized education program includes a course recovery 33
38-program; 34
39- (2) Student who is in foster care; 35

46- (4) Student who is considered homeless under the McKinney -Vento 2
47-Homeless Assistance Act, 42 U.S.C. § 11431 et seq., as it existed on January 3

49- (5) Student who is in long -term placement in a mental health 5

51- (6) Student who is in long -term placement in a medical hospital 7
52-due to unforeseen circumstances, including without limitation a medical 8
53-procedure or an accident; 9
54- (7) Student who is pregnant; 10
55- (8) Student who is determined to be high -risk or in need of Tier 11
56-III intensive intervention services according to the Division of Elementary 12
57-and Secondary Education Alternative Education Process Guide; 13
58- (9) Student who is enrolled full -time in a statewide open -14
59-enrollment virtual charter school; 15
60- (10) Student who is being served or has been served in an 16
61-English as a Second Language program in grades nine through twelve (9 -12); or 17
62- (11) Student who is enrolled in a credit recovery open -18
63-enrollment public charter school. 19
64- (c) As used in this section, "long -term placement" means the placement 20
65-of a student in a mental health facility or medical hospital for prescribed 21
66-care that results in the student being absent from school for a cumulative 22
67-total of thirty (30) or more days during a single academic semester while the 23
68-student is enrolled in school and attempting to earn credit towards 24

27+ (a) A student participating in a course credit recovery program in 25
28+order to obtain credit toward high school graduation requirements shall not 26
29+obtain more than six (6) total hours of credit in the course credit recovery 27
30+program during grades nine through twelve (9 -12). 28
31+ (b) However, this section shall not apply to a student with an 29
32+individualized education program if the student's individualized education 30
33+program includes a course credit recovery program. 31
