2323 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS: 21

2525 SECTION 1. APPROPRIATION - PERPETUAL CARE CEMETERIES - GRANTS. There 23
2626 is hereby appropriated, to the Department of Commerce - State Insurance 24
2727 Department, to be payable from the cash fund deposited in the State Treasury 25
2828 as determined by the Chief Fiscal Officer of the State , the following: 26
2929 (A) for grants for structural maintenance, roads, drainage, fencing, 27
3030 irrigation, unpaid maintenance expense and other repairs for perpetual care 28
3131 cemeteries, in a sum not to exceed .............................. $10,000,000. 29

3737 TRANSFER. Immediately upon the effective date of this Act, the C hief Fiscal 1
3838 Officer of the State shall transfer on his or her books and those of the 2
3939 State Treasurer and the Auditor of St ate the sum of ten million dollars 3
4040 ($10,000,000) from the General Revenue Allotment Reserve Fund to a cash fund 4
4141 deposited in the State Treasury as determined by the Chief Fiscal Officer of 5
4242 the State for grants for structural maintenance, roads, drainage, fencing and 6
4343 other repairs for perpetual care cemeteries. 7

4545 SECTION 3. COMPLIANCE WITH OTHER LAWS. Disbursement of funds 9
4646 authorized by this act shall be limited to the appropriation for such agency 10
4747 and funds made available by law for the support of such appropriations; and 11
4848 the restrictions of the State Procurement Law, the General Accounting and 12
4949 Budgetary Procedures Law, the Revenue Stabilization Law, the Regular Salary 13
5050 Procedures and Restrictions Act, or their successors, and other fiscal 14
5151 control laws of this State, where applicable, and regulations promulgated by 15
5252 the Department of Finance and Administration, as authorized by law, shall be 16
5353 strictly complied with in disbursement of said funds. 17

5555 SECTION 4. LEGISLATIVE INTENT. It is the intent of the General 19
5656 Assembly that any funds disbursed under the authority of the appropriations 20
5757 contained in this act shall be in compliance with the stated reasons for 21
5858 which this act was adopted, as evidenced by the Agency Requests, Executive 22
5959 Recommendations and Legislative Recommendations contained in the budget 23
6060 manuals prepared by the Department of Finance and Administration, letters, or 24
6161 summarized oral testimony in the official minutes of the Arkansas Legislative 25
6262 Council or Joint Budget Committee which relate to its passage and adoption. 26

6464 SECTION 5. EMERGENCY CLAUSE. It is found and determined by the General 28
6565 Assembly, that the Constitution of the State of Arkansas prohibits the 29
6666 appropriation of funds for more than a one (1) year period; that the 30
6767 effectiveness of this Act on the date of its passage and approval is 31
6868 essential to the operation of the agency for which the appropriations in this 32
6969 Act are provided, and that in the event of an extension of the Regular 33
7070 Session, the delay in the effective date of this Act beyond the date of its 34
7171 passage and approval could work irreparable harm upon the proper 35
7272 administration and provision of essential governmental programs. Therefore, 36 HB1577

7575 an emergency is hereby declared to exist and this Act being necessary for the 1
7676 immediate preservation of the public peace, health and safety shall be in 2
7777 full force and effect from and after the date of its passage and approval. If 3
7878 the bill is neither approved nor vetoed by the Governor, it shall become 4
7979 effective on the expiration of the period of time during which the Governor 5
8080 may veto the bill. If the bill is vetoed by the Governor and the veto is 6
8181 overridden, it shall become effective on the date the last chamber overrides 7
8282 the veto. 8
