21	21	FOR THE 2024-2025 FISCAL YEAR. 19

23	23	BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS: 21

25	25	SECTION 1. APPROPRIATION - PERPETUAL CARE CEMETERIES - GRANTS. There 23
26	26	is hereby appropriated, to the Department of Commerce - State Insurance 24
27	27	Department, to be payable from the cash fund deposited in the State Treasury 25
28	28	as determined by the Chief Fiscal Officer of the State , the following: 26
29	29	(A) for grants for structural maintenance, roads, drainage, fencing, 27
30	30	irrigation, unpaid maintenance expense and other repairs for perpetual care 28
31	31	cemeteries, in a sum not to exceed .............................. $10,000,000. 29

33	33	SECTION 2. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS 31

37	37	TRANSFER. Immediately upon the effective date of this Act, the C hief Fiscal 1
38	38	Officer of the State shall transfer on his or her books and those of the 2
39	39	State Treasurer and the Auditor of St ate the sum of ten million dollars 3
40	40	($10,000,000) from the General Revenue Allotment Reserve Fund to a cash fund 4
41	41	deposited in the State Treasury as determined by the Chief Fiscal Officer of 5
42	42	the State for grants for structural maintenance, roads, drainage, fencing and 6
43	43	other repairs for perpetual care cemeteries. 7

45	45	SECTION 3. COMPLIANCE WITH OTHER LAWS. Disbursement of funds 9
46	46	authorized by this act shall be limited to the appropriation for such agency 10
47	47	and funds made available by law for the support of such appropriations; and 11
48	48	the restrictions of the State Procurement Law, the General Accounting and 12
49	49	Budgetary Procedures Law, the Revenue Stabilization Law, the Regular Salary 13
50	50	Procedures and Restrictions Act, or their successors, and other fiscal 14
51	51	control laws of this State, where applicable, and regulations promulgated by 15
52	52	the Department of Finance and Administration, as authorized by law, shall be 16
53	53	strictly complied with in disbursement of said funds. 17

55	55	SECTION 4. LEGISLATIVE INTENT. It is the intent of the General 19
56	56	Assembly that any funds disbursed under the authority of the appropriations 20
57	57	contained in this act shall be in compliance with the stated reasons for 21
58	58	which this act was adopted, as evidenced by the Agency Requests, Executive 22
59	59	Recommendations and Legislative Recommendations contained in the budget 23
60	60	manuals prepared by the Department of Finance and Administration, letters, or 24
61	61	summarized oral testimony in the official minutes of the Arkansas Legislative 25
62	62	Council or Joint Budget Committee which relate to its passage and adoption. 26

64	64	SECTION 5. EMERGENCY CLAUSE. It is found and determined by the General 28
65	65	Assembly, that the Constitution of the State of Arkansas prohibits the 29
66	66	appropriation of funds for more than a one (1) year period; that the 30
67	67	effectiveness of this Act on the date of its passage and approval is 31
68	68	essential to the operation of the agency for which the appropriations in this 32
69	69	Act are provided, and that in the event of an extension of the Regular 33
70	70	Session, the delay in the effective date of this Act beyond the date of its 34
71	71	passage and approval could work irreparable harm upon the proper 35
72	72	administration and provision of essential governmental programs. Therefore, 36 HB1577

75	75	an emergency is hereby declared to exist and this Act being necessary for the 1
76	76	immediate preservation of the public peace, health and safety shall be in 2
77	77	full force and effect from and after the date of its passage and approval. If 3
78	78	the bill is neither approved nor vetoed by the Governor, it shall become 4
79	79	effective on the expiration of the period of time during which the Governor 5
80	80	may veto the bill. If the bill is vetoed by the Governor and the veto is 6
81	81	overridden, it shall become effective on the date the last chamber overrides 7
82	82	the veto. 8
